Residents of Tan Tay Do service land area (Dan Phuong district):

Reflecting to Hanoi Moi Newspaper, households living in Tan Tay Do service land (group 1, Tan Lap commune, Dan Phuong district) said that about 160 households have lived stably here for many years, but up to now, many households have not been imported or registered for temporary residence.

Tan Tay Do service land area was formed 15 years ago, since about 230 households in Tan Lap commune whose agricultural land was recovered were allocated service land by the State according to Decision No. 1098/2007/QD-UBND dated June 28, 2007 of the People's Committee of Ha Tay province (old) on promulgating regulations on land allocation with land use fees for production, business - service premises or residential land for households and individuals when the State recovered agricultural land to implement projects in the area. After being allocated land, many households built houses for living, business - service, or transferred (currently about 160 households have moved in). However, in addition to the number of households with permanent residence in Tan Lap commune, most of the households receiving service land transfers here have not been registered for temporary residence, which greatly affects their rights.

Mr. Duong Van Cong, from Thai Nguyen province, residing at house number 5, lane 79, residential group 1, Tan Lap commune, said: “In 2010, my family received a transfer of a land plot with an area of ​​57.4 square meters, then built a house and moved here to live, but currently no one has been registered for temporary residence. Therefore, the children have to apply for school outside the district; the parents are not allowed to participate in Party and mass organization activities at the place of residence. Meanwhile, the family has fully implemented all activities and contributions to the locality…”.

Sharing the same concern, Mr. Le Phi Truong from Thanh Hoa province, residing at house number 46, lane 79, residential group 1, Tan Lap commune shared that his family bought a house and moved here in 2021, but because they were not allowed to register their household or register for temporary residence, their children could not go to school in the right area, and the family had to pay for electricity and water according to the service business price: VND 29,000/m3 of water (excluding value added tax and environmental protection fee), VND 3,200/kWh of electricity.

Talking to reporters of Hanoi Moi Newspaper about this, Head of Residential Group 1 (Tan Lap Commune) Tran Dinh Hoan said that the reason is because the purpose of land use here is "non-agricultural production land", not residential land. This is also the reason why electricity and water businesses have applied the correct business price.

According to Chairman of Tan Lap Commune People's Committee Nguyen Van Hoc, since 2023, 160 households with land in Tan Tay Do service land have submitted applications to change the purpose of use to residential land. The Commune People's Committee has made a list and submitted a proposal report to Dan Phuong District People's Committee and relevant agencies, but to date there have been no specific instructions.

On the side of Dan Phuong district, Deputy Head of the District Department of Agriculture and Environment Bui Van Hoa said that the district has responded to the people's petition. Previously, when converting from non-agricultural land that is not residential land to residential land, households did not have to pay land use fees, but now, based on the 2024 Land Law, when converting, households must fulfill financial obligations. Many households said that people in most service land areas in the district do not have to pay financial obligations when converting, so to ensure fairness, households in Tan Tay Do service land area also requested to be exempted from financial obligations, the reason being that the origin of the land and the time of granting service land in the area are the same and all households have had to pay land use fees.

“In March 2025, the People's Committee of Dan Phuong district sent a report to the City People's Committee and the Department of Agriculture and Environment requesting written guidance for cases of land allocation for long-term stable service according to Decision 1098/2007/QD-UBND dated June 28, 2007 of the People's Committee of Ha Tay province (old) when applying to change the purpose of use to residential land, do they have to fulfill financial obligations? After having specific instructions, we will advise the District People's Committee to implement in accordance with regulations to ensure fairness, helping people stabilize their lives", Mr. Bui Van Hoa added.
