Following the success of the first Conference (September 2023), the second Conference was held in person (at the National Assembly House) combined with online to 63 connecting points in provinces and centrally run cities, with the participation of about 1,147 delegates, including 130 delegates at the central connecting point and more than 1,000 delegates from local connecting points. Notably, the second Conference was held earlier, taking place at the beginning of the year instead of September like last year, and less than 2 months after the closing of the Fifth Extraordinary Session. That shows the scale and appeal of the Conference on implementing laws and resolutions of the National Assembly in particular as well as the important role and significance of law enforcement in general.

"Handbook" for the implementation of laws and resolutions of the National Assembly

Although it is the second annual conference, its purpose and significance are consistent and continuous, aiming to implement the conclusions of the first conference , while continuing to implement the requirement of "closely linking law-making with law enforcement, ensuring that the law is implemented fairly, strictly, consistently, promptly, effectively and efficiently" ( according to Resolution No. 27-NQ/TW of the 6th Central Conference of the 13th National Assembly on continuing to build and perfect the Socialist Republic of Vietnam 's rule-of-law state ) as well as performing the National Assembly's supervisory function over the organization of law enforcement.

The National Assembly Standing Committee and the Ministry of Natural Resources and Environment have researched, compiled and published the book “Land Law - Questions and Answers” ​​to meet the requirements of disseminating and propagating the law. They have organized professional training in appropriate forms for civil servants assigned to implement the law, especially for specialized laws with many new and complex contents such as the Land Law, the Telecommunications Law, the Identity Law, the Law on Credit Institutions, etc.

Synchronously implement solutions to improve the effectiveness and efficiency of law enforcement, tighten discipline, promote the responsibility of leaders, the responsibility and proactiveness of civil servants, combined with strengthening inspection and examination to prevent, detect, promptly stop and resolutely handle negative behaviors, "group interests", "local interests" in law enforcement; promptly and effectively overcome the situation of pushing, avoiding, and lacking responsibility among a number of cadres and civil servants. Focus on organizing dialogues with businesses and people, promptly removing difficulties and obstacles arising in the process of organizing law enforcement.

Although the number of laws and resolutions implemented at this Conference is not as large as the first Conference (with 52 laws and resolutions, including 15 laws and 21 resolutions passed by the National Assembly from the beginning of the 15th term to before the Fifth Session and 8 laws and 8 resolutions passed at the Fifth Session), the 9 laws and 10 resolutions (passed by the National Assembly at the Sixth Session and the Fifth Extraordinary Session) are all very important contents, not only promptly resolving some shortcomings and limitations in practice, or having significance for the implementation of the socio-economic development plan for 2024, but also being very fundamental, strategic, and long-term, contributing to the sustainable development of the country in the new period. In particular, with the passage of the Land Law (amended) at the Fifth Extraordinary Session, the National Assembly has completed one of the most important legislative tasks of this term .

Therefore, organizing a National Conference to disseminate new points, key contents, requirements and main tasks of the 9 laws and 10 resolutions immediately after the National Assembly passed them is very timely, contributing to urging and speeding up the issuance of guiding documents and detailed regulations for implementation, enhancing the responsibility of the Government, ministries, branches, agencies and localities in putting the laws and resolutions of the National Assembly into practice as soon as they come into effect.

In terms of quantity, the number of laws and resolutions implemented at this Conference is not much, but if we consider the difficulty and complexity, the 9 laws and 10 resolutions implemented this time are much higher, with about 400 contents that need to be developed and issued according to the authority of detailed regulations and implementation instructions. For example, just with the implementation of the Land Law, there are 104 contents of the Law that the Government and Ministries are assigned to detail and guide the implementation. Not to mention the large number of other related sub-law documents that need to be reviewed for amendment and supplementation to ensure consistency with the 2024 Land Law and the 8 laws amended and supplemented in Section 1, Chapter XVI of the 2024 Land Law (including: Law on Planning, Law on Investment, Law on Forestry, Law on Fisheries, Law on Organization of Local Government, Law on Civil Judgment Enforcement, Law on Personal Income Tax, Law on Non-agricultural Land Use Tax).

With such difficulties and complexities, the National Assembly Standing Committee’s coordination with relevant agencies in organizing the Conference to implement these laws and resolutions is to continue the spirit of being proactive, “early”, “remote” - originating from the beginning of the XV term and being proven effective in practice - in improving the quality and effectiveness of the National Assembly’s legislative, supervisory and decision-making activities on important national issues. As commented by Deputy Secretary General of the Vietnam Chamber of Commerce and Industry (VCCI) Dau Anh Tuan, “The National Assembly has been acting very quickly…”. Along with that, the determination of the Government and Government agencies to complete the guidance documents "on time" shows that the spirit of urgency and proactiveness of the National Assembly has spread strongly in the political system, especially at all levels of implementation, thereby contributing to ensuring the rights and interests of the people, the business community and the socio-economic development of the country, Mr. Dau Anh Tuan stated.

In the article “Proud and confident under the glorious flag of the Party, determined to build an increasingly prosperous, civilized, cultured and heroic Vietnam” on the occasion of the 94th anniversary of the founding of the Communist Party of Vietnam (February 3, 1930 - February 3, 2024), General Secretary Nguyen Phu Trong emphasized the need to perfect the legal system and improve the effectiveness of law enforcement. Accordingly, “it is necessary to focus on prioritizing the synchronous and quality promulgation of the legal system, regulations, statutes, and working procedures for serious and unified implementation throughout the Party and the entire political system”.

Based on the success of the First Conference and this Conference, we need to make greater efforts, be more determined, more responsible, and coordinate more closely and effectively to soon put the National Assembly's policies into practice.

