On the morning of August 27, Prime Minister Pham Minh Chinh chaired a Government meeting on law-making, discussing and giving opinions on three draft laws: Draft Law on Management and Investment of State Capital in Enterprises (amended); Draft Law on Teachers; Draft Law on Digital Technology Industry.

This is the second legal thematic meeting in August 2024 and the eighth legal thematic meeting this year of the Government. Attending the meeting were Deputy Prime Ministers, Ministers, Heads of ministerial-level agencies, and Government agencies.

At the meeting, the Government listened to the presentation of the Summary Report and the report on receiving appraisal opinions; and discussed the policy contents of the draft laws.

Regarding the Draft Law on Management and Investment of State Capital in Enterprises (under the Ministry of Finance's leadership), Government members discussed the scope of regulation, subjects of application, regulations related to the transfer of the Development Investment Fund, inspection, supervision, state management functions and the function of representing state capital owners.

Regarding the draft Law on Teachers (under the Ministry of Education and Training), the Government agreed that it is necessary to continue perfecting relevant regulations on teachers; inheriting regulations that have been proven in practice and applied effectively; and supplementing regulations to handle shortcomings and problems arising in practice.

Regarding the draft Law on Digital Technology Industry (under the Ministry of Information and Communications), delegates focused on giving opinions on a number of contents such as the mechanism for large-scale special projects, the authority to approve the controlled testing mechanism, the relationship of the draft law with related laws, artificial intelligence management, etc.

Directly giving specific opinions on each discussion content, Prime Minister Pham Minh Chinh analyzed and emphasized some additional viewpoints on the construction of draft laws.

Regarding the general viewpoint, the Prime Minister requested to closely follow and fully institutionalize the Party and State's guidelines and policies on related issues; closely follow and clearly demonstrate the policies approved by the Government in the proposal to build laws.

Along with that, continue to innovate the thinking of law-making in the direction of: Closely following reality, respecting objective reality; legalizing issues that are ripe, clear, proven correct by practice, agreed by the majority, and effectively implemented; piloting issues that are not ripe or clear, learning from experience while doing, and gradually expanding; not being perfectionist, not being hasty; removing difficulties, obstacles, and inadequacies in practice.

Promote decentralization and delegation of authority thoroughly, while allocating resources, improving implementation capacity, designing tools to strengthen supervision, inspection, and control of power; promote post-inspection; clearly assign people, tasks, responsibilities, and products; cut down and simplify administrative procedures, eliminate the request-grant mechanism, and reduce intermediary steps.

State agencies focus on performing state management tasks, including developing strategies, plans, schemes, institutions, policy mechanisms, legal corridors, standards, criteria, tools for monitoring and inspection, conducting interim and final reviews, rewards, and disciplines, etc.

Strengthen close and effective coordination between ministries, branches and agencies. Have incentive mechanisms suitable for the fields that need encouragement, refer to international experiences suitable to Vietnam's conditions and circumstances, and the economy's ability to pay.

"The policy mechanism must be open, feasible but controllable; including appropriate and effective policies to train and foster high-quality human resources related to the three fields regulated by the three draft laws; mobilizing all legal resources for national development" - the Prime Minister said.

Regarding the Draft Law on State Capital Management and Investment in Enterprises, the Prime Minister requested that it is necessary to closely follow and institutionalize the contents of Resolution No. 12-NQ/TW of the 12th Central Committee on continuing to restructure, innovate and improve the efficiency of state-owned enterprises; putting the common interests, national and ethnic interests above all and first.

It is necessary to review and remove shortcomings and problems arising in practice, inherit regulations that have been proven in practice, effectively apply current laws, ensure consistency and unity with relevant legal regulations such as the Investment Law, Public Investment Law, Enterprise Law, Construction Law, etc.

The Prime Minister also said that it is necessary to focus on management by objectives; decentralize and delegate more power, give more autonomy to enterprises along with appropriate resource allocation, improve implementation capacity and design inspection and supervision tools; reduce administrative procedures for enterprises, reduce requests, promote the spirit of dynamism, creativity, dare to think, dare to do for the common good, pay attention to ensuring the legitimate and legal rights of workers.

From there, improve investment efficiency, maximize the efficiency of huge resources in enterprises; promote the pioneering role of state-owned enterprises in a number of fields, as well as the general important role of state-owned enterprises in the economy, promote the leading role of the state economy.

Regarding the draft Law on Digital Technology Industry, the Prime Minister noted that it is necessary to continue to closely follow, thoroughly grasp and institutionalize the Party's policies in Resolution No. 19-NQ/TW of the 13th Central Committee and Plan 13-KH/TW of the Politburo on continuing to promote industrialization and modernization until 2030, with a vision to 2045; Resolution No. 52-NQ/TW dated September 27, 2019 of the Politburo on a number of policies and strategies to proactively participate in the Fourth Industrial Revolution; Resolution No. 23-NQ/TW dated March 22, 2018 of the Politburo on orientations for building national industrial development policies until 2030, with a vision to 2045, etc.

Regarding the draft Law on Teachers, the Prime Minister emphasized the need to improve the quality of teachers, meeting the requirements, tasks and missions of educating people of teachers in new conditions, with the viewpoint that "teachers are the driving force and inspiration for students."

Concluding the meeting, Prime Minister Pham Minh Chinh highly appreciated the efforts and active preparation and submission of contents by the Ministries of Finance, Education and Training, and Information and Communications; seriously receiving and explaining opinions of the Government Standing Committee and Government members to revise and perfect the draft laws; and the dedicated, responsible, practical and quality opinions of the Government members and delegates attending the meeting.

The Prime Minister requested the Ministers to direct the serious and complete acceptance of valid opinions, complete the draft laws in accordance with the provisions of the Law on Promulgation of Legal Documents and related documents to submit to the National Assembly at the 8th Session, October 2024.

These are laws with many new and difficult contents. The Prime Minister requested the Ministers to establish working groups with the participation of experts and human resources from other ministries, branches and agencies; continue to listen to experts, scientists and affected subjects; closely coordinate with the agencies of the National Assembly; do a good job of communication; assign Deputy Prime Ministers assigned according to the responsible fields to pay attention to and directly direct the completion of the draft laws, ensuring progress and improving quality.
