Regarding the case of a business producing tens of thousands of tons of cooking oil for humans from vegetable oil for animal feed, earning VND8,200 billion, in response to VTC News, Mr. Tran Viet Hoa, Director of the Department of Industry ( Ministry of Industry and Trade ) affirmed: The Ministry of Industry and Trade did not issue a food safety certificate to Nhat Minh Food Production and Import-Export Company Limited to produce Ofood cooking oil. Nhat Minh Food Production and Import-Export Company Limited only has a self-declaration of products for vegetable oil products.
“The act of using vegetable oil raw materials of animal feed origin to produce and process food for human consumption is an act of intentionally distorting the nature, uses and purposes of goods, showing signs of constituting the act of producing and trading in counterfeit goods according to the provisions of Clause 7, Article 3 of Decree No. 98/2020/ND-CP”. Director of the Department of Industry Tran Viet Hoa said.
According to Mr. Hoa, vegetable oil used for animal feed is a raw material on the management list according to Circular 21/2019/TT-BNNPTNT, under the management of the Ministry of Agriculture and Rural Development (now the Ministry of Agriculture and Environment ). The production, trading and use of vegetable oil for this purpose must strictly comply with safety, quality, product declaration and labeling.
“Vegetable oil used for animal husbandry does not meet food hygiene and safety standards and has no uses or value for consumers. Therefore, when intentionally introduced into the food production chain for humans and labeled as “vegetable oil” or “cooking oil for humans”, the nature and uses are misleading; there are signs of counterfeiting the uses and purposes of the goods. Labeling vegetable oil for human use is an act of fraud regarding the nature of the goods. This act poses a serious risk to public health and violates the rights of consumers,” Mr. Hoa said.
According to the assessment of the leader of the Department of Industry, Article 65 of the Law on Food Safety, Article 40 of Decree No. 15/2018/ND-CP stipulates that the People's Committee at the provincial level is responsible for: Implementing state management of food safety at the local level, being responsible to the Government for food safety at the local level; Organizing the reception of self-declared products; certifying establishments that meet food safety conditions according to assignment and decentralization; Inspecting, checking, and handling violations of food safety laws in the management area.
According to initial information from the Department of Industry, up to now, Nhat Minh Food Production and Import-Export Company Limited has self-declared its products for vegetable oil products. However, the Ministry of Industry and Trade has not yet issued a Food Safety Certificate to this enterprise. At the same time, the Ministry of Industry and Trade has not received reports from local authorities and relevant agencies on the above-mentioned acts of producing and consuming fake cooking oil.
In the coming time, the Ministry of Industry and Trade will direct the Departments of Industry and Trade and coordinate with the People's Committees of provinces and centrally-run cities to direct local functional units to conduct large-scale inspections of cooking oil production facilities, especially small-scale facilities, facilities without food safety certificates, and facilities exempted from food safety certificates.
“The above incident shows signs of serious violations of the law on production and trade of counterfeit goods, commercial fraud, protection of consumer rights and violations of prohibitions under the law on food safety. The Ministry of Industry and Trade directs functional units to continue to coordinate with management agencies to handle the case resolutely, not to affect the reputation of the food industry and the trust of consumers,” The head of the Department of Industry said.
On the evening of June 24, Vietnam Television (VTV) reported that Hung Yen Provincial Police, in coordination with relevant agencies, had dismantled a fake cooking oil production and consumption ring with a scale of tens of thousands of tons. This large-scale fake cooking oil production ring involved many businesses across the country. What many people find unbelievable is that this large amount of cooking oil for humans actually comes from vegetable oil used for animal feed. To conceal their actions, the masterminds used underground pipes to pump oil from the tank containing raw materials for animals to the tank containing oil for human use. They then announced that the product was cooking oil supplemented with vitamin A, but the results of the authorities' tests showed that this ingredient did not exist. Initially, the subjects were identified as having sold tens of thousands of tons of substandard vegetable oil to consumers.
