On the morning of April 28, the National Assembly Standing Committee gave its opinion on the draft Law amending and supplementing a number of articles of the Law on Vietnamese Nationality. The draft law will be submitted to the National Assembly for consideration and approval at the upcoming 9th session.
Two major nationality policy groups propose amendments
Presenting the Government's proposal, Minister of Justice Nguyen Hai Ninh emphasized that this bill aims to create more favorable conditions for foreigners and the Vietnamese community abroad when carrying out procedures to acquire/reclaim Vietnamese nationality.
According to the Minister of Justice, the draft law focuses on two major policies.
Firstly, amend and supplement a number of regulations related to the acquisition of Vietnamese nationality, in order to facilitate cases where the biological father or mother or paternal or maternal grandparents are Vietnamese citizens; foreign investors, scientists, experts... are granted Vietnamese nationality.
Second, amend and supplement a number of regulations related to the return of Vietnamese nationality to create conditions for those who have lost Vietnamese nationality to return to Vietnamese nationality.
With this amendment, the bill stipulates that all cases of losing Vietnamese nationality and applying to regain Vietnamese nationality can be considered.
At the same time, it is added that "people applying to regain Vietnamese nationality can retain foreign nationality if they meet the conditions prescribed by the Government and are permitted by the President".
Regarding the additional content, Minister Nguyen Hai Ninh said the bill adds the condition "must be a person with only one nationality, Vietnamese nationality, and must permanently reside in Vietnam" when Vietnamese citizens who also have foreign nationality participate in elected bodies, agencies of the political system, and perform military and police service....
This regulation aims to ensure political security and national interests.
In addition, to create flexibility in recruiting specific cases with outstanding abilities to join the state civil service, the bill stipulates "special cases as prescribed by the Government".
According to the draft law submitted by the Government, candidates, those who are elected, approved, appointed, hold positions and titles for a term; those who are recruited, appointed to ranks, positions and titles of state agencies and socio-political organizations at the central and local levels; and those who join the armed forces of Vietnam must have only one nationality, Vietnamese nationality, and must permanently reside in Vietnam, except in special cases prescribed by the Government.

Rules with exceptions for all should be considered carefully and cautiously.
Examining this content, Chairman of the Law and Justice Committee Hoang Thanh Tung said that the Committee basically agreed to add the provision "must be a person with only one nationality, Vietnamese nationality" for "candidates, elected, approved, appointed, holding positions and titles for a term of office.
Being recruited and appointed to ranks, positions and titles of state agencies and socio-political organizations at the central and local levels; participating in the armed forces of Vietnam".
However, according to the review agency, the provision of exceptions for all these subjects needs to be carefully considered.
Special cases should only be considered and applied to those recruited and appointed to ranks, positions, and titles of state agencies and socio-political organizations at the central and local levels. It is necessary to attract and create conditions for recruiting talents.
The review agency proposed to continue reviewing current laws that require "only one Vietnamese nationality" and stipulate standards and conditions for being only "Vietnamese citizen" to propose appropriate amendments and supplements.
Regarding cases of regaining Vietnamese nationality, the examining agency agrees with this regulation to create more favorable conditions and encourage more people who have lost Vietnamese nationality to regain Vietnamese nationality, contributing to limiting the stateless situation of Vietnamese people abroad.
However, there are opinions suggesting that the law should specify the conditions for "possibility" of regaining Vietnamese nationality because it is related to the right to regain nationality of Vietnamese people abroad.
