Workshop on comments on the Draft Decree and Circular amending and supplementing a number of regulations on land valuation in the Southern and South Central regions

Speaking at the opening of the Workshop, Deputy Minister of Natural Resources and Environment Le Minh Ngan said: Realizing the importance of the policy on land valuation and implementing the direction of the Government and the Government Standing Committee, the Ministry of Natural Resources and Environment has developed a draft Decree amending and supplementing Decree No. 44/2014/ND-CP dated May 15, 2014 (Decree 44) of the Government regulating land prices and a Circular amending and supplementing a number of articles of Circular No. 36/2014/TT-BTNMT dated June 30, 2014 (Circular 36) of the Minister of Natural Resources and Environment detailing the method of land valuation; developing and adjusting land price tables.

Overview of the Workshop

The draft is built on the spirit of Resolution 18-NQ/TW in addition to amending policies related to land prices in the process of amending the Land Law to ensure timely removal of existing obstacles in practice, and unlocking land resources for socio-economic development.

According to Deputy Minister Le Minh Ngan, the Southern and South Central regions are very dynamic in terms of economy, trade, and services, with high demand for land use to implement projects, so it is often necessary to conduct specific land valuations for large plots of land, encountering many difficulties and obstacles in practical implementation.

Therefore, Deputy Minister Le Minh Ngan suggested that, based on the actual situation in the localities, delegates from 26 provinces and cities attending the Workshop actively contribute opinions, go straight to the local problems in order to complete these two important legal documents in the fastest time and ensure quality, effectiveness and efficiency in implementation.

Speaking at the workshop, Mr. Vo Van Hoan, Vice Chairman of the Ho Chi Minh City People's Committee, said: In the process of implementing the provisions of the land law, Ho Chi Minh City has encountered many difficulties and obstacles; proactively made many reports, proposals, and recommendations and has received attention from the Ministry of Natural Resources and Environment, timely guidance, solutions, and recommendations to the Central Government on appropriate mechanisms and policies.

Implementing Decree No. 44 and Circular No. 36, in the past nearly 10 years, Ho Chi Minh City has consulted on determining land prices for more than 320 real estate projects, creating conditions for businesses to bring products to the market; people are publicly informed about objective and accurate land price determination methods, creating peace of mind when participating in purchasing real estate projects when their rights are fully exercised; at the same time, creating a large source of revenue for the City budget.

However, according to Mr. Vo Van Hoan, during the implementation process, Ho Chi Minh City encountered many difficulties and problems. Thereby, the City has made many reports, proposals, and recommendations and has received timely guidance and solutions from the Ministry of Natural Resources and Environment. However, in reality, there are still legal difficulties and problems, with some regulations that are not strict and not suitable for the reality in Ho Chi Minh City.

“The workshop to collect comments on the Draft Decree amending and supplementing Decree No. 44 and the Draft amending and supplementing Circular No. 36 is a valuable opportunity for Ho Chi Minh City as well as provinces and cities to contribute ideas on inadequacies, difficulties and problems. Therefore, we will together focus our intelligence to contribute detailed comments on the draft Decree and Circular with the highest sense of responsibility” – Vice Chairman of Ho Chi Minh City People's Committee Vo Van Hoan affirmed.

On behalf of the drafting agency, Mr. Dao Trung Chinh, Director of the Department of Planning and Land Resources Development, presented the main contents of the Draft amending and supplementing Decree 44 (including 11 amended and supplemented contents and 3 transitional contents) and the Draft amending and supplementing Circular 36 (including 3 main groups of contents).

According to Mr. Dao Trung Chinh, the spirit is to amend and supplement regulations on land valuation methods, procedures for applying land valuation methods in accordance with the conditions of information sources, input data and practical conditions of implementation in localities; clarify the selection and application of land valuation methods for each specific case to ensure transparency, accuracy and consistency in determining land prices. Review the content and procedures for applying valuation methods to shorten the time for determining specific land prices in localities, ensure the progress of valuation, reduce investors' waiting time, and simplify procedures for clearing land resources.

At the same time, supplement regulations on procedures, records, and responsibilities of natural resources and environment agencies, financial agencies, and relevant departments and offices in determining specific land prices, appraising land price plans to submit to the District People's Committee to decide on specific land prices in cases where the Provincial People's Committee authorizes the District People's Committee to decide on specific land prices according to the provisions of the Law on Organization of Local Government, Resolution No. 73/NQ-CP dated May 6, 2023 of the Government.

At the Workshop, many opinions of the leaders of the People's Committees and Departments of Natural Resources and Environment of 26 provinces and cities in the Southern and South Central regions agreed with and highly appreciated the Draft supplementing and amending Decree 44 and Circular 36 developed by the Ministry of Natural Resources and Environment. At the same time, delegates contributed, exchanged and discussed many contents of the Draft on the basis of determining actual land prices in the locality.

After listening to the comments, Deputy Minister Le Minh Ngan, on behalf of the Ministry of Natural Resources and Environment and the drafting agency, thanked and fully accepted all comments contributed at the Workshop. According to the Deputy Minister, the comments were very responsible and dedicated, demonstrating close attention to the work of determining land prices in the locality. All comments will be fully recorded, synthesized, accepted, explained, and selected by the drafting agency to complete the Draft Decree and guiding Circular.

"We will make the greatest and fastest efforts so that when the Decree is issued, it will unlock land resources, free up local barriers and truly put it into practice," Deputy Minister Le Minh Ngan emphasized.
