There needs to be a strategy to "repatriate" antiques, relics, and antiquities to the country.

One of the issues that delegates were interested in and gave opinions on at the meeting was the regulations on the management of national relics, antiques, and treasures.

According to Most Venerable Thich Duc Thien ( Dien Bien Delegation), Vietnamese Buddhism with more than 2000 years of history has become an indispensable cultural element in the Vietnamese cultural and cultural tradition. Buddhism has created a large part of Vietnam's cultural heritage, in the fields of tangible cultural heritage, intangible cultural heritage, relics, antiquities, national treasures, and documentary heritage.

According to the Ministry of Culture, Sports and Tourism, up to now, the country has more than 41,000 historical and cultural relics, scenic spots; 130 special national relics, nearly 4,000 national relics, more than 10,000 provincial and city relics. Of which, Buddhist relics include 15 special national relics, 829 national relics, and more than 3,000 provincial and city relics. The Vinh Nghiem Pagoda Woodblocks have been recognized by UNESCO as a World Memory Heritage in the Asia- Pacific region, and many woodblocks in pagodas have been recognized as national treasures that we believe will be recognized by UNESCO in the future. Buddhist cultural relics account for about 25-30% of the total number of relics in the country.

Delegate Thien also said that pagodas, which are both religious establishments and historical and cultural relics, are defined by the Charter of the Vietnam Buddhist Sangha as religious establishments, under the management of the Sangha at all levels; at the same time, the 2016 Law on Belief and Religion stipulates that these are religious establishments directly managed and used by the Vietnam Buddhist Sangha, and that they are the representative of the community owner. Therefore, the draft Law needs to clearly stipulate the rights, obligations, and responsibilities of religious organizations in managing, protecting, and promoting the value of cultural heritage in these cases.

Delegate Thien suggested that the Government should have a strategy to repatriate antiquities, bringing relics and antiques of Vietnamese origin from abroad back to the country. In order to truly encourage organizations and individuals at home and abroad to discover, purchase, donate, and transfer to the State relics and antiques of Vietnamese origin from abroad back to the country, the draft Law should consider stipulating exemption of related taxes and fees for relics and antiques repatriated to the country not for the purpose of exchange, sale, or business for profit. Only then can resources for repatriating antiquities to the country be truly attracted.

According to Deputy Huynh Thi Phuc (Ba Ria-Vung Tau Delegation), the Drafting Committee needs to consider and add organizations and individuals participating in performing work related to the field of history along with organizations and individuals such as associations in the fields of literature, arts, science and technology.

“In addition to the Science and Technology Association, the Historical Science Association from the central to local levels has been actively participating in research activities, protecting and promoting the value of cultural heritage as well as conducting appraisals of relics and antiquities. Article 39 of the draft Law stipulates professional requirements when appraising relics and antiquities. It is necessary to consider supplementing this content,” said Ms. Phuc.

Regarding the work of protecting and promoting the value of cultural heritage, according to Ms. Phuc, this work is not only about the tasks of repairing, restoring, and preventing the risk of heritage degradation, but also about the tasks and solutions to best promote the value of heritage; at the same time, fully and responsibly implement the committed measures to protect cultural heritage.

Studying Article 63 of the draft Law on the duties of museums; Articles 41, 44, 48 on management, protection, preservation, and display of relics and antiques and the current situation of many artifacts after being excavated and collected not being really protected, preserved, ensuring technical requirements in the environment, in accordance with the requirements on management and display of artifacts, Ms. Phuc recommended that the draft Law needs to have more strict and specific regulations on the conditions and responsibilities for management, protection, preservation, and display of relics, antiques, and treasures.