That spirit of urgency and initiative was reflected in the two central reports (of the National Assembly Standing Committee and the Government) presented at the Conference , and received the agreement and high appreciation of the delegates attending. In particular, the report of the National Assembly Standing Committee (implementing new points, key contents, requirements and main tasks to implement the laws and resolutions passed by the 15th National Assembly at the 6th Session and the 5th Extraordinary Session) was elaborately constructed, specifically listing about 400 detailed contents related to each agency, organization, unit and the deadline for completing detailed regulations and implementation instructions of each law and resolution. This report is considered by ministries and branches as a "handbook" for the implementation of laws and resolutions of the National Assembly as well as for strengthening the enforcement of laws. If they do not read it, the advisory agencies of the Ministry may not know how to list all the documents that need to be developed and issued.

Along with the 2 central reports, the Conference listened to 12 reports and presentations from agencies, units and localities, which both " illustrated " the central report and each report and presentation provided very specific and useful recommendations and solutions for the agencies of the National Assembly and the Government to study and absorb in the process of supervision as well as to develop detailed regulations and implementation instructions.

In particular, in the reports, discussions and speeches of agencies, units, organizations and localities at the Conference, the quality of the laws and resolutions issued by the National Assembly was highly appreciated, and it was also stated that these laws and resolutions are initially receiving consensus from voters, the people , our compatriots abroad as well as the business community at home and abroad. "This is a very happy thing".

Happy because, right before passing, many laws and resolutions still had many different opinions, even contradictory, and at times it seemed difficult to pass, such as the Land Law (amended), the Law on Credit Institutions (amended)... But " with all efforts , close and effective coordination , we have passed them !". Emphasizing this, National Assembly Chairman Vuong Dinh Hue stated that the Central and local governments were also " satisfied " and found that "the Law is progressive, easy to apply, feasible, and transparent "; People at home and abroad , the business community " strongly agree " and " expect " the laws and resolutions just passed by the National Assembly, including the Land Law (amended).

The recent period, especially after the success of the first Conference, has shown very positive changes in the implementation of laws and resolutions of the National Assembly. Agencies have shown a high sense of responsibility, proactively and resolutely overcoming all difficulties and challenges, especially pressure on progress, scope and workload, to make efforts to urgently deploy the implementation work , bringing laws and resolutions of the National Assembly into life as soon as they come into effect . Although there is no summary yet, preliminary monitoring shows that the issuance of detailed regulations and guidance on law implementation has been "more timely", the situation of document backlog is also "much less". Notably, the quality of detailed regulations and guidance on implementation has closely followed the reality and the provisions of laws and resolutions of the National Assembly, and has entered life more quickly.

Acknowledging the results of implementing laws and resolutions in recent times, but with a dialectical and practical perspective, National Assembly Chairman Vuong Dinh Hue also frankly pointed out that this is the " first step ", and only in the process of building and promulgating detailed documents and organizing implementation " can we fully assess the quality of the law " .

In fact, the amount of work that needs to be continued to be implemented to be able to put laws and resolutions into practice is very large, especially, many laws passed by the National Assembly at the two most recent sessions have a large number of articles and contents assigned to the Government and agencies for detailed regulation, " both large " ( about 400 contents ), " both difficult " (such as the contents on sandbox - controlled testing mechanism in the Law on Telecommunications, Law on Credit Institutions ... ) , " both demanding high progress " (there are contents of the Land Law that set the time of application from April 1, 2024 ... ) . This requires all detailed regulations to be issued synchronously . Not to mention, the Laws and Resolutions of the National Assembly that have just passed also stipulate many new policies, specific mechanisms as well as new tasks and powers in the direction of promoting decentralization and delegation of power to agencies and establishments.

With such many challenges, National Assembly Chairman Vuong Dinh Hue pointed out that the implementation of laws and resolutions of the National Assembly requires " great concentration, effort, and determination " of agencies in the political system, from the National Assembly agencies in the supervisory role, to the Government, the Prime Minister, ministries, branches, agencies, units, and localities.

During that process, one of the notes of the Head of the legislative body is that the development and promulgation of detailed regulations must comply with the Law on Promulgation of Legal Documents . Urgently develop and promulgate under the authority of 56 detailed regulations (including 29 decrees, 5 decisions, 22 circulars) , ensuring progress and quality to take effect promptly with laws and resolutions . And, " absolutely do not overlap, create obstacles, bottlenecks, processes, procedures, "sub-licenses" contrary to regulations in the implementation organization ". At the same time, pay attention to new policies and regulations that take effect earlier than the general effect of the law; detailed regulations and implementation instructions for transitional contents to create a basis for smooth and unified implementation, avoiding creating legal gaps. Continue to review sub-law documents related to new provisions of laws and resolutions to amend, supplement, replace, abolish or promulgate according to authority, ensuring consistency and synchronization with passed laws and resolutions.

With such a proactive, scientific, urgent and responsible working spirit, the wishes and messages of National Assembly Chairman Vuong Dinh Hue at the Conference will certainly become vivid reality. Accordingly, the issues discussed at this Conference will become valuable lessons and experiences, and the remaining problems in the implementation of laws and resolutions will have appropriate solutions . Thereby, the work of implementing laws will become increasingly professional and methodical, meeting the expectations of voters and people, along with the work of building and perfecting the legal system to contribute to building a strong Socialist Republic of Vietnam.

In particular, the specific results of the Second National Conference on implementing laws and resolutions of the National Assembly, together with the success of the Fifth Extraordinary Session at the beginning of this year, show that the National Assembly has, is and will certainly continue to promote the effective spirit of "proactive legislation, effective supervision, timely decisions, and breakthrough development" , accompanying the Government and agencies in the political system to successfully carry out the socio-economic development tasks of 2024 and other important tasks in the entire period of 2021-2025.
