Tien Phuoc Company built against planning, Senturia Vuon Lai residents 'taste bitter fruit'

On October 17, VTC News received an urgent request for help from nearly 100 households in Senturia Vuon Lai Residential Area (An Phu Dong Ward, District 12, Ho Chi Minh City). In the request, the residents stated that their rights and security were being violated and threatened.

At the time of starting the project, the investor Tien Phuoc widely advertised the project on websites, distributed leaflets in many locations and invited visitors to visit the site. At this time, along with the construction of houses and internal roads, the investor also started to build a community house and swimming pool.

On the sales website, the investor describes many of the project’s amenities. Among them, the community house and swimming pool are strong points to attract customers. In the sales contract, the swimming pool and other amenities are also clearly stated with the usage rules that residents must follow.

Realizing the diverse amenities, hundreds of customers have agreed to spend large sums of money to own houses in the project.

At the end of 2017, the project began to be handed over to the first residents. At the time of handing over the houses, the community house and swimming pool were used by the investor Tien Phuoc to organize events. This utility area was later also used by the investor to organize many other events for residents such as: 2017 Year-end Party, house handover ceremony for residents (April 2018)...

After the investor Tien Phuoc handed over the houses, the community house and swimming pool have been operating and used stably by residents until now.

However, at the end of 2022, there was a complaint sent to the authorities about Tien Phuoc Company building a community house and swimming pool that was not in accordance with the approved planning of the project.

Upon receiving the above feedback, the authorities intervened and requested Tien Phuoc Company to return the current status to the approved planning.

Specifically, on May 15, 2023, the People's Committee of District 12 sent an official dispatch to Tien Phuoc Company with the content: "The swimming pool and clubhouse project in the green park area are not invested in accordance with the approved planning and do not have a construction permit. Tien Phuoc Company is requested to promptly remedy and dismantle the projects that are not in accordance with the approved planning...".

Following the dispatch of the People's Committee of District 12, the investor Tien Phuoc sent notices to residents in turn stating that the swimming pool and community house would be dismantled. At this time, the residents just learned about the investor's violations.

Upon receiving notice from the investor Tien Phuoc, the group of residents held the first extraordinary meeting with the investor. At the meeting, residents requested that the investor not be allowed to dismantle the facilities that they had paid to own. Tien Phuoc Company recorded the residents' opinions.

However, after that on August 16, August 28, September 10... investor Tien Phuoc continued to work with residents, announcing the mandatory demolition of the swimming pool and community house.

Most recently, on October 12, Tien Phuoc Company sent a notice to residents about the time to dismantle the construction that did not comply with the planning. The notice stated: "October 24, 2023 - use debris to fill the swimming pool; October 27 - dismantle the community house...".

Realizing that their rights were being violated, nearly 100 households in Senturia Vuon Lai Residential Area sent a petition to the Department of Construction and relevant authorities.

Ms. Vu Thi Phuong, a resident of the project, was upset: "The community house is where we residents live and meet, and is also where the local government often organizes propaganda activities. A part of the community house is currently used to install residential management systems such as: security camera monitoring system, fire prevention and fighting equipment gathering...

As for the swimming pool, it is where hundreds of children have learned to swim and know how to swim, and many residents have been able to exercise. The swimming pool is a regulating lake for the entire residential area, the lake holds a large amount of water so it can provide water for fire prevention and fighting if a fire or explosion occurs. Most importantly, we have paid the investor to use these two facilities. Now the investor is removing it, which is no different from defrauding customers."

According to Ms. Phuong, the swimming pool and community house were among the important reasons why her family decided to choose the project as a place to settle down, even though at the time of purchase, the project price was much higher than other projects in the same area.

"In 2017, the project won the award for best housing project at the "Vietnam Property Award 2017", partly thanks to the community house and swimming pool. And thanks to these two amenities, Tien Phuoc sold the project's houses very quickly. But with the current situation, it is clear that the investor is deceiving us and violating the construction law", said Mr. Nguyen The Hai, a resident of the area.

Responding to VTC News about residents' complaints, a representative of Tien Phuoc Company said that the business is currently in a "dilemma".

"In the approved project planning, the water surface and landscape lake items are clearly shown. Currently, there is a bit of confusion between the two concepts of landscape lake and swimming pool. For the company, the company also really wants to keep the swimming pool and community house facilities," said a representative of Tien Phuoc Company.

According to this person, the investor is continuing to work with authorities and residents in the hope of finding the best solution.

Lawyer Le Van Huyen, Ho Chi Minh City Bar Association, said that after reviewing the case file, Tien Phuoc Company did not provide complete information, records, and planning documents related to the project to customers.

This has made customers believe that the project has swimming pool and community house facilities approved by competent authorities, so customers trust and sign to buy a house.

"With the current reality, Tien Phuoc Company is determined to have violated the approved planning, and must correct the violation by demolishing the facilities. This has clearly caused damage to residents, seriously affecting the rights of residents," said lawyer Huyen.
