Continuing the ninth session, on the morning of May 7, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, the National Assembly listened to the Report on explanation, acceptance and revision of the draft Law on Employment (amended); discussed in the hall about a number of contents with different opinions of the draft Law on Employment (amended).

Ensure the correct objectives of amending the Law

Presenting the Report on explanation, acceptance and revision of the draft Law on Employment (amended), Chairman of the National Assembly's Committee on Culture and Society Nguyen Dac Vinh said that, so far, basically, the draft Law on Employment (amended) submitted to the National Assembly has ensured the correct objectives of amending the Law, there are no major contents with different opinions between the drafting agency, the reviewing agency and relevant agencies.

Regarding labor registration, Mr. Nguyen Dac Vinh said that, to ensure feasibility and convenience for labor registrants, the Government should pay attention to ensuring funding sources to build, maintain and update the database on laborers and the labor information system; adjust, update and manage the database on laborers; ensure connectivity and data sharing between databases (national database on insurance, national database on population, etc.); have regulations to encourage laborers to proactively register for labor; enhance the responsibility of employers in implementing labor declarations...

Regarding the period of unemployment insurance payment that is not reserved, the Standing Committee of the National Assembly finds that this content is not included in the provisions of the current Law but is stipulated in Circular No. 15/2023/TT-BLDTBXH dated December 29, 2023 of the Ministry of Labor, War Invalids and Social Affairs. The draft Law, when submitted to the National Assembly at the eighth session, added this content. In the spirit of innovation in thinking in law-making and absorbing the opinions of National Assembly deputies, the Standing Committee of the National Assembly has directed the revision in the direction of not stipulating this content in the draft Law.

Regarding the organization of public employment services (Employment Service Centers in the current Law), taking into account the opinions of National Assembly deputies, the draft Law has been revised in the direction of not directly regulating Employment Service Centers but regulating employment service organizations including public employment service organizations (formerly Employment Service Centers) and employment service enterprises (Clause 2, Article 28), assigning the Government to regulate the conditions for establishment, organization and operation of public employment service organizations (Clause 6, Article 28).

Regarding the content of the responsibility to notify about the job search of employees (Clause 1, Article 42), accepting the opinions of National Assembly deputies, the National Assembly Standing Committee has directed to adjust in the direction that during the period of receiving unemployment benefits, every month, employees must notify about their job search to the public employment service organization where they are receiving unemployment benefits and assign the Government to specify in detail to ensure flexibility and convenience for employees.

Proposal to increase unemployment benefits

Discussing in the hall about the Law on Employment (amended), the majority of opinions of National Assembly deputies agreed with the amended content and highly appreciated the report explaining, accepting and revising the draft Law on Employment (amended).

Contributing additional comments to the draft Law, delegate Tran Van Khai (Ha Nam Delegation) said that the draft Law on Employment (amended) is an opportunity to institutionalize the Party's major policies on science and technology development, innovation and national digital transformation, private economic development and restructuring and streamlining the apparatus; thereby, creating a strong driving force for sustainable development of the labor market.

Delegate Tran Van Khai suggested continuing to review and supplement to ensure the most complete institutionalization of the Party's major policies; in which it is necessary to prioritize and support the private economy as the main driving force in creating sustainable jobs for workers; consider developing a nationwide integrated online job exchange; have an inter-sectoral coordination mechanism in implementing employment policies.

Concerned about the unemployment benefit policy for workers, delegate Thach Phuoc Binh (Tra Vinh delegation) said that, regarding the unemployment benefit level, the draft Law stipulates the benefit level at 60% of the average monthly salary, which is low and difficult to ensure the standard of living in the case of workers losing their jobs and having no income. Therefore, the delegate proposed that the unemployment benefit level be increased to about 65% of the average salary for unemployment insurance; in case of economic crisis, epidemic..., the Government is allowed to increase the benefit level for workers to a maximum of 75%.

According to Delegate Duong Khac Mai (Dak Nong Delegation), currently, the Party and State are vigorously implementing the revolution of rearranging and streamlining the apparatus of the political system throughout the country. From there, a labor force from the State sector will enter the labor market. This is a team with high professional qualifications and good discipline, so the drafting committee of the Law needs to update this reality to study and have appropriate policies, maximizing this resource for national development.

Delegate Duong Van Phuoc (Quang Nam Delegation) proposed to the drafting committee of the draft Law that it is necessary to regulate the maternity leave period of employees participating in unemployment insurance, to unify the regulations with other types of insurance (all are covered during maternity leave).

Delegates Nguyen Hoang Bao Tran (Binh Duong Delegation) and Ha Sy Dong (Quang Tri Delegation) proposed that the drafting committee of the draft Law add the force of cadres, civil servants and public employees to the unemployment insurance policy, because this force is also workers and may face the risk of unemployment. This policy ensures social security and ensures fairness among the labor forces in society.

Speaking at the end of the discussion session, Vice Chairwoman of the National Assembly Nguyen Thi Thanh highly appreciated the opinions of the National Assembly deputies; at the same time, she said that the competent authority will synthesize, study and explain the opinions to continue to perfect the draft Law in the best way. It is expected that the draft Law on Employment (amended) will be passed by the National Assembly on June 11, 2025.
