On the morning of May 27, at the 5th Session, the National Assembly worked in the Hall to listen to the Government's Report on the draft Law amending and supplementing a number of articles of the Law on People's Public Security.
Add specific regulations on 6 positions with the highest rank being General
Authorized by the Prime Minister, presenting the Report on the draft Law amending and supplementing a number of articles of the Law on the People's Public Security, Minister of Public Security To Lam said: The construction of the draft law is based on the viewpoint of ensuring that the People's Public Security force is under the direct and comprehensive leadership of the Party in all aspects, the command of the President, the management of the Government, the direct command and management of the Minister of Public Security, relying on the people and being supervised by the people. At the same time, it inherits the relevant regulations, overcomes difficulties and obstacles to meet the requirements of protecting national security, ensuring social order and safety, and fighting against crimes and law violations in the current period and the following years.
According to Minister To Lam , the draft Law consists of 2 articles: Article 1: Amending and supplementing a number of articles of the Law on Public Security and Article 2: Effective date.
In particular, the amendment and supplement stipulate that police officers who are considered for promotion from Colonel to Major General must have at least 3 years of service remaining. In case of less than 3 years of service, the President will decide. The Government will specify the criteria and standards for promotion to the rank of General ahead of schedule for police officers with outstanding achievements in combat and work. The addition of this content is to specifically determine the criteria and standards for outstanding achievements in combat and work as a basis for proposing the President to consider and decide on promotion to the rank of General ahead of schedule.
Regarding the regulations on the highest rank for positions and titles of People's Public Security officers, the current Law only specifically stipulates 199 positions with the highest rank being General (including 1 General, 6 Senior Lieutenant Generals, 35 Lieutenant Generals, 157 Major Generals).
The draft Law amending and supplementing a number of articles of the Law on the People's Public Security adds specific regulations on 6 positions with the highest rank of General in the People's Public Security, including: 1 position with the highest rank of Senior Lieutenant General and 5 positions with the highest rank of Major General; stipulates that the Chief of the City Police under a centrally-run city and the Commander of a Regiment have the highest rank of Colonel. Adds regulations that the Standing Committee of the National Assembly stipulates the rank of General for newly established units; the Chief of the Regiment and the Chief of the City Police under a centrally-run city have the highest rank of Colonel.
In addition, the draft Law supplements regulations and increases the maximum service age of police officers (men increase by 2 years, women increase by 5 years); increases the age of officers and non-commissioned officers by 2 years; female officers with the rank of Colonel increase by 5 years, female officers with the rank of Lieutenant Colonel increase by 3 years; female officers with the rank of General remain at 60 years old as current; supplements regulations to extend the maximum service age for police officers in special cases. The age increase time is according to the roadmap: Each year increases by 3 months for men and 4 months for women. For officers and non-commissioned officers with the maximum service age under 60 years old for men, under 55 years old for women, the age increase is immediately 2 years, not following the above roadmap.
Comprehensive assessment is needed to ensure correlation between highest rank and command hierarchy.
Reporting on the review of the draft Law amending and supplementing a number of articles of the Law on People's Public Security, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the Committee on National Defense and Security agreed with the necessity of promulgating the Law amending and supplementing a number of articles of the Law on People's Public Security for the reasons stated in the Government's Submissions.
Regarding some specific contents, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi stated that the Committee on National Defense and Security agreed with the provisions on the time limit for considering promotion from Colonel to Major General in the draft Law, because this content is basically inherited from current regulations, ensuring consistency in regulations on the highest age limit for service, contributing to taking advantage of the intelligence and experience of officers promoted to the rank, ensuring the next leadership and command time of the promoted rank.
Regarding the regulations on criteria and standards for outstanding achievements to be considered for promotion to the rank of general ahead of schedule, the National Defense and Security Committee agreed to supplement the regulations in Clause 2, Article 1 of the draft Law to ensure feasibility, create transparency and strictness in the implementation process. At the same time, it is recommended to review, research and supplement regulations of a principle nature on criteria and conditions...
Regarding the addition of regulations on the highest rank for a number of positions and titles of Public Security officers, the National Defense and Security Committee basically agrees with the provisions of the draft Law, because it believes that it does not exceed the number of general positions in the Public Security as prescribed by the Politburo; consistent with the practical needs of the work and the new organizational structure of the Ministry of Public Security. At the same time, it agrees with the regulation that the Public Security officer seconded to the position of Chairman of the National Defense and Security Committee of the National Assembly has the highest rank of Senior Lieutenant General, which is consistent with the spirit of Conclusion No. 35-KL/TW, dated May 5, 2022 of the Central Executive Committee.
In addition, the National Defense and Security Committee also agreed to supplement the regulation on the highest rank of Major General; Regarding the rank of General for newly established units; Regarding the highest rank of Colonel for the Chief of City Police under centrally-run cities, Regiment Commander. However, it is recommended that a full and comprehensive assessment is needed to ensure the correlation of the highest rank and the hierarchy of command in the People's Public Security.
Regarding the maximum service age of police officers, non-commissioned officers, and workers, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the Committee on National Defense and Security agreed with the Government's proposal to increase the maximum service age of police officers, non-commissioned officers, and workers. However, there are opinions that raising the maximum service age for female Lieutenant Colonels to 3 years and female Colonels to 5 years is a significant increase, while most other ranks are increased by 2 years to suit the special working environment of the People's Public Security Forces.../.
