The National Assembly Standing Committee has just commented on the draft Law on Citizen Identification (amended) for explanation, acceptance and revision at the 25th session.
Notably, Article 23 regulates the integration of information into the identity card. Accordingly, integrating information into the identity card means adding information in addition to the identity information.
Information integrated into the ID card includes: Health insurance card, social insurance book, driver's license, birth certificate, marriage certificate or other documents decided by the Prime Minister, except for information on documents issued by the Ministry of National Defense .
Information integrated into the ID card must be authenticated through the national database and specialized database to be integrated into the ID card at the request of the people or state management agencies.
The use of integrated information from the identity card has the same value as providing information or using documents containing that information in performing administrative procedures, public administrative services and other civil, economic and commercial transactions.
In case the information printed and stored in the encrypted storage part of the ID card is different from the information integrated in the electronic ID card due to changes, fluctuations, or adjustments to the information in the National Population Database or the ID Database, the agency, organization, or individual shall use the information in the electronic ID card.
People carry out procedures to integrate information into their ID cards through issuing, exchanging, reissuing ID cards or using the VNeID application when they already have an electronic ID card.
In addition, Article 17 of the draft law stipulates the collection, updating, connection, sharing, exploitation and use of information in the Identity Database.
Accordingly, information in the Identity Database is collected and updated from connecting and sharing information with the National Population Database; national databases, other specialized databases; from the identity archive; issuing and managing identity cards; issuing and managing identity certificates.
In case the information collected from the above-mentioned sources is not available or is incomplete, it will be collected and updated from individuals, except for the case specified in the point below.
Biometric information on DNA and voice is collected when people voluntarily provide it or during the process of resolving a case according to assigned functions and tasks. If the prosecution agency or the agency managing the person subject to administrative handling measures requests an appraisal or collects biometric information on DNA and voice of an individual who is a Vietnamese citizen or a person of Vietnamese origin, that information and data will be shared with the identity management agency to update the Identity Database.
The draft law also stipulates that identification characteristics and biometric information will not be collected for people under 6 years old.
According to the draft law, the identity card has the value of proving identity and other information that has been integrated into the identity card of the cardholder to conduct transactions within the territory of Vietnam.
Identity cards are used instead of immigration documents in cases where Vietnam and a foreign country sign international treaties or agreements allowing citizens of the signatory countries to use identity cards instead of immigration documents in each other's territories.
Agencies, organizations and individuals use personal identification numbers or identity cards to check information of cardholders in the National Population Database and specialized databases according to the provisions of law.
In cases where citizens must present their identity cards at the request of competent agencies, organizations or individuals, such competent agencies, organizations or individuals shall not request citizens to present documents or provide information that has been printed or integrated into the identity card.
In which, except in cases where people's information has been changed, corrected and the information in the ID card is inconsistent with the information in the National Population Database.
