National Assembly delegates point out shortcomings in converting land use purpose to residential land

Delegate Nguyen Van Loi - Head of the National Assembly Delegation of Ho Chi Minh City - pointed out the shortcomings in the policy of collecting land use fees from people when converting the purpose to residential land (currently collecting 100% of the land price list multiplied by the area, regardless of whether it is within or outside the limit).

On November 19, discussing in groups about the draft Resolution stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, delegate Nguyen Van Loi analyzed: "It is said that the state manages the land, but in fact, the land is left by the family and clan. People say that paying money like now is like buying their own land."

The delegate suggested: "If this resolution is built to create favorable conditions for the people, especially those who have residential land according to state regulations, I even suggest exempting this land tax. Only when this land is put on the market for sale, will we collect tax."

Delegate Hoang Van Cuong ( Hanoi delegation) said that for a long time, land compensation and resettlement support prices have been determined based on specific land prices, but according to the draft resolution, the land price table will be multiplied by the adjustment coefficient.

"This will be safe for the manager, without fear of loss. But the price list is usually very low, even if multiplied by the adjustment coefficient, the price is still low, affecting people whose land is recovered," said Mr. Hoan Van Cuong.

The delegates said that it is necessary to create favorable conditions for managers but also ensure the benefits for those whose land is recovered. Specifically, the adjustment coefficient to calculate land compensation must be determined for each land location.

"For example, the road surface position of Ba Trieu Street, the adjustment coefficient must be multiplied by 1.5 times. But Hang Ngang Street must be multiplied by 5 times. That means the adjustment coefficient must be determined for each land position, not determined in general," said Mr. Cuong.

At the group discussion session, many delegates were interested in discussing the regulation that the State considers and approves the revocation of projects through agreements to receive land use rights that have expired and must complete the agreement, or that have expired and must complete the agreement, but have agreed on over 75% of the land area and over 75% of the number of land users for the investor.

Agreeing with the State Minister to consider revoking the project that has agreed on over 75% of the land area and over 75% of the number of land users for the investor, delegate Nguyen Thi Yen (HCMC delegation) wondered what mechanism would ensure the rights of the people. Delegate Nguyen Thi Yen said that it is necessary to consider the two numbers 75% in the draft, because they "cannot go together".

Ms. Nguyen Thi Yen analyzed that in many cases, 75% of the people agreed to the agreement but this group did not hold more than 75% of the land area; conversely, there were cases where the group agreed to hold more than 75% of the land area but did not have 75% of the total number of people.

So only one of the two criteria should be chosen, either over 75% of the land area or over 75% of the number of land users. If both are chosen, it will be very difficult to implement.

Another issue the female delegate noted was the compensation and resettlement in case of repossession of the remaining 25%. According to her, because the 25% group did not agree with the price offered by the investor, the State would take over the repossession and compensate.

The problem is how the compensation price for the 25% group will be implemented, it must be equal to or higher than the price that the business agreed with the 75% group.

If it is higher, it will be difficult for the State, but if it is lower, it is not allowed either, it must be at least equal for the people to agree. Ms. Yen suggested clearly regulating this content to protect the rights of the people.

In addition, the female delegate assumed that 75% of the agreement was not necessarily within the project’s construction area, while the remaining 25% was right in the center of the project. How to resolve this situation also needs to be studied and regulated in detail.

Delegates are concerned that "if investing in land is successful, no one will do business or production anymore."

Delegate Pham Duc An, Chairman of the People's Committee of Da Nang City , acknowledged that the revised resolution is the National Assembly's way of making timely adjustments to resolve current difficulties, even though the 2024 Land Law has just been issued.

Agreeing with the draft resolution, Mr. Pham Duc An expressed concern that the land price list could not completely resolve the issue related to compensation for site clearance.

"The price is set according to the price list, but later the market pushes the price up. Uncontrolled land prices lead to huge consequences for the economy ," said Mr. Pham Duc An, who is concerned that the long-term competitiveness of the economy will be affected if land prices are not controlled.

The Chairman of the People's Committee of Da Nang City is concerned that if there is no synchronous solution to control real estate prices at a certain level of increase, then... "people will not need to do business or production anymore, but investing in land will be the most profitable."

According to the delegate, this is a long-term consequence for the economy. Therefore, according to him, in addition to the amendments in this draft, there needs to be a policy related to the tax mechanism, the land control mechanism so as not to focus on the issue of real estate holding. Only then can the issues related to land recovery and site clearance be resolved quickly.
