Pursuant to Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus, the Ministry of Home Affairs provides guidance on a number of contents related to the establishment of a provincial-level occupational accident investigation team.
According to the Ministry of Home Affairs, at Point b, Clause 1, Article 7 of Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly , it is stipulated that after the reorganization of the state apparatus, an agency that no longer conducts inspections shall perform inspection functions and tasks within the scope of state management as prescribed by law. The agency assigned to perform specialized inspection functions after the reorganization of the state apparatus shall not perform specialized inspection functions but shall perform specialized inspection functions and tasks as prescribed by law.
Based on the above provisions and Clause 2, Article 35 of the Law on Labor Safety and Hygiene, the Ministry of Home Affairs clearly states that the Department of Home Affairs is responsible for establishing a provincial-level labor accident investigation team.
The composition of the labor accident investigation team decided by the Department of Home Affairs includes: Representative of the unit (department) under the Department of Home Affairs with the function of advising on the implementation of state management tasks in the field of labor safety and hygiene as head of the team; representative of the Department of Health ; representative of the provincial Labor Federation and other members (if deemed necessary).
The Ministry of Home Affairs requested that the Departments of Home Affairs promptly establish provincial-level labor accident investigation teams to investigate accidents in accordance with legal regulations./.
