7 projects terminated due to slow progress

The Provincial People's Committee issued Official Dispatch No. 2842/QD.UBND Decision approving the inspection results of the 2022 Interdisciplinary Inspection Team on the inspection of investment projects in Nghe An province.

In particular, the operation of 7 projects will be terminated and related legal documents will be annulled, including: Kids House International Kindergarten Project, invested by Tuoi ThoEducation and Entertainment Investment Company Limited; Precast Concrete Components Factory Expansion Project and Prestressed Concrete Products Project, invested by Hoa Hiep Company Limited; Construction Materials Business Facility Project, invested by Han Chau Service & Trading Investment Joint Stock Company; Restaurant and Hotel Area Project, invested by Phu Ha An Company Limited.

Project of Original Gold Ore Production and Processing Factory, invested by A Cuong Minerals Group Joint Stock Company and Do Linh Joint Stock Company; Project of Pilot Investment in Small-scale Domestic Waste Treatment Station, invested by T-tech Vietnam Technology Group Joint Stock Company; Factory of Roofing Tiles (High-tech Burnt Clay), invested by An Trach Son Company Limited.

The projects that Nghe An province has decided to terminate investment, revoke investment certificates... are all "suspended " and behind schedule projects.

Among the projects that are behind schedule and have had their investment certificates revoked, there are some projects that have been extended for the first time, even extended for the second time and have expired, but the investors still do not implement the project according to their commitments and investment progress. For example, the project to expand the factory of precast concrete components and prestressed concrete products.

Some projects have investors who have not made deposits to ensure project implementation as well as completed related legal procedures such as the project of the original gold ore production and processing factory, investors are A Cuong Mineral Group Joint Stock Company and Do Linh Joint Stock Company in Chau Hanh commune, Quy Chau district;...

The Provincial People's Committee assigns the Department of Planning and Investment to carry out procedures to terminate project activities, revoke investment certificates/investment registration certificates (if any) in accordance with the provisions of law; contact and notify investors about the termination of activities, cancellation of relevant legal documents for the projects; and announce on the electronic information page. The Department of Planning and Investment shall preside over and coordinate with the Department of Finance, the District People's Committees and relevant agencies to advise and handle projects that have deposited funds to ensure project implementation in accordance with the provisions of law.

In addition, the People's Committee of Nghe An province also requested investors to terminate all activities related to the project according to current regulations; take full responsibility for the costs incurred (if any) related to the project; coordinate with relevant agencies in handling the deposit amount to ensure project implementation in accordance with the provisions of law (if any).

Classify and handle suspended and delayed projects

From 2016 to 2021, interdisciplinary inspection teams conducted 489 inspections on 391 projects (2.7 times higher than the 2011-2015 period when only 186 projects were inspected); of which, 258 projects had been allocated land or leased land and 133 projects had not been allocated land or leased land.

Thereby, terminating the validity of legal documents, terminating all activities of 91 projects (retrieving land that has been assigned or leased for 23 projects); allowing the continued implementation of 30 projects according to schedule, of which 24 projects have been assigned or leased land and 6 projects have not been assigned or leased land; extending the implementation progress of 168 projects, of which 132 projects have been assigned or leased land and 36 projects have not been assigned or leased land.

Other handling for 80 projects (temporarily suspend to review planning, environmental treatment, public assets; assign departments, branches, and localities to inspect and work with investors again; request investors to review and report). Along with that, there are 13 projects that were allocated land, leased land but the investors used the land for the wrong purpose, violated construction order, arbitrarily changed the land use purpose, inspected, checked, and handled administrative violations for 5 projects.

The Nam Hoa Villa Housing Project is nearly 10 years behind schedule, and has been adjusted for an additional 24 months.

Regarding this, Mr. Cao Tien Trung, Head of the Economic - Budget Committee of Nghe An Provincial People's Council, reported to Nghe An Provincial People's Committee, pointing out many shortcomings and limitations such as: Many projects are not implemented, are behind schedule; after being reviewed, inspected and extended, but when the extension period expires, they are still not implemented, are not implemented on schedule and continue to be behind schedule. In particular, in urban areas, there is a high rate of suspended projects and projects behind schedule.

On the other hand, many projects are behind schedule because they have only completed investment and construction procedures but have not yet been allocated or leased land due to difficulties and problems with compensation and site clearance; some investors have not proactively completed investment procedures. Some projects have been allocated or leased land in violation of land laws, such as allowing people to encroach, leaving it fallow, building against planning, using it for the wrong purpose, wasting it, and subleasing land in violation of regulations.

The coordination, monitoring, inspection and reporting of project progress is sometimes not timely and not consistent, so there are still many projects behind schedule, projects using land for the wrong purpose but have not been inspected and handled. The management of projects after termination of operations is not close, not attracting many replacement investment projects;...

Mr. Nguyen Nam Dinh, Permanent Vice Chairman of the People's Council of Nghe An province, made recommendations to the Provincial People's Committee on a number of issues "regarding suspended projects, projects behind schedule and projects using land for the wrong purpose in Nghe An province".

In particular, building data on non-budget investment projects in the province to monitor the status and progress of projects; proposing to screen licensed projects; supplementing and amending investment processes and procedures in the direction of stipulating the maximum time to complete procedures on site survey, investment policy, detailed planning, compensation, site clearance, land allocation, land lease to minimize the situation of suspended projects, slow progress due to investors not proactively completing procedures after being allowed to survey and select locations or grant investment policies;...

At the meeting of the Nghe An Provincial People's Council in July 2023, Mr. Pham Hong Quang, Director of the Department of Planning and Investment, informed that in 2022, the Nghe An Provincial People's Committee established an inspection team for 146 projects. Currently, the inspection teams are synthesizing to report to the Provincial People's Committee for 99/146 projects. In 2023, the Departments, branches and localities will continue to review and inspect slow-progressing projects.
