Vegetable oil for animal feed is "magically" transformed into cooking oil for humans.
Recently, VTV reported that Hung Yen Provincial Police in coordination with relevant agencies had dismantled a fake cooking oil production and consumption ring with a scale of up to tens of thousands of tons. These establishments used imported cooking oil for animal feed to process into consumer products for humans. Typical examples are Nhat Minh Food Production and Import-Export Company Limited with Ofood soybean oil products, along with An Duong Trading and Service Company Limited, An Hung Phuoc Company Limited.
According to the representative of the Ministry of Industry and Trade , the act of using vegetable oil raw materials of animal feed origin to produce and process food for human consumption is an act of intentionally distorting the nature, uses and purposes of goods, showing signs of constituting the act of producing and trading in counterfeit goods according to the provisions of Clause 7, Article 3 of Decree No. 98/2020/ND-CP.
Vegetable oil used for animal husbandry does not meet food safety and hygiene standards and has no uses or value for consumers. When intentionally introduced into the food production chain for humans and labeled as "vegetable oil" or "cooking oil for humans", the nature and uses are distorted; there are signs of counterfeiting the uses and purposes of the goods. In addition, labeling vegetable oil for human use is an act of fraud regarding the nature of the goods. This act poses a serious risk to public health and violates the rights of consumers.
The representative of the Ministry of Industry and Trade added that, according to the provisions of Article 65 of the Law on Food Safety, Article 40 of Decree No. 15/2018/ND-CP, the Provincial People's Committee is responsible for implementing state management of food safety in the locality, responsible to the Government for food safety in the locality; Organizing the reception of self-declaration of products, certification of establishments meeting food safety conditions according to assignment and decentralization; Inspecting, checking, and handling violations of food safety laws in the management area.
Based on preliminary information collected to date, Nhat Minh Food Production and Import-Export Company Limited has self-declared its products for vegetable oil products. However, the Ministry of Industry and Trade has not yet issued a Food Safety Certificate to this enterprise. At the same time, the Ministry of Industry and Trade has not yet received reports from local authorities and relevant agencies on the above-mentioned acts of producing and consuming fake cooking oil.
Resolutely handle violations
The representative of the Ministry of Industry and Trade informed that recently, in performing the state management function on food safety assigned in legal documents, the Ministry has issued Official Dispatch No. 2192/BCT-CN dated April 23, 2025 to the People's Committees of provinces and cities on strengthening the management of food production and circulation under the management of the Ministry of Industry and Trade and Official Dispatch No. 2755/CD-BCT dated April 18, 2025 on strengthening the work of monitoring, inspection and market control.
In the coming time, the Ministry will continue to direct the Departments of Industry and Trade and coordinate with the People's Committees of provinces and centrally-run cities to direct local functional units to conduct large-scale inspections of cooking oil production facilities, especially small-scale facilities, facilities without food safety certificates, and facilities exempted from food safety certificates.
At the same time, the Ministry also assigned the Department of Domestic Market Management and Development to preside over and coordinate with the Departments of Industry and Trade of provinces and centrally-run cities to urgently direct the Market Management Sub-Departments to closely monitor establishments producing, processing and trading edible oil products nationwide; strengthen inspection, strictly handle violations and promptly report results and situations to the Ministry of Industry and Trade.
Along with that, strictly handle violations. At the same time, strengthen propaganda to warn consumers, publicize brands and establishments that violate.
"The above incident shows signs of serious violations of the law on production and trade of counterfeit goods, commercial fraud, protection of consumer rights and violations of prohibitions under the law on food safety. The Ministry of Industry and Trade will direct functional units to continue to coordinate with competent authorities to handle it resolutely, not to affect the reputation of the food industry and consumer confidence," the representative of the Ministry of Industry and Trade emphasized.
