Continuing the 10th Session, on the morning of November 11, Government Inspector General Doan Hong Phong presented the draft Law amending and supplementing a number of articles of the Law on Citizen Reception , the Law on Complaints, and the Law on Denunciation.

Regarding the Law on Citizen Reception, the draft adds provisions on the form of online citizen reception. Accordingly, citizens can choose to receive citizens in person or online.

The draft law assigns the Government to guide and specify other cases in which citizens can be refused access.

To conform to the two-level local government organization model, the draft law adds a number of tasks of the Chairman of the People's Committee at the commune level: deciding on the arrangement of places to receive citizens outside the headquarters of the People's Committee at the commune level; promulgating regulations on receiving citizens; assigning a staff unit to receive citizens.

The draft law supplements the provisions: The Ministry of National Defense, the Ministry of Public Security , and the State Bank of Vietnam assign inspection agencies to arrange civil servants to perform citizen reception work; Ministries without a Ministry Inspectorate assign appropriate units to arrange civil servants to perform citizen reception work; specialized agencies under the provincial People's Committee assign appropriate subordinate units to arrange civil servants to perform citizen reception work.

Regarding the Law on Complaints, in practice, the settlement of complaints may have to be suspended or terminated due to: force majeure events or objective obstacles; need to wait for the settlement results of other competent authorities; the complainant withdraws the complaint, the complainant dies without an heir to the rights and interests, or the complaining agency or organization dissolves or goes bankrupt...

Therefore, the draft law supplements the provisions on cases of temporary suspension and suspension of complaint settlement. Temporary suspension and suspension are carried out by decision of competent authority, stating clearly the reasons and legal basis, sent to the complainant, the complained and related parties.

Supplementing the regulation that the complainant can withdraw part of the complaint content; the complainant can withdraw the complaint by recording the complainant's opinion of withdrawing the complaint when working with the complaint handler or the person verifying the complaint content.

Regarding the settlement of second-level complaints, the draft law supplements the right of the second-level complaint handler to consult with a specialized agency when deemed necessary in addition to consulting with the Advisory Council to ensure accuracy in the settlement of complaints.

To be consistent with the arrangement of the inspection agency system, the draft law supplements the responsibility of the Head of the unit assigned to advise on complaint settlement at state management agencies that do not have an inspection agency.

In practice, there are cases where the complainant does not participate in the dialogue when invited. This makes it difficult to resolve the complaint and there is no legal basis to continue or suspend the resolution.

Therefore, the draft law supplements the provision that in case the complainant is invited but does not participate in the dialogue, the person handling the complaint will continue to handle the complaint.

Regarding the Law on Denunciation, the draft law supplements regulations on the principles of determining the authority to resolve denunciations in a number of cases that the Law on Denunciation has not yet regulated.

Accordingly, the minister, head of a ministerial-level agency, and chairman of a provincial People's Committee shall determine the authority to resolve denunciations against agencies, organizations, cadres, civil servants, and public employees at the time of the violation under their management authority that do not fall under the cases specified in Clauses 3, 4, 5, and 6, Article 12 (Clause 7, Article 12).
