The program to send seasonal workers to Korea is a non-profit cooperation organized by local authorities, without the participation of businesses.
According to the Department of Overseas Labor Management (Ministry of Labor, War Invalids and Social Affairs), recently, some organizations and individuals have taken advantage of this form to advertise, sign contracts, collect money illegally, and promise to send workers to work seasonally in Korea.
The Department of Overseas Labor Management has requested the police agencies of some localities about the illegal acts of some organizations such as T&Q International Travel and Study Abroad Consulting Service Trading Company Limited, L&R Travel Service and Trading Company Limited.... These companies have organized the selection and collected money from workers to commit to sending them to work seasonally in Korea under E8 visas.
A representative of the Department of Overseas Labor Management affirmed that the program of sending seasonal workers to Korea is a non-profit cooperation program between Vietnamese and Korean localities organized and implemented by local authorities, without the participation of any enterprises.
To date, 12 localities including Da Nang, Dong Thap, Thai Binh, Ha Nam, Ha Tinh, Thua Thien-Hue, Ca Mau , Quang Binh, Hau Giang, Ha Giang, Lai Chau and Tuyen Quang have signed agreements with Korean localities to send seasonal workers to work in Korea.
The conditions for participating in the program are that the workers are aged 30-50, are long-term residents in the locality and sign an agreement; have full civil capacity, have no criminal record and are not banned from leaving the country or temporarily suspended from leaving the country according to the provisions of law; have good health to work abroad; are working in the fields of agriculture , fisheries, etc.
Regarding benefits, employees are paid according to the annual minimum wage prescribed by Korea (in 2023, the salary is 2,010,580 KRW/month, about 36 million VND/month). Overtime and working on holidays are paid according to Korean Labor Law.
Regarding accommodation conditions, the employer is responsible for arranging accommodation that ensures safety and hygiene for the employee during the entire period of the contract, has fire and explosion sensors, and has a complete heating and cooling system. Accommodation costs are deducted from the monthly salary and must be clearly agreed upon with the employee (reference level from 300,000 won to 400,000 won/month).
The employer shall partially support the cost of round-trip airfare for the employee. The employer shall register and pay for occupational accident insurance for the employee during the working period in Korea; provide free protective gear for the employee...
Workers are responsible for complying with labor safety regulations during working hours; complying with Korean law, regulations of the receiving locality and returning home immediately after the contract expires.

The Ministry of Justice of Korea has issued Order No. 1054 to announce the adjustment of some contents of the "Immigration Control Law Enforcement Rules." Accordingly, Korea allows E8 seasonal workers to extend their stay, the total stay not exceeding 8 months from the date of entry. The extension of the period of stay will be applied from June 30, 2023, including seasonal workers working in Korea under the E8 visa . Previously, seasonal workers working in Korea under the E8 visa had a maximum stay of 5 months. Seasonal workers in this program, if they work faithfully, can be invited and sent to Korea continuously every year. |
