Delegate Trinh Xuan An ( Dong Nai delegation) expressed his agreement when the draft law added the concept of "advertising transmitter", including "influencer". However, according to the delegate, the current definition and regulations on influencers are still unclear.
According to Decree No. 55/2024/ND-CP of the Government detailing a number of articles of the Law on Protection of Consumer Rights and the Law on Protection of Consumer Rights, influencers are often people with professional qualifications and have a certain influence on consumer behavior. However, in reality, many situations arise: Famous people such as beauty queens, models, singers, and actors only rely on their beautiful images and popularity to participate in product advertising without any expertise or understanding of that product.
"We have to tighten the rules so that advertisers are influential people. Only people who are both influential and have professional skills can advertise. A beauty queen or an actress who advertises knows nothing about the product but still advertises because of her beautiful image. It is very difficult for them to know the quality of the product," said delegate Trinh Xuan An.
Delegate Huynh Thi Phuc (Ba Ria-Vung Tau delegation) said that the situation of false advertising of functional foods, social consumer goods from luxury to essential, even products serving daily meals, is not only an issue of social concern but has been expressed at least twice in the question and answer sessions at the 15th National Assembly .
Therefore, according to the delegate, along with regulations on the responsibility of organizations and individuals doing business in advertising services and advertising distribution, the draft law needs to increase administrative sanctions against groups of influential people, celebrities, Facebookers, YouTubers, TikTokers when transmitting false advertising products. Because they are the ones who have the ability to guide and influence people's consumption decisions, having a direct impact on the lives and health of users.

Regarding the compensation mechanism for false advertising activities of advertising carriers, especially famous people, delegates said that it needs to be more clearly regulated in the law. "It is possible to supplement their obligations, to be jointly responsible for compensation for their false advertising actions," delegate Tran Khanh Thu suggested.
