Proposal to shorten compensation time when land is recovered

The Department of Agriculture and Environment of Ho Chi Minh City has just reported to the People's Committee of Ho Chi Minh City to evaluate the implementation of the Land Law and propose amendments and supplements to a number of articles of the Land Law.

According to the report, the Department of Agriculture and Environment of Ho Chi Minh City pointed out a number of difficulties in the implementation of the 2024 Land Law and proposed solutions.

Specifically, Article 87 of the Land Law stipulates the measurement of maps when implementing compensation, support, resettlement, and land recovery for national defense and security purposes; socio -economic development for national and public interests (public purposes).

According to the Department of Agriculture and Environment of Ho Chi Minh City, measuring maps for all cases serving compensation, support and resettlement work according to this regulation takes a lot of time and in some cases is unnecessary, while currently many localities have basically completed measuring and creating regular cadastral maps according to the VN2000 coordinate system.

Therefore, to ensure the time and progress of compensation work, it is recommended that the Ministry of Agriculture and Rural Development draft amendments and supplements to Article 87 of the 2024 Land Law in the direction that for places where a regular cadastral map has been built according to the VN2000 coordinate system and fully updated data, it will be used to carry out land recovery work. For places where disputes or changes have occurred but have not been updated, it is necessary to conduct measurements and map making to serve compensation, support and resettlement work.

In addition, at Point a, Clause 3, Article 87 of the 2024 Land Law, there are regulations on the order and procedures for compensation, support, resettlement, and land recovery for public purposes.

Accordingly, the preparation, appraisal, approval of compensation plans, the organization implementing the compensation task shall prepare a compensation plan and coordinate with the People's Committee of the commune where the recovered land is located to publicly post the compensation plan within 30 days. Immediately after the posting period expires, a public consultation will be organized in the form of a direct meeting... Within 60 days from the date of organizing the consultation, a dialogue will be held if the person whose land is recovered does not agree with the compensation plan.

According to the Department of Agriculture and Environment, it is unreasonable to conduct a consultation with people whose land is recovered about the compensation plan after the 30-day public posting period has expired.

Therefore, to be suitable for practice and reduce the time for land recovery, it is recommended that the Ministry of Agriculture and Environment draft amendments in the direction that during the time of public posting, the organization will collect opinions from people whose land is recovered about the compensation plan...

According to the report, Ho Chi Minh City has 162 projects implemented in 2024 with a total amount of VND 35,076,392 billion, the total amount paid (as of May 4, 2025) is VND 10,215,672 billion. 79 projects implemented in 2025 with a total compensation capital of VND 9,379,532 billion; the amount of compensation disbursed (as of May 4, 2025) is VND 265,583 billion, only reaching a rate of 2.83%.
