Draft Circular amending and supplementing Article 4 of the List of types and quality standards of exported minerals. Accordingly, exported minerals are minerals of legal origin, processed, listed in the List of types and meeting the following quality standards:

a) For exported minerals of domestic origin: List of types and corresponding quality standards in Appendix 1 of this Circular.

b) For exported minerals of imported origin:

- Minerals processed for foreign traders: List of types and quality standards after processing are implemented according to the contract signed with the foreign trader, and at the same time meet the requirements specified in Article 39 of Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government detailing a number of Articles of the Law on Foreign Trade Management.

- Processed minerals of other imported origin: List of types and corresponding mineral quality standards in Appendix 2 of this Circular.

Mineral exporters are selected to organize conformity assessment according to the provisions of Decree 107/2016/ND-CP dated July 1, 2016 of the Government stipulating the conditions for business of conformity assessment services and Decree 154/2018/ND-CP dated November 9, 2018 of the Government on amending, supplementing and abolishing a number of regulations on investment and business conditions in the field of State management of the Ministry of Science and Technology and a number of regulations on specialized inspection to assess the types and quality of exported minerals.

Management responsibility

In addition, the draft Circular amends and supplements Article 6 on management responsibilities. Provincial People's Committees organize supervision, inspection and examination of mineral export activities in the area, and coordinate with the Ministry of Industry and Trade in the management of mineral import and export.

For the export of minerals of imported origin:

a- The General Department of Customs shall coordinate with the Ministry of Industry and Trade (Department of Industry) and People's Committees of relevant provinces to provide information and control the activities of receiving, processing and exporting minerals of imported origin according to the provisions of this Circular and the law on foreign trade.

b- The Department of Industry and Trade where the trader has a processing facility located in the province shall preside over and coordinate with relevant agencies to supervise and inspect the processing and export activities of imported minerals, ensuring that the processed and exported minerals have legal origins, are consistent with the type, quality and recovery rate of processed mineral products; the suitability of the processing facility/or the facility hiring the processing facility as prescribed in Clause 2, Article 38 of Decree No. 69/2018/ND-CP of the Government. Report to the Ministry of Industry and Trade and the Provincial People's Committee for handling according to their authority cases of violations or failure to comply with regulations on mineral processing.

c- Provincial People's Committees shall organize the supervision of the import, processing and export of minerals by traders to ensure that the import, processing and export comply with the provisions of the law on foreign trade management and this Circular. Inspect, examine and strictly handle violations according to their authority.

The Department of Industry (Ministry of Industry and Trade) is responsible for presiding over and coordinating with relevant ministries, branches and localities to periodically organize inspections of compliance with regulations on mineral export according to this Circular and relevant legal provisions; and handling difficulties in the process of mineral export.

Based on the actual situation of domestic mineral exploitation, processing, consumption, export and the Party and Government's policies and orientations for mineral export in each period, the Department of Industry is responsible for reporting to the Minister of Industry and Trade for consideration, adjustment and supplementation of this Circular when necessary.
