Giving opinions on the draft Land Law (amended) at the conference of full-time National Assembly deputies recently held in Hanoi, National Assembly deputy Pham Van Hoa (Dong Thap) expressed special interest in the issue of land recovery for socio -economic development, serving national defense and security purposes, and for national and public interests.
The delegate said that this is a necessary issue but suggested that it is necessary to clearly separate land acquisition for national defense, security, social security, and public purposes from land acquisition for commercial projects and new urban areas. For these projects, investors must have an agreement with the people so that it is appropriate. The State should not acquire land for commercial housing projects. At the same time, there should be specific regulations to clearly identify cases of land acquisition.

Regarding compensation and resettlement support when the State reclaims land, National Assembly Deputy Pham Van Hoa suggested that the regulations on resettlement need to be more clear that the State supports resettlement with better housing than the old place. However, the Deputy wondered if the regulations as in the draft are "better in what way?", this issue is not clear.
The delegate said that the resettlement area must ensure as prescribed, complete the conditions of technical infrastructure, social infrastructure, synchronize with the detailed planning and have the approval of competent authorities, such regulations will be appropriate. In particular, resettled people have the right to choose accommodation in the same area, district level, county level or province level for people with practical needs. At the same time, it is suggested that before the decision to approve land recovery, there should be a resettlement area first so that people can stabilize their living conditions.

Regarding land prices, National Assembly Deputy Pham Van Hoa agreed with the provisions of the draft Law that are determined according to the principles of market mechanisms and common land prices on the market. He suggested that the Drafting Committee pay attention to this content and calculate land prices effectively.
Regarding the issue of overseas Vietnamese with foreign nationality and foreigners with Vietnamese nationality being allowed to own land use rights in Vietnam, the Delegate said that such regulations are still general and suggested that the Drafting Committee clearly separate this content to avoid confusion.
Land price list needed soon to recover real estate market
Meanwhile, National Assembly Deputy Vu Trong Kim ( Nam Dinh ) said that if the land price list is not available until 2025, it will be late compared to the current land market requirements when the market is facing many difficulties due to the impact of the pandemic. The delegate suggested that the authorities need to show high determination in completing the land price list early to recover the real estate market.

Regarding compensation and resettlement for land recovered by the State, Delegate Vu Trong Kim said that it is necessary to determine the time for compensation and resettlement, because this is the source of complicated complaints.
According to the delegate, when calculating the time, interest should be calculated for the land grantor, so that the compensated person can actively resolve the issue. In resettlement, it is also necessary to ensure infrastructure and cultural quality standards, and there should be a commitment between the land user and the land grantor to minimize disagreements and complicated complaints, and achieve a harmony of interests between the two parties.
In addition, National Assembly Deputy Vu Trong Kim said that the notary office should be fully responsible before the law for determining the price when conducting transactions based on the price list of the land area and plot of land at that location, to enhance the responsibility of the notary office, reduce the role of the natural resources and environment sector, and the land registration office. It is possible to connect directly from the notary office to the tax authority to shorten procedures, ensuring tax revenue for the State.
