We request that employees' records be finalized based on the actual time of their contributions.

Delegations from the National Assembly of Hanoi and Ho Chi Minh City have just forwarded a petition from voters to the Government Office and the National Assembly's Committee on Citizen Petitions and Supervision, reflecting the situation of many businesses owing or evading social insurance contributions.

Specifically, voters in Hanoi have petitioned the Government to direct ministries and agencies to inspect and strictly handle businesses that are still in arrears or evading social insurance contributions for their employees, causing harm to workers and affecting the insurance fund.

Meanwhile, voters in Ho Chi Minh City have reported that some businesses, after dissolving or relocating their production and business locations, have terminated labor contracts but have not fulfilled their social insurance contribution obligations. This prevents employees from finalizing their social insurance records, affecting their retirement benefits and other social insurance schemes.

Therefore, voters in Ho Chi Minh City have requested that the Vietnam Social Security (BHXH) study solutions to resolve this issue, allowing employees to finalize their social insurance records based on the actual time of contribution. At the same time, they request continued collection of outstanding social insurance debts from businesses to ensure the legitimate rights of employees and prevent them from being disadvantaged due to the businesses' unfulfilled responsibilities.

The above recommendations were submitted to the Ministry of Finance . Regarding the difficulties in implementing social insurance policies that affect the legitimate rights of workers, the Ministry of Finance responded that it had coordinated with the Ministry of Interior to submit to the Government Decree 158/2025, which details and guides the implementation of some articles of the Social Insurance Law.

According to regulations, employers are responsible for paying the full amount of mandatory social insurance contributions for eligible employees. In the event of an employee's resignation or termination of their employment contract, the employer must fulfill their social insurance contribution obligations in order to process benefits promptly.

In cases where the employer has not paid the full amount, the employee's benefits will be settled based on the period for which social insurance contributions have been paid. After recovering the outstanding mandatory social insurance contributions, the additional period of social insurance contributions will be confirmed, and the benefit level will be adjusted accordingly.

In cases where businesses are no longer able to pay social insurance contributions for their employees before July 1, 2024, the policy allows for the confirmation of contribution periods to serve as a basis for resolving retirement and death benefit claims for employees.

Thus, the Ministry of Finance affirms that the verification of the social insurance contribution period for employees is fully regulated by law. At the same time, Vietnam Social Insurance continues to coordinate with relevant agencies to find solutions to recover overdue social insurance contributions from businesses in order to adjust benefits in accordance with regulations.

Businesses that intentionally evade social insurance contributions will be subject to prosecution.

Regarding the issue of delayed or evaded social insurance contributions, the Ministry of Finance stated that it has directed Vietnam Social Insurance to implement various solutions to limit violations and ensure the rights of workers. As a result, the rate of delayed social insurance contributions has decreased from 3.05% of the total amount due in 2021 to 2.59% in 2024 and is expected to be 2.55% this year.

To address the issue of businesses delaying or evading social insurance contributions, the National Assembly passed the Social Insurance Law, effective from July 1, 2025; the Government issued Decree 274 detailing regulations on delayed or evaded social insurance contributions, effective from November 30, 2025. This decree clarifies the acts of delayed or evaded social insurance contributions and strengthens penalties for these acts to maximize the protection of workers' rights.

The Ministry of Finance is finalizing a circular guiding the inspection process for social insurance, unemployment insurance, and health insurance, which includes provisions for remote inspection when signs of delayed or evaded social insurance contributions are detected. This solution aims to limit the prolonged problem of delayed or evaded social insurance contributions.

In addition, Vietnam Social Security is strengthening its efforts to urge businesses to pay social insurance contributions for their employees as required. Monthly, the Social Security agency compiles and reviews the data and sends notifications to businesses with overdue payments.

At the same time, Vietnam Social Security coordinates with the Tax Department, the Ministry of Interior, the Police, and People's Committees at all levels to promptly detect and strictly handle businesses that evade or delay social insurance contributions as prescribed.

"For businesses that deliberately evade paying social insurance contributions for their employees, Vietnam Social Insurance will forward the case files and recommend prosecution in accordance with the Penal Code, creating a deterrent for businesses that have not yet shown good compliance with social insurance laws," the Ministry of Finance emphasized.

In addition, the list also includes businesses such as Hoa Binh Construction Group Joint Stock Company, AIS American International Education Joint Stock Company branch, etc.
