At the regular press conference of the Ministry of Home Affairs on April 28, the leader of the Ministry of Home Affairs said that they are studying a support policy for non-professional officials whose activities will end when the two-level local government organization model comes into operation.
According to Decision 759/QD-TTg of the Prime Minister approving the project to rearrange and reorganize administrative units at all levels and build a model of organizing two-level local governments, the use of part-time workers at the commune level will end.
Mr. Phan Trung Tuan, Director of the Department of Local Government (Ministry of Home Affairs) said that currently, Article 33 of Decree 33/2023/ND-CP stipulates that the number of non-professional staff at the commune level is calculated according to the type of commune-level administrative unit, specifically as follows: Type I is 14 people; Type II is 12 people; Type III is 10 people.
Thus, on average, each commune has 12 non-professional cadres. With the current scale of 10,035 commune-level administrative units nationwide, the country has about 120,000 non-professional cadres at the commune level. The Ministry of Home Affairs is reviewing and synthesizing from localities to get the exact number of non-professional commune-level cadres and surplus commune-level cadres.
Currently, the Ministry of Home Affairs is researching support and placement policies for non-professional commune-level officials when their work ends.
According to Mr. Tuan, Decision 759/QD-TTg stated that local authorities can also consider and arrange part-time workers at the commune level who meet the requirements of the task to participate in work in villages and residential groups; implement a leave policy for part-time workers at the commune level without arranging work according to regulations.
Mr. Tuan added that when the two-level local government model comes into operation, non-professional cadres at the commune level will stop working, while those at the village and residential group levels will remain the same. There is no policy to end the work of this group.
“In the long term, it is expected that the Ministry of Home Affairs will advise the Government to issue a decree on organizing activities in villages and residential groups in 2026. In the next 5 years, with the context of streamlining the commune level and abolishing the district level, the new decree will regulate the streamlining and standards and titles of commune, village and residential group officials,” said Mr. Tuan.
Previously, the Ministry of Home Affairs sent an official dispatch to the People's Committees of provinces and centrally-run cities on policies for part-time workers at the commune, village, and residential group levels.
According to the Ministry of Home Affairs, implementing the policy of "ending the use of non-professional workers at the commune level" in Conclusion 137-KL/TW of the Politburo and the Secretariat, non-professional workers at the commune level, in villages and residential groups who are redundant due to the rearrangement of administrative units at the commune level and who retire within 12 months from the date of the rearrangement decision of the competent authority will enjoy the policy according to the provisions of Decree No. 29/2023/ND-CP of the Government regulating the policy of streamlining the payroll.
However, the Ministry of Home Affairs assessed that because the monthly allowance for non-professional workers at the commune, village and residential group levels is currently not high, the subsidy level for these subjects when arranging administrative units at the commune level is still low.
Therefore, to facilitate the settlement of policies for non-professional workers at the commune, village and residential group levels according to Conclusion 137-KL/TW, the Ministry of Home Affairs requests the Provincial People's Committee to study and propose policies for non-professional workers at the commune, village and residential group levels and send them to the Ministry of Home Affairs for the Ministry of Home Affairs to synthesize and submit to the Government for consideration and decision./.
