Clarifying regulations when moving 5.5 million cubic meters of soil

Recently, Mr. Mai Xuan Liem, Vice Chairman of Thanh Hoa Provincial People's Committee signed a document requesting a review of the overall adjustment project of the detailed planning at a scale of 1/500 for the project of the Automobile and Construction Machinery Manufacturing and Assembly Factory of Toan Cau Audiovisual Entertainment Joint Stock Company in Dai Loc and Trieu Loc communes, Hau Loc district, Thanh Hoa.

Accordingly, Thanh Hoa province agreed to adjust and remove the content of "progress" stipulated in Point b, Section 10, Article 1 of Decision No. 1713/QD-UBND dated May 22, 2023 of the Provincial People's Committee on approving the project to adjust the overall detailed planning at a scale of 1/500 of the project of the Automobile and Construction Machinery Manufacturing and Assembly Factory in Dai Loc and Trieu Loc communes, Hau Loc district, Thanh Hoa province.

Next, the leaders of Thanh Hoa Provincial People's Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with the Department of Planning & Investment and relevant units to report and clarify the progress of the project of the Automobile and Construction Machinery Manufacturing and Assembly Factory in Dai Loc and Trieu Loc communes, Hau Loc district according to the provisions of the law on land and investment, and report to the Chairman of the Provincial People's Committee before June 10, 2024.

The document also clearly states that, based on the project implementation time, Global Audiovisual Entertainment Joint Stock Company reviews and evaluates the feasibility of the project, clearly states the time and progress of implementation, ensures investment objectives and environmental protection requirements when implementing the project, and reports to the People's Committee of Hau Loc district.

Notably, regarding the "huge" amount of excess land estimated to be more than 5.5 million cubic meters that the investor is requesting to transport from the project and collect, the above document clearly states that the People's Committee of Hau Loc district (the project appraisal agency) is assigned to study and clarify the requirements according to regulations for moving large amounts of land in the project implementation area to the outside, ensuring the feasibility of the project. This was done after receiving a report from Global Audiovisual Entertainment Joint Stock Company.

Surplus of 5.5 million cubic meters of land at the trillion-dollar auto project

Previously, according to the report dated January 25 of the Department of Natural Resources and Environment of Thanh Hoa, Toan Cau Audiovisual Entertainment Joint Stock Company was leased land by the Provincial People's Committee to continue using it for the purpose of implementing the project of Cluster of factories manufacturing and assembling automobiles and construction machinery (Toan Cau automobile project) in Dai Loc commune and Trieu Loc commune, Hau Loc district in Decision No. 2194/QD-UBND dated June 24, 2021, with an area of ​​456,334m2.

According to the 1/500 scale detailed master plan adjustment project, in the leveling category, the volume of excavated soil (excess soil) that needs to be transported out of the project is about 5,557,000m3. The dumping location is not determined, causing businesses a "headache" in handling this huge volume of waste soil.

Regarding the project's ground leveling work, according to the Department of Construction, "The ground leveling elevation of the project area is controlled from +10.8m to +17.2m; the ground leveling in the planned land plot creates a slope of i = 0.04% - 1.0%, sloping towards the Southwest. Leveling the hill area in the middle to create a flat surface". In which, the ground leveling elevation of the land plots is from +11m to +14.6m; the highest slope elevation in the Northeast is +17.2m".

Global Audiovisual Group Corporation spent about 28 billion VND to buy back the auctioned assets of the old Vinaxuki project and become the "new owner" of the project.

Meanwhile, according to Document No. 3516/UBND-KTHT dated December 14, 2023 of Hau Loc District People's Committee, the lowest controlled ground leveling elevation is +11.00m in the Northwest land area and the highest is +14.60m in the Southeast of the project construction land area, consistent with the data in drawing QH-06: Map of planning ground leveling elevation orientation (drawing attached to the Decision) approved by Thanh Hoa Provincial People's Committee in May 2023.

At the same time, Hau Loc district also said that during the leveling process, the amount of soil that needs to be transported to create a construction site for the factory during the construction process will generate an excess amount of soil and rock that needs to be moved of about 5.5 million m3 (calculated data provided by the Investor and design consultant).

Regarding the handling of excess soil, according to the document, the People's Committee of Hau Loc district stated the opinion that if the excess soil volume is transported and dumped, it will cause waste of mineral resources and will not solve the difficulty in supplying earth filling materials for current projects in Hau Loc district and neighboring localities. On the other hand, according to the planning of Hau Loc district area approved by the Provincial People's Committee, in Hau Loc district there is no planning for a centralized dumping site for waste soil and rock.

