Accordingly, in order to improve the effectiveness of managing multi-level marketing activities and combating crimes related to this business method, the Minister of Industry and Trade requested the units under the Ministry and the National Competition Commission to urgently review, propose amendments and complete legal regulations on managing multi-level marketing activities in the direction of strengthening strict control over security and order, especially for new licensing cases.
In addition, it is necessary to focus on preventing the risk of violating security and social order as well as manifestations that go against cultural traditions, ethical standards and customs of the nation. At the same time, coordinate with relevant agencies of the Ministry of Public Security to review and propose amendments and supplements to the provisions of the Penal Code related to crimes arising from multi-level marketing business activities.
In addition, strengthen inspection, examination, and strictly handle violations of the law in multi-level sales activities; continue to effectively monitor the implementation of the law in managing this business activity for the Departments of Industry and Trade; advise the Ministry's leaders to rectify the management of multi-level business activities at the local level.
The Ministry of Industry and Trade also requested units to actively coordinate with the Public Security and Police agencies to fight against crimes in multi-level marketing activities; strengthen propaganda activities, disseminate knowledge and laws to raise people's awareness of multi-level marketing activities. On the other hand, coordinate and train officials and civil servants of the Department of Industry and Trade of provinces and centrally run cities to improve their expertise and management skills in multi-level marketing; act as a focal point to receive recommendations, proposals and reports related to the management of this business activity to promptly synthesize and report to the Ministry's leaders.
The Department of Domestic Market Management and Development shall take the lead in advising on the development and completion of regulations on administrative sanctions for violations in multi-level marketing activities; provide training and professional guidance to Market Management Sub-Departments in inspecting and handling violations in multi-level marketing activities.
The Legal Department shall coordinate with the National Competition Commission in reviewing, researching, and proposing amendments and supplements to legal documents on the management of multi-level marketing activities. The Ministry Office shall coordinate with the National Competition Commission in the publication of administrative procedures, propose the reduction and simplification of administrative procedures, and provide online public services in the field of multi-level marketing management; coordinate and provide information to the press on issues related to multi-level marketing activities.
The Department of E-commerce and Digital Economy coordinates and supports the National Competition Commission in deploying administrative procedures in multi-level sales activities on the Ministry of Industry and Trade's online public service portal. In addition, coordinates with the National Competition Commission to research and develop regulations on the management of cross-border e-commerce platforms using multi-level business models. The Ministry's press and media units coordinate and support the National Competition Commission in disseminating and popularizing laws on multi-level business.
For the Department of Industry and Trade of provinces and centrally run cities, coordinate to contribute opinions in the process of amending and perfecting legal regulations on the management of multi-level business activities in the locality. In particular, advise the People's Committees of provinces and centrally run cities to issue regulations, rules, and directives within their authority (in cases where they have not been issued) and organize the implementation (in cases where they have been issued) seriously, regularly, and continuously of the coordination regulations between relevant local agencies in the inspection, examination, and supervision of multi-level business activities in the locality.
In addition, the Ministry of Industry and Trade proposed to strengthen inspection, examination and handling of violations of the law in multi-level marketing activities; at the same time, closely monitor the activities of conferences, seminars and training on multi-level marketing in the area; actively coordinate with the Public Security and Police agencies in the fight against crimes related to multi-level marketing business activities. In addition, continue to strengthen propaganda activities, disseminate knowledge and laws to raise people's awareness of multi-level marketing activities; train local officials and civil servants to improve their expertise and management skills in multi-level marketing.
The Ministry of Industry and Trade also noted the strict implementation of the periodic reporting regime to the Ministry of Industry and Trade on the management of this activity, ensuring compliance with the prescribed deadline.
