On May 8, 2024, the Ministry of National Defense issued Consolidated Document No. 10/VBHN-BQP Circular guiding the implementation of a number of articles of Decree No. 27/2016/ND-CP dated April 6, 2016 of the Government stipulating a number of regimes and policies for non-commissioned officers and soldiers serving in active service, demobilized and relatives of non-commissioned officers and soldiers in active service.
Scope of adjustment
This Circular guides the implementation of a number of regimes and policies for non-commissioned officers and soldiers serving in active service, being discharged from the army, and relatives of non-commissioned officers and soldiers serving in active service according to the provisions of Decree No. 27/2016/ND-CP dated April 6, 2016 of the Government stipulating a number of regimes and policies for non-commissioned officers and soldiers serving in active service, being discharged from the army, and relatives of non-commissioned officers and soldiers serving in active service.
Applicable objects
1. Non-commissioned officers and soldiers serving in active duty and discharged from service.
2. Relatives of non-commissioned officers and soldiers on active duty include: biological fathers and mothers; fathers-in-law or mothers-in-law; legal guardians; spouses; biological children and legally adopted children of non-commissioned officers and soldiers on active duty.
3. Agencies and units within the Ministry of National Defense and organizations and individuals related to the implementation of a number of regimes and policies for non-commissioned officers and soldiers serving in active service, discharged from service and relatives of non-commissioned officers and soldiers serving in active service are guided in this Circular.
Terms of enforcement
1. This Circular takes effect from August 15, 2016.
2. The regimes and policies prescribed in this Circular shall be implemented from January 1, 2016.
3. Circular No. 213/2006/TT-BQP dated December 23, 2006 of the Ministry of National Defense guiding the implementation of Decree No. 122/2006/ND-CP dated October 26, 2006 of the Government on regimes and policies for non-commissioned officers and soldiers serving in the army; Circular No. 75/2009/TTBQP dated September 18, 2009 of the Ministry of National Defense amending and adjusting a number of allowances, subsidies and spending norms in the Army; Clause 2, Article 5 of Circular No. 11/2012/TT-BQP dated February 20, 2012 of the Ministry of National Defense regulating the demobilization of non-commissioned officers and soldiers of the Vietnam People's Army and Joint Circular No. 20/2012/TTLT-BQP-BTC dated March 6, 2012 of the Ministry of National Defense and the Ministry of Finance guiding the implementation of Decree No. 88/2011/ND-CP dated September 29, 2011 of the Government on regimes and policies for families of non-commissioned officers and soldiers on active duty cease to be effective from the effective date of Decree No. 27/2016/ND-CP.
4. The Chief of the General Staff, Director of the General Department of Politics, commanders of agencies and units in the Ministry of National Defense and relevant organizations and individuals are responsible for implementing this Circular.
Articles 5 and 6 of Circular No. 13/2024/TT-BQP dated March 18, 2024 of the Minister of National Defense amending and supplementing a number of articles of legal documents under the promulgation authority of the Minister of National Defense related to the declaration of personal information when performing administrative procedures, effective from May 2, 2024, stipulate as follows:
“ Article 5. Entry into force
This Circular takes effect from May 2, 2024.
Article 6. Responsibility for implementation
The Chief of the General Staff, Director of the General Department of Politics, commanders of agencies and units in the Ministry of National Defense and relevant organizations and individuals are responsible for implementing this Circular".
