AI is changing rapidly, laws must be timely and flexible

(Chinhphu.vn) - Minister of Science and Technology Nguyen Manh Hung said that the Law on Artificial Intelligence (AI) is a framework law, focusing on defining principles and governance frameworks, ensuring flexibility for the Government in organizing implementation due to rapid changes in AI. Technical and detailed regulations will be included in the decree.

Minister of Science and Technology Nguyen Manh Hung spoke to explain and clarify a number of issues raised by National Assembly deputies.

On November 27, continuing the 10th session, the National Assembly discussed the draft Law on Artificial Intelligence (AI).

The majority of the National Assembly deputies agreed on the need to promulgate the Artificial Intelligence Law project. Although the time is very urgent, the draft law has many new contents, is technically specialized, complex, and covers many fields, the Government, the Ministry of Science and Technology, the Committee on Science , Technology and Environment, together with the National Assembly agencies, have actively and promptly prepared the draft law dossier, the review report, and the initial explanation and acceptance report for the draft law.

After receiving and initially revising the draft law according to the opinions of relevant National Assembly deputies, it has basically met the proposed viewpoints, goals and requirements.

Speaking to explain and clarify a number of issues raised by National Assembly deputies, Minister of Science and Technology Nguyen Manh Hung said that not many countries in the world have issued AI Laws. The first AI Law issued by the EU was also issued in 2024; the first three countries to have AI Laws are the EU, South Korea and Japan.

Other countries have strategies, guidelines, regulations or are drafting laws, but because AI is the core technology of the 4th industrial revolution and determines the country's development, it is really necessary to have an AI Law soon so that we can develop AI proactively and systematically to attract investment, to develop the country quickly and sustainably.

According to the Minister, the AI ​​Law is a 20-page framework law, focusing on defining principles and governance frameworks, ensuring flexibility for the Government in implementation because AI changes rapidly, technical and detailed regulations will be included in the decree. A short law accompanied by a decree is an appropriate approach to new technology.

The Minister clarified that the approach to AI governance is a form of intelligence. For thousands of years, humans have managed intelligence by managing inputs through education and formal information, managing decision-making activities through laws, ethics and professional standards, and managing outputs through social supervision and clear accountability.

With AI, the same principle applies: Input data is managed through the Data Law and the Personal Data Protection Law, AI models must undergo risk assessment, independent testing and ensure accountability for output, where risks become reality, the State manages with safety standards, post-audit mechanisms and sanctions when consequences arise.

If the law is too closed, we will fall behind.

Regarding human-centered AI development, the overriding principle is that AI must serve humans and not replace their decisive role. The law stipulates transparency, people must know when interacting with AI and legal responsibility when AI causes damage. The responsibilities of developers, suppliers, deployers and users are all clearly defined. The green AI aspect is also mentioned because AI can be a large electricity consuming industry.

Regarding the construction of artificial intelligence infrastructure, the State will build a national AI supercomputing and data center to serve the research, training and development of AI infrastructure, including Vietnamese and ethnic minority language models, avoiding complete dependence on foreign countries. AI requirements in public services and sensitive areas must run on Vietnam's AI infrastructure; develop technical standards, encourage AI based on open source code, and issue an AI ethics framework.

The law identifies priority applications of AI in public administration, research and development, healthcare, education, agriculture, industry, and transportation, while encouraging services to social security, people with disabilities, children, and cultural preservation.

Policies to support AI development were also proposed, including encouraging research, startups, tax incentives for AI startups; creating a legal “sandbox” for AI development, supporting quick file processing and exemption from legal obligations; establishing a separate AI investment fund, prioritizing public procurement of AI products, supporting product commercialization through vouchers, training and attracting high-quality human resources. The Minister emphasized that AI is a national strategic technology that requires fast, flexible funding mechanisms and large investments for development.

Regarding AI management according to risk levels, the draft law divides it into 3 levels: Low, medium and high, and also adds prohibited behaviors. For high-risk AI, the law provides a minimum pre-inspection mechanism before deployment along with post-inspection, businesses must prepare safety assessment documents but only present them when requested by the management agency.

According to the Minister, AI and its problems are like two sides of the same coin. AI problems can be solved by AI itself, for example, training AI human resources with AI technology, detecting AI ethics violations with AI, and detecting deepfake manipulation with AI.

"AI and its problems will always exist. We cannot eliminate them, but must live with them and manage them wisely. How we live with them is our choice. That is the content of the AI ​​Law, and the main spirit of the law is harmony, development, and safety," said Minister Nguyen Manh Hung.

Concluding the discussion, Vice Chairman of the National Assembly Le Minh Hoan emphasized that first and foremost, the Law on Artificial Intelligence must be for people, directed towards people and must protect people. Based on the fast and accurate calculations of artificial intelligence, only people can breathe life into human values. The law needs to be designed to ensure that all applications of artificial intelligence serve the interests of the community, do not harm vulnerable groups, and do not create any new equality in society.

The Law on Artificial Intelligence must promote innovation and be flexible enough for the future. AI platforms are changing every day, every hour, if the law is too closed, we will fall behind; if the law is open and has a clear strategic direction, we can take advantage. Therefore, the law needs to design regulations according to the principle of being able to update, avoiding going into short-term details.
