At the meeting, Mr. Hoang Thanh Tung, Chairman of the National Assembly 's Law Committee, said that regarding private archives, some opinions suggested reviewing and supplementing more complete and specific regulations on private archives to encourage the participation of organizations and individuals, thereby contributing to better preservation and promotion of the value of private archives; respecting and protecting ownership rights to private archives; ensuring harmonious handling of the relationship between the State and organizations and individuals in the management of private archives.
The Standing Committee of the Law Committee proposed to absorb and supplement regulations to encourage the participation of organizations and individuals in document archiving, specifically: regulations on organizations, individuals, families, clans, and communities to decide on the application of the provisions of the Law on Archives to private archives (Clause 4, Article 3); amend regulations on State policies on private archives, including supplementing a number of policies to develop private archive activities as shown in Article 45 of the draft Law.
Although the current Investment Law does not stipulate that the storage service business is a conditional investment business, Article 36 of the current Archives Law stipulates that organizations and individuals operating storage services must meet certain conditions, which are essentially investment and business conditions. Therefore, the Standing Committee of the Law Committee and the drafting agency propose to retain the regulation that storage service business is a conditional investment and business as the Government submitted to the National Assembly at the 6th session; at the same time, add to the draft Law a number of specific provisions on investment and business conditions to ensure transparency and assign the Government to specify in detail a number of technical and specialized conditions on storage as shown in Articles 50 and 51 of the draft Law.
Secretary General of the National Assembly Bui Van Cuong said that the draft Law only regulates the archiving activities for documents of the People's Council and People's Committee without any regulations for the Party Committee level, which is not satisfactory. Therefore, it is recommended that the source of documents must be sufficient from all three archive sources for the Party Committee, People's Council and People's Committee levels.
According to the Chairman of the National Assembly's Committee on Science , Technology and Environment, Le Quang Huy, it is necessary to add to the draft law the issue of encouraging digital transformation because only regulating the storage of modern Vietnamese archives is not enough. At the same time, there should be regulations on connecting and sharing valuable documents between agencies to promote the value of archives and review phrases about digital authentication.
Speaking at the meeting, National Assembly Chairman Vuong Dinh Hue suggested that from now until the submission to the National Assembly for consideration and approval and before signing for certification, relevant agencies need to continue reviewing to ensure the consistency of the legal system, especially on issues such as digital transformation, digital storage, digital government, digital economy, digital society, comparing with the Law on Information Technology, Law on Cyber Security, Law on Access to Information, Law on Protection of State Secrets.
In addition, drafting agencies and review agencies need to carefully compare with international treaties and agreements of which Vietnam is a member. Because Vietnam is currently a member of the International Council of Archives, the Association of Archives of French-speaking countries, and has also signed bilateral agreements with a number of countries in this field, it is necessary to carefully review to ensure consistency and no contradictions.
Regarding the management of archives, databases and documents, the National Assembly Chairman noted that agencies need to continue reviewing the content related to the issue of responsibility for providing information, connecting and sharing data related to Party archives, historical archives of the defense, police and foreign affairs sectors from central to local levels. At the same time, there should be regulations on these agencies periodically reporting to state management agencies in the field of archives, promptly sharing and connecting information and data to state management agencies, to increase the value of archives as well as the synchronization and unity of the national archives system.
Concluding the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh requested that the Standing Committee of the Law Committee continue to closely coordinate with the Ministry of Home Affairs and other agencies of the National Assembly, and relevant agencies of the Government to absorb the opinions of the Standing Committee of the National Assembly to continue perfecting the draft law, further improving the quality of the draft law, perfecting the report to continue explaining to submit to the National Assembly, first of all, preparing to organize the conference of specialized National Assembly deputies in the coming time.
