Speaking at the opening of the training course, Director of the Department of Organization and Personnel, Office of the National Assembly Trinh Ngoc Duc stated that the training course on Bidding Law aims to update and improve professional knowledge and skills for cadres, civil servants and public employees working in bidding and project management to meet job requirements.

In order for the training course to be effective and successful, the Office of the National Assembly invited lecturers who are experienced people from departments and units under the Ministry of Planning and Investment ; requested that delegates participating in the training course take advantage of their time, actively research, exchange, discuss, and acquire practical knowledge to apply in the actual work assigned.

In the training program, trainees were informed and conveyed 2 topics, including: Important new perspectives of the Law on Bidding and Decree No. 24/2024/ND-CP of the Government detailing a number of articles and measures to implement the Law on Bidding on contractor selection; a number of issues on medium-term and annual public investment planning of the Office of the National Assembly.

The Law on Bidding was passed by the 15th National Assembly at the 5th Session, effective from January 1, 2024, with 10 chapters and 96 articles.

The Law has added provisions to more strictly manage bidding activities of enterprises with capital from state-owned enterprises. Accordingly, in addition to state-owned enterprises as prescribed by the Law on Enterprises, the Law has added enterprises in which 100% of charter capital is held by state-owned enterprises. The Law also clearly defines the scope of regulation for activities of selecting investors to implement business investment projects, including: investment projects using land that must be organized for bidding according to the provisions of the law on land; investment projects that must be organized for bidding to select investors according to the provisions of the law on industry and sector management.

In addition, the Law has added a number of provisions to enhance the autonomy and self-responsibility of agencies, organizations and enterprises in selecting contractors on the basis of ensuring publicity, transparency, economic efficiency and accountability for procurement activities using production and business capital of state-owned enterprises...

Prohibited acts in bidding activities include: Giving, receiving, or brokering bribes; Taking advantage of one's position and power to influence or illegally interfere in bidding activities in any form; Bid collusion; Fraud...

Regarding some contents that central agencies need to pay attention to in the process of developing the medium-term public investment plan for the next period, the lecturers clearly stated that the development of the capital allocation plan for the next period must be consistent with the investment orientation of the industry, field, ministry, and central agency in the period. Capital allocation in order of priority: Projects that have been completed and put into use but have not yet been allocated enough capital; ODA project counterpart capital; State capital participating in PPP projects; transitional projects according to approved progress; projects expected to be completed within the planning period; new projects starting construction.

In addition, capital allocation must be prioritized, not spread out, and must be close to the implementation and disbursement capacity of the stage. The development of a capital allocation plan for the next stage must also take into account the capital structure of each sector and field of the Ministry, central agencies, etc.
