Clarifying regulations related to the responsibilities of grassroots trade unions

Continuing the 44th Session, this afternoon, April 28, under the direction of Vice Chairman of the National Assembly Nguyen Khac Dinh, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Implementing Democracy at Grassroots Level.

Establishment of Vietnam Fatherland Front Committees in special administrative- economic units decided by the National Assembly

According to the Draft Law Report presented by Vice President - General Secretary of the Central Committee of the Vietnam Fatherland Front Nguyen Thi Thu Ha, the Law focuses on a number of articles directly related to the position, role, functions, powers and responsibilities, organizational structure and principles of organization and operation of the Vietnam Fatherland Front, socio -political organizations, and mass organizations assigned tasks by the Party and State.

The subjects of the Law are: Vietnam Fatherland Front at all levels; socio-political organizations from central to local levels; mass organizations assigned tasks by the Party and State; other member organizations of the Front; relevant agencies, organizations and individuals.

The draft Law consists of 5 articles. To be consistent and consistent with the arrangement and reorganization of administrative units at all levels and the construction of a 2-level local government organization model (provincial and grassroots levels, not organized at the district level), consistent with the provisions of the Law on Organization of Local Government (after amendment), the draft Law amends the provisions in Clause 3 in the direction of removing the provision: "The Vietnam Fatherland Front Committee of districts, towns, and cities under the province" organizes the Vietnam Fatherland Front at the provincial and communal levels.

At the same time, amend and supplement the provisions of the Vietnam Fatherland Front at Point b, Clause 3 and Clause 4 as follows: At the local level, there are Vietnam Fatherland Front Committees of provinces and centrally run cities; there are Vietnam Fatherland Front Committees of communes, wards and special zones in islands. At each level, there is a Standing Committee of the Vietnam Fatherland Front Committee. The establishment of Vietnam Fatherland Front Committees in special administrative-economic units is decided by the National Assembly.

The organization, tasks and powers of the agencies of the Vietnam Fatherland Front are prescribed in the Charter of the Vietnam Fatherland Front.

Presenting the Preliminary Review Report on this content, Chairman of the Committee on Culture and Society Nguyen Dac Vinh stated that the Standing Committee of the Committee agreed with the necessity of promulgating the Law amending and supplementing 4 laws with the political, legal and practical bases stated in the Submission; basically agreed with the scope of amendments and supplements of the draft Law, mainly focusing on regulating issues related to the organizational arrangement of the Vietnam Fatherland Front and its member organizations.

Regarding the amendment and supplementation of the Law on Grassroots Democracy in the draft Law, the Standing Committee of the Committee agreed with the proposal of the drafting agency to ensure consistency and unity in the new regulations on organization and apparatus. In addition, it requested the drafting agency to continue reviewing the contents related to the organization of two-level local governments and other regulations related to the arrangement and organization of the apparatus.

At the same time, it is recommended to continue reviewing a number of laws with provisions related to the activities of the Vietnam Fatherland Front in laws that are being amended such as: Law on Promulgation of Legal Documents, Law on Election of National Assembly Deputies and People's Council Deputies, Law on Organization of People's Courts, Law on Organization of People's Procuracies...; complete and promptly update the amended contents of these laws to make appropriate adjustments in the draft Law (if appropriate).

Research and review the whole to amend the Law on Vietnam Fatherland Front

The National Assembly Standing Committee acknowledged that the draft Law dossier had been prepared urgently, actively and seriously by the drafting agency in coordination with relevant agencies in accordance with the provisions of the Law on Promulgation of Legal Documents; agreed that the scope of amendment of this law is one law amending four laws and agreed to submit it to the National Assembly for consideration and approval according to the simplified procedure at the Ninth Session.

The National Assembly Standing Committee also highly appreciated the Preliminary Review Report of the Standing Committee of the Culture and Social Affairs, which was prepared in accordance with regulations and also initially clearly expressed its views on the contents of the Submission.

Commenting on the draft Law, Chairman of the Delegation Work Committee Nguyen Thanh Hai suggested that the drafting agency continue to research, review and supplement regulations on transitional provisions to ensure feasibility and continuity of operations of organizations and individuals when implementing the law.

In addition, there should be general regulations on principles for the activities of the Vietnam Fatherland Front, trade unions, youth unions and the implementation of grassroots democracy when converting to a two-level local government model.

The Chairman of the Delegation Work Committee also suggested that it is necessary to continue researching and reviewing all relevant laws to amend the Law on the Vietnam Fatherland Front and other laws in a more systematic and comprehensive manner.

Chairman of the Law and Justice Committee Hoang Thanh Tung suggested that it is necessary to clarify some contents related to the organizational arrangement, specifically the regulations related to the responsibilities of grassroots trade unions. Along with that, review the regulations related to the district level in the Law on Implementing Democracy at the Grassroots Level to ensure complete amendment and elimination.

Carefully consider and ensure consistency between the draft law and other related draft laws, especially those with contents related to the organizational arrangement that will also be submitted to the National Assembly for consideration and approval at the upcoming Ninth Session, such as: Criminal Procedure Code, Civil Procedure Code, Law on Promulgation of Legal Documents.

Concluding this content, Vice Chairman of the National Assembly Nguyen Khac Dinh stated that the National Assembly Standing Committee requested the Presidium of the Central Committee of the Vietnam Fatherland Front to coordinate with relevant agencies to direct continued research and maximum absorption of opinions at this session; opinions in the Preliminary Review Report of the Standing Committee of the Committee on Culture and Social Affairs as well as opinions participating in the review of the National Assembly Committees to promptly complete the draft law dossier to submit to the National Assembly for comments and send to National Assembly deputies before the opening of the session.

The Vice Chairman of the National Assembly also noted that it is necessary to continue reviewing relevant laws and supplementing content to absorb and explain comments from the Government and socio-political organizations; assess the compatibility of the draft Law with relevant international treaties to which Vietnam is a member; closely follow the direction of amending the Constitution as well as promptly update the content of amending the Constitution and relevant laws being amended to adjust when necessary, ensuring the constitutionality, legality, consistency and unity of the legal system.

At the same time, continue to review and ensure compliance with current laws and laws being amended and supplemented such as the Criminal Procedure Code, Civil Procedure Code, Law on Organization of People's Courts, Law on Promulgation of Legal Documents, Law on Election of Deputies to the National Assembly and People's Councils, Law on Organization of People's Procuracy.
