Explanation must promptly resolve hot issues

Continuing the 28th Session, on the afternoon of December 13, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly Standing Committee voted to approve in principle the draft Resolution guiding the organization of explanation activities at the meeting of the National Assembly's Ethnic Council and Committees.

Contribute to timely resolution of pressing issues

Presenting the Summary Report of the Draft Resolution of the National Assembly Standing Committee Guiding the organization of explanation activities at the meetings of the National Assembly's Ethnic Council and Committees, Secretary General of the National Assembly, Head of the National Assembly Office Bui Van Cuong stated the necessity of issuing the Resolution. Accordingly, since the Law on Supervision Activities of the National Assembly and People's Councils in 2015 was issued, explanation activities at the meetings of the National Assembly's Ethnic Council and Committees have been increasingly focused on and implemented, achieving many important results.

Since the 14th National Assembly term, the National Assembly Council and Committees have held 31 explanation sessions, some of which were jointly organized by the two Committees. The organization of explanation sessions has contributed to clarifying and promptly resolving inadequacies and pressing issues in social life, "hot" issues of current events that are of interest to voters and the people; thereby, enhancing the responsibility of ministries and branches in organizing the implementation of the Constitution and laws and enhancing the openness and transparency in the activities of state agencies; at the same time, creating positive changes in state management in all fields.

In addition to the achieved results, the activities of explanation at the sessions of the National Assembly's Ethnic Council and Committees have been basically regulated in a number of legal documents, such as the Law on Organization of the National Assembly, the Law on Supervision Activities of the National Assembly and People's Councils, etc., but the new regulations are only in principle, without specific regulations and instructions on the order, procedures, responsibilities, and powers of the agencies, so the organization of explanation sessions still faces many difficulties, confusion, and lack of consistency in deciding on the selection of explanation issues; the development and promulgation of plans for organizing explanation sessions, concluding the issues to be explained; the monitoring, urging, and evaluating the implementation of conclusions on the issues to be explained... Therefore, it has not created initiative for the subjects requesting explanation, the people requested to explain, related individuals and organizations, as well as the agencies and units serving the explanation activities; Lack of critical information, lack of participation of experts or subjects affected by the policy, partly affects the effectiveness and efficiency of accountability activities.

Based on the above situation, in order to promote the achieved results, overcome the shortcomings and limitations, especially in terms of procedures and processes, and ensure the requirement of "promoting and improving the quality of accountability activities at the Council of Nationalities and Committees of the National Assembly", it is necessary for the Standing Committee of the National Assembly to issue a Resolution Guiding the organization of accountability activities at the meetings of the Council of Nationalities and Committees of the National Assembly, meeting practical requirements, aiming to improve efficiency, create synchronization and unity, put accountability work into order, and contribute to improving the quality of supervision activities of the National Assembly and its agencies as stated in Conclusion No. 843-KL/DĐQH15 dated August 3, 2022 of the Party Delegation of the National Assembly.

The explanation conclusion must determine the cause and responsibility.

At the meeting, Chairman of the Law Committee Hoang Thanh Tung said that the Standing Committee of the Law Committee agreed with the necessity, purpose and viewpoint of building the Resolution.

Chairman Hoang Thanh Tung further emphasized the requirement that the guidance on the accountability activities of the National Assembly Council and the National Assembly Committees must be implemented in accordance with the provisions of the Law on the Organization of the National Assembly, the Law on Supervision Activities of the National Assembly and People's Councils, and other relevant legal documents. In addition, the Resolution's instructions must be specific, detailed, feasible, easy to understand, easy to implement, ensuring consistency and unity in the implementation process.

The order and procedures for conducting the accountability activities of the Nationalities Council and the National Assembly Committees must accurately reflect the nature of the accountability activities and the practice of accountability activities in the past; at the same time, the process of preparation, implementation, and issuance of conclusions of the accountability sessions must be urgent, meeting the requirements for timely consideration and resolution of hot and pressing issues in society.

Regarding the nature of the explanation activity, the Standing Committee of the Law Committee believes that this draft Resolution is not a legal document but a guiding document of a handbook nature to guide the unified implementation of the organization of explanation activities of the Nationalities Council and Committees of the National Assembly. The draft Resolution does not set out new regulations but specifies and guides the implementation of regulations in relevant laws on the selection and decision of explanation content, order of organization of explanation activities, implementation of explanation conclusions, responsibilities of relevant agencies and organizations... similar to the Resolution guiding the supervision of legal documents and the Resolution guiding the supervision of People's Councils issued by the Standing Committee of the National Assembly.

At the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh emphasized that the explanation must have a conclusion. The conclusion must be close to the explanation content, clear information, correctly assess the current situation, correctly identify the cause, responsibility, correctly identify the issue that needs to be further worked on, the deadline for doing it, the deadline for reporting back and public information. At the same time, it is stipulated that the conclusion of the explanation session must be voted on at the explanation session, there should not be a separate meeting to vote on the explanation conclusion.

At the meeting, with 100% of the members of the National Assembly Standing Committee participating in the vote in favor, the National Assembly Standing Committee voted to approve in principle the draft Resolution guiding the organization of explanation activities at the meetings of the National Assembly's Ethnic Council and Committees./.
