Business owners who pay compulsory social insurance before July 1, 2025 will have their payment period recorded to resolve the regime, according to the Resolution of the National Assembly Standing Committee.
National Assembly Chairman Tran Thanh Man has just signed and issued Resolution No. 78/2025 of the National Assembly Standing Committee on recording the compulsory social insurance (SI) payment period of business household owners who participated before the Social Insurance Law 2024 took effect.
Accordingly, business owners who have paid compulsory social insurance before July 1, 2025 will have their time recorded as a basis for settling social insurance benefits. Business owners who have met the conditions for enjoying social insurance benefits before the above date will be settled to enjoy benefits from the date of eligibility.
The Government is assigned to guide the implementation of this Resolution; resolve arising problems; and ensure the rights of business owners.
According to current regulations, business households must pay compulsory social insurance for hired and contracted workers; household owners are not subject to compulsory payment. However, according to the Petition Committee's reflection in May 2023, many individual business household owners were illegally charged compulsory social insurance.
According to statistics from Vietnam Social Security, from 2003 to May 31, 2023, 3,567 business owners paid compulsory social insurance to the Social Security Fund of VND 113 billion. More than 9,600 business owners received sick leave and maternity benefits of nearly VND 13.3 billion; 275 people received pensions and death benefits of more than VND 32.8 billion; 397 people received one-time social insurance of nearly VND 9.4 billion.
According to the Ministry of Labor, War Invalids and Social Affairs (formerly), the Social Insurance Agency's collection of compulsory social insurance premiums from business owners is not in accordance with the law, and in principle, this money must be refunded. However, there is concern that refunding will cause problems due to incorrect collection for up to 20 years, many people have received benefits, and many household owners have reached retirement age and need to ensure social security benefits. After discussion, the parties agreed to propose recording the mandatory payment period so that household owners can enjoy benefits.
