Minister of Natural Resources and Environment Do Duc Duy has just signed Decision No. 78/QD-BTNMT transferring functions and tasks of management and implementation of legal provisions on responsibility for recycling products, packaging and responsibility for collecting and treating waste of organizations and individuals producing and importing (EPR).
Accordingly, all functions and tasks of management and implementation of legal provisions on responsibility for recycling products, packaging and responsibility for collecting and treating waste of manufacturing and importing organizations and individuals in Decision No. 788/2023/QD-BTNMT will be transferred from the Legal Department to the Department of Environmental Pollution Control.
The Director of the Legal Department will hand over records, documents, ongoing tasks; finances, assets (if any) related to EPR to the Department of Environmental Pollution Control according to regulations, to be completed before January 15, 2025.
The Director of the Department of Environmental Pollution Control is responsible for receiving and handing over tasks, promptly organizing the implementation of tasks as required, ensuring progress and quality.
The National EPR Council and its Secretariat will be established as prescribed.
Previously, EPR regulations were stipulated in the Law on Environmental Protection; Decree No. 08/2022/ND-CP; Decree No. 05/2025/ND-CP amending and supplementing a number of articles of Decree No. 08/2022/ND-CP; Circular No. 02/2022/TT-BTNMT.
According to the above documents, manufacturers and importers of 5 groups of products and packaging, including: Pesticides; Disposable batteries; Diapers, sanitary napkins, disposable wet towels; Chewing gum, cigarettes; some products and goods containing synthetic plastic such as balloons, children's toys, shoes, clothes, disposable plastic products, disposable items, furniture, construction materials, small-sized non-biodegradable plastic bags... are responsible for contributing financially to support waste collection and treatment from January 1, 2022.
Manufacturers and importers of 6 groups of products and goods including: Tires and tubes; Batteries and accumulators; Lubricants; Products with packaging (food, cosmetics, medicine, fertilizer, animal feed, veterinary medicine, cement, detergents and preparations for household, agricultural and medical use); Electricity and electronics; Means of transport must be responsible for recycling products and packaging according to a mandatory recycling rate and mandatory recycling standards. Manufacturers and importers can organize recycling themselves or can contribute financially to the Vietnam Environmental Protection Fund to support recycling activities.
In particular, manufacturers and importers of tires, batteries, lubricants and packaged products shall be responsible for recycling from January 1, 2024; manufacturers and importers of electrical and electronic products shall be responsible for recycling from January 1, 2025; manufacturers and importers of means of transport (cars and motorbikes) shall be responsible for recycling from January 1, 2027.
