Recently, the National Assembly discussed the draft law amending and supplementing a number of articles of 10 laws related to security and order. The National Assembly is expected to vote and pass this bill on December 10.
The person granted an electronic identity card must not be required to present documents or provide integrated information.
In particular, with the Law on Identification, amending and supplementing regulations on identification management agencies; revocation of identification cards; and the value of use of electronic identification cards.
Amend and supplement regulations of administrative procedures to create more favorable conditions for people.
According to the draft law, the identity management agency is the agency assigned by the Ministry of Public Security to perform the task of managing identity cards, the national population database, the identity database, the electronic identification and authentication system, including: the identity management agency of the Ministry of Public Security, the provincial/municipal Public Security, and the police of communes, wards, and special zones.
Regarding the place to carry out procedures for issuing, exchanging, and re-issuing ID cards, the draft law stipulates the ID management agency of the provincial and city police and the police of communes, wards, and special zones.
The draft law supplements the provision that if a person granted an electronic identity card must present the identity card at the request of a competent agency, organization or individual, that agency, organization or individual may not request the person granted an electronic identity card to present documents or provide information that has been integrated into the electronic identity card.
Previously, the Ministry of Public Security - the drafting agency - said that the current law regulating the validity of electronic identification cards does not stipulate the content of the case where the person granted an identification card must present the identification card at the request of a competent agency, organization or individual.
Therefore, that agency, organization or individual is not allowed to request the card holder to present documents or provide information that has been printed or integrated into the identity card.
It is also recommended that in case the information has changed compared to the information on the ID card, the cardholder must provide legally valid documents and papers proving the information has changed.
This leads to many agencies, organizations and individuals still requiring citizens to present documents or provide information that has been integrated into the electronic ID.
Therefore, it is necessary to add a regulation that does not require the presentation of documents or the provision of information that has been integrated into the electronic identity card.
The drafting agency believes that if this provision is not promptly supplemented, it will lose the value of integrating information into electronic identification, making people not see the benefits of using electronic identification.
People can apply for and change their ID cards online.
Regarding regulations on procedures for issuing, changing, and re-issuing ID cards, the bill also proposes changes to create favorable conditions for people.
People whose information on their ID cards changes due to administrative unit reorganization, people whose ID cards are lost or damaged and cannot be used can apply for a replacement or reissue of their ID cards online on the public service portal, national identification application or directly at the place where ID card issuance procedures are carried out.
The ID management agency uses the most recently collected facial photo, fingerprint, iris information and existing information in the National Population Database and ID Database to reissue ID cards.
