On the afternoon of November 8, the National Assembly listened to the Presentation and Verification Report on the draft Law on Defense and Security Industry (DIS) and Industrial Mobilization.
Building Laws to perfect mechanisms and policies to meet immediate and long-term construction and development needs
Presenting the Report on the draft Law on Defense Industry, Security and Industrial Mobilization, Minister of National Defense Phan Van Giang said that the Defense Industry (NDI), Security Industry (CNAN) and Industrial Mobilization (IMO) have always received special attention, leadership and direction from the Party and State in the process of construction and development; the Party's viewpoints, guidelines and policies are expressed in political documents.
According to General Phan Van Giang, from the reality of wars and conflicts in the world in recent years, especially the ongoing Russia-Ukraine conflict, the forecast of future wars and the requirement to protect national security, ensure social order and safety in the new situation have posed requirements and demands to build a self-reliant, self-reliant, modern, dual-use national defense and security industrial potential; carry out widespread industrial mobilization to proactively prevent early, from afar, repel and be ready to respond successfully in all situations, with enough internal strength to defeat all forms of aggressive wars, and protect national security.
Minister of National Defense Phan Van Giang said that the purpose of building the Law is to perfect mechanisms and policies to meet the needs of building and developing the defense industry, security and non-business units in the short and long term, including ensuring specific mechanisms and policies for particularly important areas of the defense industry and security; promoting the role, functions and tasks of the defense industry, security and non-business units in ensuring weapons, technical equipment and professional technical means for the people's armed forces; organizing innovation and rearranging the system of defense industry facilities and security facilities in accordance with the characteristics of the defense industry, security and non-business units and in association with the combat methods of the Army and the tasks of the Public Security, responding to the market economy and global integration; ensuring concentration, unity, effectiveness and efficiency of state management of the defense industry, security and non-business units.
At the same time, mobilize economic sectors and enterprises outside the people's armed forces with financial and scientific and technological potential to participate in investing in the development of defense industry and security and perform the tasks of a military unit, participate in the production and repair of weapons, technical equipment, and professional technical means for the people's armed forces; promote international cooperation and integration...
Minister of National Defense Phan Van Giang said that the draft Law on Defense Industry, Security and Non-Profiting Units has a structure of 07 chapters and 73 articles. The basic content of the draft Law on Defense Industry, Security and Non-Profiting Units focuses on 05 outstanding policies including: Developing the defense industry and non-profiting unit in a dual-use direction, ensuring the participation of enterprises, organizations and individuals in defense industry and non-profiting unit activities; Completing, arranging and innovating the defense industry and non-profiting unit organizational system; Promoting science and technology activities to serve the development of defense industry and non-profiting unit; Mobilizing resources for the development of defense industry and non-profiting unit; Ensuring the effectiveness of defense industry and non-profiting unit activities...
Clarifying "other legal capital sources" in the development of defense and security industry
Reporting on the review of the draft Law on Defense Industry, Security and Industrial Mobilization, Chairman of the National Assembly's Committee on Defense and Security (NCS) Le Tan Toi said that the NCS agreed on the necessity of promulgating the Law on Defense Industry, Security and Industrial Mobilization (NCS and MIC) as stated in the Government's Submission to fully institutionalize the Party and State's policies and guidelines on the development of NCS and MIC.
At the same time, it is necessary to overcome the limitations and shortcomings after 15 years of implementing the Defense Industry Ordinance (DID), 20 years of implementing the DIV Ordinance and the practice of developing the security industry (SIE) since the 11th Party Congress to date; in order to create a complete and feasible legal corridor, contributing to firmly protecting the independence, sovereignty, unity and territorial integrity of the Fatherland, maintaining political security, social order and safety, maintaining a peaceful and stable environment for sustainable development of the country.
In addition, the National Defense and Security Committee recommends that the drafting agency of the Law project continue to review and evaluate more fully and comprehensively the political, legal and practical bases; clarify the close relationship between the defense industry, the defense industry and the public service; place the defense industry and the public service in the overall national industry and the whole economy, in response to the requirement of building and strengthening the country's defense and security potential to comprehensively assess and clarify the necessity of promulgating the Law.
The Committee for National Defense and Security found that the draft Law dossier submitted by the Government was basically in accordance with the provisions of the Law on Promulgation of Legal Documents, many contents were carefully and meticulously researched and prepared, and qualified to be reported to the National Assembly for consideration and comments, but it is necessary to research, continue to review, and fully supplement the draft detailed regulations, and further assess the impact on costs and budget to ensure feasibility.
Regarding the planning for the construction and development of the defense industry and the defense industry, the National Defense and Security Commission recognizes that the planning for the construction and development of the defense industry and the defense industry is an important content to guide the goal of building and developing a strong, self-reliant, and self-reliant defense industry, placed within the overall national industrial strategy. However, it is recommended to review and ensure the consistency and synchronization of the legal system and feasibility; study and supplement the provisions on planning adjustment in Article 9 to be consistent with Clause 4, Article 6 of the draft Law.
Regarding ensuring resources for the CNQPAN, the PCC basically agrees with the draft Law stipulating that financial resources for the development of the CNQPAN are guaranteed by the State budget and in the context of the State budget's difficulties, mobilizing other legal resources such as funds, loans, sponsorships, and post-tax deductions is appropriate. This will be an important material foundation to ensure the CNQPAN, but the Government plans not to stipulate "Specialized capital sources" but instead "other legal capital sources". This is a new issue, the implementation must be associated with a confidentiality regime, therefore, it is recommended to continue researching and clarifying to suit reality and be consistent in the legal system.
Regarding the policies and regimes in the People's Public Security Forces and the People's Public Security Forces, the People's Public Security Forces Committee finds that the classification of policies and regimes by subject and group of subjects is reasonable. However, some opinions say that the policies and regimes are still scattered and lack generality. At the same time, the regulations related to laws such as: Law on Officers of the Vietnam People's Army, Law on Professional Soldiers, Workers and National Defense Officials, Law on Amending and Supplementing a Number of Articles of the Law on the People's Public Security Forces, Law on National Security... Therefore, it is proposed that the study should only stipulate principles and assign the Government to stipulate details.
Regarding the regime and policies for experts, leading scientists, and chief engineers in the fields of research and production of weapons, strategic technical equipment, and special technical means, the National Defense and Security Commission proposes to study and stipulate more specifically and transparently the regime and policies for economic sectors and enterprises participating in investment in construction and development of the National Defense and Security Industry and the National Defense and Security Service, ensuring consistency with Resolution No. 27-NQ/TW dated May 21, 2018 on reforming salary policies for cadres, civil servants, public employees, armed forces, and employees in enterprises and ensuring feasibility.
Regarding the responsibility for state management of the national defense and security industry and the national defense industry, Chairman of the National Defense and Security Committee Le Tan Toi said that the National Defense and Security Committee proposed to review the regulations on the responsibilities of the Ministries to suit their functions and tasks and only stipulate the responsibilities of a number of ministries with specific characteristics regarding the national defense and security industry and the national defense industry; at the same time, it proposed to study the formation of a model of a state management agency to coordinate the activities of the national defense and security industry, promoting the connection between the national defense and security industry and the national industry./.
