Presenting the Draft Law , Government Inspector General Doan Hong Phong said that the Law was developed and promulgated to promptly and effectively institutionalize the policy on reorganizing the apparatus of the political system, implementing a two-level local government; arranging a system of inspection agencies to be streamlined, strong, efficient, effective, and efficient; overcoming the limitations and inadequacies of the current Law on Citizen Reception, Law on Complaints, and Law on Denunciations, meeting practical requirements.
The Law is built on the viewpoint of closely following the guidelines and policies in the resolutions, directives and conclusions of the Central Executive Committee, the Politburo and the Secretariat in the field of citizen reception, handling of complaints and denunciations; related to the arrangement of the political system's apparatus, implementation of two-level local government; development of science, technology, innovation and national digital transformation; the policy of cutting administrative procedures, promoting decentralization and delegation of power in state management.
Ensure compliance with the 2013 Constitution (amended in 2025) and consistency with relevant legal documents.
The draft law consists of 4 articles. Specifically, Article 1 - Amending and supplementing a number of articles of the Law on Citizen Reception. Article 2 - Amending and supplementing a number of articles of the Law on Complaints. Article 3 - Amending and supplementing a number of articles of the Law on Denunciation. Article 4 - Implementation provisions.
The Draft Law omits 1/36 articles of the Law on Citizen Reception, 1/70 articles of the Law on Complaints; omits some contents in points and clauses of 4/36 articles of the Law on Citizen Reception, 1/70 articles of the Law on Complaints, 1/67 articles of the Law on Denunciations; adds 1 article to the Law on Citizen Reception, 1 article to the Law on Complaints; adds the contents of 3/36 articles of the Law on Citizen Reception, 6/70 articles of the Law on Complaints, 4/67 articles of the Law on Denunciations; amends and completes 8/36 articles of the Law on Citizen Reception, 5/70 articles of the Law on Complaints, 4/67 articles of the Law on Denunciations; makes technical corrections to 2/36 articles of the Law on Citizen Reception, 6/70 articles of the Law on Complaints.
Organizing the apparatus of the political system
The Draft Law amending and supplementing a number of articles of the Law on Citizen Reception, the Law on Complaints, and the Law on Denunciations focuses on amending and supplementing specific issues: Institutionalizing the policy on reorganizing the apparatus of the political system, implementing a two-level local government; arranging a system of inspection agencies to be streamlined, strong, efficient, effective, and efficient, including eliminating regulations related to the district level in receiving citizens, handling complaints and denunciations; adjusting the authority and responsibility in receiving citizens, handling complaints and denunciations according to the new organizational model of local governments, People's Courts, People's Procuracies, and the system of inspection agencies; enhancing the responsibility of heads of state administrative agencies and advisory agencies and units at all levels and sectors in receiving citizens, handling complaints and denunciations.
Institutionalize the Party's policy on breakthroughs in science and technology development, innovation and national digital transformation: Supplement regulations on online citizen reception; promote the application of information technology, digital transformation, build a national database on citizen reception, petition processing, complaint and denunciation settlement to serve the work of citizen reception, petition processing, complaint and denunciation settlement.
At the same time, institutionalize the policy of promoting decentralization, delegation of power, and cutting administrative procedures.
Overcoming shortcomings, difficulties and obstacles in implementing the Law on Citizen Reception, the Law on Complaints and the Law on Denunciations to contribute to improving the effectiveness and efficiency of state management in citizen reception and handling of complaints and denunciations.