Struggling with a plan to "handle" 5.5 million cubic meters of excess soil

To resolve the excess land when leveling the ground to implement the project, Global Audiovisual Entertainment Joint Stock Company signed Contract No. 12/HDNT/2023 dated October 12, 2023 with Manh Nguyen Tien Company Limited to execute the leveling and site preparation package for the project of the Cluster of factories for manufacturing and assembling automobiles and construction machinery in Dai Loc and Trieu Loc communes, Hau Loc district.

Therefore, on October 13, 2023, Manh Nguyen Tien Company Limited submitted an application (with documents submitted through the Public Administration Service Center) requesting to exploit and transport out about 5,556,672m3 of fill soil, with an exploitation capacity of more than 2.77 million cubic meters per year, with an exploitation period of 2 years from the date of license issuance.

However, with the large amount of excess land of up to 5.5 million m3 and the exploitation of minerals in the area of ​​a project, Thanh Hoa authorities were "confused", having to ask for instructions from superior agencies, specifically asking for instructions from the Ministry of Natural Resources and Environment .

Accordingly, based on the inspection results and opinions of relevant sectors and units, on November 10, 2023, the Department of Natural Resources and Environment of Thanh Hoa issued Official Dispatch No. 10512/STNMT-TNKS requesting the Ministry of Natural Resources and Environment to guide the procedures and components of the dossier for granting a license to exploit minerals for common construction materials in construction investment projects approved by the Provincial People's Committee.

It is expected that there will be more than 5.5 million cubic meters of surplus land when implementing the project.

At the same time, a few days later, the Department issued Document No. 10670/STNMT-TNKS dated November 15, 2023, returning the application for a License to exploit minerals in the Global Project area at the request of Manh Nguyen Tien Company Limited, for the reason of waiting for instructions from the Ministry of Natural Resources and Environment.

By November 27, 2023, the Vietnam Department of Mineral Resources had issued a written response with instructions on the procedures and components of the dossier for granting a license to exploit minerals for common construction materials in construction investment projects approved in principle by the Provincial People's Committee.

After receiving instructions from the Vietnam Minerals Administration, on November 29, 2023, Manh Nguyen Tien Company Limited issued Document No. 11/CV-NT to continue requesting a license to exploit landfill land in the above area.

However, according to the Department of Natural Resources and Environment of Thanh Hoa, due to the large volume of land requested for licensing, about more than 5.5 million cubic meters, and the implementation in a short time, along with inconsistent data on the leveling elevation in the 1/500 detailed planning and the construction drawing design documents, on December 11, 2023, the Department of Natural Resources and Environment issued Document No. 11511/STNMT-TNKS requesting the Department of Construction and the People's Committee of Hau Loc district to review and clarify the content related to the leveling elevation and the amount of excess land that needs to be transported at the above project.

One month later, on December 27, 2023, Manh Nguyen Tien Company Limited continued to have Document No. 2711/CV-NT reporting and requesting to exploit the land for leveling within an area of ​​12.88 hectares (this is the planned area for the construction of the project's operating - service area and production workshop area) for a period of 1 year.

Therefore, based on the opinions of the Vietnam Minerals Department, the Department of Construction, the People's Committee of Hau Loc district, relevant sectors and units and the request of Manh Nguyen Tien Company Limited, on January 6, 2024, the Department of Natural Resources and Environment issued Document No. 152/STNMT-TNKS reporting to the Provincial People's Committee to direct the handling of the above contents.

Regarding the project, on the afternoon of June 7, in a quick exchange with Nguoi Dua Tin , Mr. Nguyen The Hung, Head of the Department of Mineral Resources of the Thanh Hoa Department of Natural Resources and Environment, said that the authorities of Thanh Hoa province are continuing to review and clarify issues related to the licensing of the project. At the same time, he acknowledged that the project may have the risk of causing problems such as environmental pollution, traffic pressure on the route as well as affecting the supply in the area.

The automobile project of Toan Cau Group Corporation was introduced with a total investment capital of up to nearly 7,000 billion VND divided into 2 phases with the goal of assembling and manufacturing automobiles and expected to create about 10,000 jobs.

The location of the Toan Cau automobile and construction machinery manufacturing and assembly project in Dai Loc and Trieu Loc communes is close to the vital National Highway 1A running through Thanh Hoa province. At the same time, it is adjacent to rapidly urbanizing areas with large land-filling needs such as Hoang Hoa, Sam Son, and many vital traffic routes are being invested in and built.

Notably, despite being the investor of an ambitious auto project worth thousands of billions of dong, Global Audiovisual Entertainment JSC previously had very little information about its activities related to the auto industry, and was almost "absent" when conducting basic searches on the internet. Therefore, Global Audiovisual Entertainment JSC can be considered a "mystery" for this ambitious project.
