Clause 4, Article 18 of the 2008 Road Traffic Law clearly stipulates that vehicle drivers are not allowed to stop or park vehicles in the following locations: On the left side of a one-way street; on curved roads and near the top of a slope where visibility is obstructed; on bridges, under overpasses ; parallel to another vehicle that is stopping or parking; on the roadway for pedestrians to cross the road; at intersections and within 5 meters from the edge of the intersection; at bus stops; in front of and within 5 meters on both sides of the gate of an agency or organization's headquarters; at a roadway with a width only enough for one lane; within the safety zone of a railway; obscuring road signs.
Thus, parking under an overpass is illegal.
Point d, Clause 4 and Point d, Clause 7, Article 5 of Decree No. 100/2019/ND-CP stipulating administrative sanctions for violations in the field of road and railway traffic are amended and supplemented by Point d, Clause 3 and Point b, Point d, Clause 34, Article 2 of Decree No. 123/2021/ND-CP stipulating sanctions for drivers of cars and similar vehicles violating road traffic rules as follows:
4. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed on a driver who commits one of the following violations:
d) Stopping or parking a vehicle at the following locations: On the left side of a one-way road or on the left side (in the direction of traffic) of a two-way road; on a curved road or near the top of a slope where visibility is obstructed; on a bridge, under an overpass , parallel to another vehicle that is stopping or parking, except for the violation specified in Point d, Clause 7 of this Article;
7. A fine of VND 10,000,000 to VND 12,000,000 shall be imposed on a driver who commits one of the following violations:
d) Stopping or parking on the highway in an incorrect place; not signaling to let other drivers know when forced to stop or park on the highway in an incorrect place; making a U-turn on the highway;
Thus, car drivers are not allowed to park under overpasses and if they do, they may be fined from VND 2,000,000 to VND 3,000,000 according to the above regulations.
