The Ministry of Agriculture and Rural Development issued a Circular amending and supplementing a number of articles of circulars in the forestry sector.

Deputy Minister of Agriculture and Rural Development Nguyen Quoc Tri has just signed and issued Circular No. 24/2024/TT-BNNPTNT dated December 12, 2024 of the Ministry of Agriculture and Rural Development amending and supplementing a number of articles of circulars in the forestry sector.

Accordingly, the new Circular amends and supplements a number of articles of Circular No. 15/2019/TTBNNPTNT dated October 30, 2019 of the Minister of Agriculture and Rural Development on guiding a number of contents on investment management of forestry works.

Specifically, this Circular stipulates the acceptance of results of a number of investment activities and investment support for forestry projects, including: afforestation, development of non-timber forest products, care of planted forests, nurturing planted forests, zoning and promoting natural regeneration, zoning and promoting natural regeneration with additional planting, nurturing natural forests, enriching natural forests, improving natural forests; acceptance of forest protection; acceptance of scattered tree planting".

Amend and supplement Article 2 as follows: This Circular applies to organizations, households, individuals, and communities engaged in activities related to the acceptance of results of a number of investment activities, support for investment in forestry works, acceptance of forest protection, acceptance of scattered tree planting as prescribed in Article 1 of this Circular using State budget funds. Organizations, households, individuals, and communities are encouraged to apply the provisions of this Circular when using funds outside the State budget."

The regulations on acceptance are also amended and supplemented. Time of acceptance: carried out immediately after completing each forestry item according to the acceptance request of the construction party. Acceptance members include representatives of the parties: the investor or the unit using the State budget (hereinafter referred to as the investor) or the supervisor and the construction party.

Circular No. 24 also amends and supplements a number of articles of Circular No. 25/2022/TTBNNPTNT dated December 30, 2022 of the Minister of Agriculture and Rural Development regulating replacement forestation when converting forest use to other purposes, which has been amended and supplemented by a number of articles according to Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023 of the Minister of Agriculture and Rural Development.

Specifically, regarding the organization of replacement forestation, for provinces and centrally-run cities that can arrange their own land funds for replacement forestation: carry out forestation on land planned for special-use forests and protection forests; plant forests on land planned for production forests assigned to forest owners who are State-owned enterprises or forest owners specified in Clauses 1, 3 and 4, Article 8 of the Forestry Law; support the planting of production forests of large timber species (exploited after 10 years of age) on land planned for production forests assigned to households and individuals;

For provinces and centrally-run cities that receive funds for replacement forest planting from other localities that no longer have land for replacement forest planting, they shall plant special-use forests, protection forests, and production forests on land planned for special-use forests, protection forests, and production forests.”;

According to Article 3 of Circular 24, the name of Article 11 of Circular No. 28/2018/TT-BNNPTNT dated November 16, 2018 of the Minister of Agriculture and Rural Development on sustainable forest management, which has been amended and supplemented in Clause 5, Article 1 of Circular No. 13/2023/TT-BNNPTNT dated November 30, 2023 of the Minister of Agriculture and Rural Development, will be amended. Specifically, Article 11 is amended as: "Approve or adjust the sustainable forest management plan of forest owners who are organizations under ministries and branches".

Article 4 of Circular 24 stipulates amendments to Article 15 of Circular No. 29/2018/TT-BNNPTNT dated November 16, 2018 of the Minister of Agriculture and Rural Development regulating silvicultural measures, which has been amended and supplemented by a number of articles according to Circular 17/2022/TT-BNNPTNT dated October 27, 2022, Circular No. 22/2023/TT-BNNPTNT dated December 15, 2023 of the Minister of Agriculture and Rural Development on amending and supplementing a number of articles of circulars in the forestry sector.

According to the amended Article 15, the Department of Forestry is responsible for organizing the implementation of this Circular nationwide; developing and promulgating technical guidelines for afforestation for major forestry tree species and scattered trees; and inspecting and evaluating the implementation of this Circular in localities.

This Circular takes effect from January 27, 2025.

In addition, the Ministry of Agriculture and Rural Development also issued Circular No. 23/2024/TT-BNNPTNT dated December 11, 2024 regulating economic and technical norms for forest boundary demarcation.

Accordingly, Circular No. 23/2024/TT-BNNPTNT applies to agencies, organizations and individuals using state budget capital, capital from legal revenue sources of state agencies and public service units to prepare records of forest boundary demarcation, set up markers and forest boundary demarcation boards of forest owners under the entire people's ownership as prescribed in Clause 1, Article 7 of the 2017 Forestry Law adjacent to adjacent forest owners, adjacent land users, boundaries between sub-zones, compartments and forest status lots in Vietnam and related organizations and individuals.

Organizations, households, individuals, and communities are encouraged to use capital sources not covered by Clause 1 of this Article to apply the provisions of this Circular to prepare records for forest boundary demarcation, marker planting, and forest boundary demarcation boards.
