Prime Minister requests to strengthen food poisoning prevention
Deputy Prime Minister Le Thanh Long signed Directive No. 38/CT-TTg dated October 11, 2024 of the Prime Minister requesting ministries, branches and localities to strengthen food poisoning prevention.
In the Directive, the Prime Minister requested the Ministry of Health to strengthen the implementation of food safety prevention, containment and remediation, especially the prevention of food poisoning risks; promptly correct limitations and shortcomings (if any); regularly urge and inspect the implementation of this work in localities, especially in key areas, large cities, tourist areas... where there are many collective kitchens, food service establishments for workers, students, tourists...; minimize the risk of food poisoning...
Conditions and procedures for establishing a kindergarten
The Government issued a Decree 125/2024/ND-CP Regulations on investment and operation conditions in the education sector; clearly stipulating the conditions and procedures for establishing kindergartens.
Decree stipulating conditions for establishing public nurseries, kindergartens, preschools or permitting the establishment of private nurseries, kindergartens, preschools (collectively referred to as preschools):
1- Have a project to establish or permit the establishment of a kindergarten in accordance with the provincial planning and relevant planning of the locality where the school is located.
2- The project clearly defines the objectives, tasks, programs and contents of preschool education; land, facilities, equipment, and planned location for school construction; organizational structure; resources and finance; strategic directions for building and developing preschools.
Conditions for establishing an association
The Government issued Decree No. 126/2024/ND-CP dated October 8, 2024 regulating the organization, operation and management of associations.
According to Decree 126/2024/ND-CP, the establishment of an association from November 26, 2024 must ensure the following conditions:
1- The name of the association must ensure the conditions according to regulations;
2- The main field of activity does not overlap with the main field of activity of a previously legally established association within the same scope of activity.
3- Have principles, purposes and fields of operation in accordance with legal regulations.
4- Have a charter, except for associations specified in Clause 5, Article 21 of this Decree.
5- Have headquarters as prescribed in Clause 2, Article 6 of this Decree.
6- There must be a sufficient number of Vietnamese organizations and citizens registered to participate in the establishment of the association, except in cases where laws and ordinances provide otherwise.
7- Have assets to ensure the operation of the association.
Supplementing the policy of visiting some units and individuals who are ethnic minorities
The Government issued Decree No. Decree No. 127/2024/ND-CP dated October 10, 2024 amending and supplementing a number of articles of Decree No. 05/2011/ND-CP dated January 14, 2011 of the Government on ethnic affairs.
Decree 127/2024/ND-CP supplements a special policy on visiting, congratulating, and supporting a number of units and individuals who are ethnic minorities to institutionalize the policy of "Strengthening social consensus; consolidating people's trust in the Party and State, promoting internal strength, overcoming difficulties and challenges, integrating and developing with the country...".
Amending regulations on maximum value of goods and services used for promotion
The Government issued Decree No. 128/2024/ND-CP dated October 10, 2024 amending and supplementing a number of articles of Decree No. 81/2018/ND-CP dated May 22, 2018 of the Government detailing the Law on Commerce on trade promotion activities.
Decree 128/2024/ND-CP amends a number of provisions related to the maximum value limit of goods and services used for promotion (Article 6) in Decree 81/2018/ND-CP. Accordingly, the maximum value limit of goods and services used for promotion is prescribed as follows:
The material value used for promotion for a unit of promoted goods or services must not exceed 50% of the selling price immediately before the promotion period of that unit of promoted goods or services, except for promotions in the forms prescribed in Clauses 8 and 9, Article 92 of the 2005 Commercial Law, Article 8, Clause 2, Article 9, Article 12, Article 13, Article 14 of Decree 81/2018/ND-CP.
The total value of goods and services used for promotion in a promotion program must not exceed 50% of the total value of the goods and services being promoted, except for promotions in the form prescribed in Clauses 8 and 9, Article 92 of the 2005 Commercial Law, Article 8 and Clause 2, Article 9 of Decree 81/2018/ND-CP.
In cases of organizing concentrated promotional programs, the maximum limit on the value of goods and services used for promotion is 100%. The maximum limit on the value of goods and services used for promotion of 100% is also applied to promotional activities within the framework of programs and trade promotion activities decided by the Prime Minister.
New regulations on declaration of eligibility for production of preparations and provision of disinfection services using preparations
The Government issued Decree No. 129/2024/ND-CP dated October 10, 2024 amending and supplementing a number of Articles of Decree No. 91/2016/ND-CP dated July 1, 2016 of the Government on the management of chemicals, insecticides and disinfectants used in the household and medical sectors; Decree No. 155/2018/ND-CP dated November 12, 2018 of the Government amending and supplementing a number of regulations related to investment and business conditions under the state management of the Ministry of Health.
In particular, Decree No. 129/2024/ND-CP amends and supplements Article 8 and Article 43 of Decree No. 91/2016/ND-CP regulating the declaration of eligibility to produce preparations and provide insect and bacteria extermination and disinfection services using preparations.
At the same time, Decree No. 129/2024/ND-CP also amends and supplements Articles 12 and 16 of Decree No. 155/2018/ND-CP regulating the declaration of eligibility to conduct testing and experimentation.
Approving the master plan for exploitation and sustainable use of coastal resources for the 2021-2023 period
Deputy Prime Minister Tran Hong Ha signed Decision No. 1117/QD-TTg dated October 7, 2024 approving the master plan for exploitation and sustainable use of coastal resources for the 2021-2023 period, with a vision to 2050.
According to the Decision, the specific objectives of the planning are to protect, maintain and restore the ecosystem, biodiversity and other values of the coastal area; increase the conservation area, protect natural values, marine ecology, and mangrove forests in the coastal area, contributing to the goal of achieving a minimum area equal to 6% of the natural area of the national sea.
