The National Assembly has issued a resolution of absolute prohibition, so the Investment Law must clearly stipulate, cannot be left blank or allow production for export purposes.
Delegate Le Van Kham (HCMC) is concerned that not including e-cigarettes and heated tobacco products in the banned list will lead to conflicts with Resolution 173, especially in the context of the draft law containing transitional provisions that could create loopholes for businesses to return to trading banned products.
Delegates Duong Ngoc Hai and Tran Hoang Ngan (HCMC) both said that e-cigarettes and heated tobacco products have been identified as prohibited industries and need to be updated immediately in Article 6 of the draft Law.
Delegate Le Hoang Anh emphasized that not including e-cigarettes and heated tobacco products in the banned list is a policy step backward, going against the Party's policy, Resolution 72 and especially Resolution 173 of the National Assembly.
According to him, e-cigarettes and heated tobacco products are being exploited to bring synthetic drugs into schools in a sophisticated disguise; therefore, the National Assembly needs to show its mettle and not let group interests dominate.
Delegate Nguyen Thi Thuy ( Thai Nguyen ) reiterated that Resolution 173 has received strong support from society. She said that this draft law has completely eliminated the prohibition provision, which is inconsistent with the conclusion of the National Assembly Standing Committee and the wishes of voters.
Delegate Nguyen Lan Hieu ( Gia Lai ) warned that heated tobacco products are no less toxic than traditional cigarettes, while e-cigarettes are even more dangerous because the solution can be mixed with addictive substances. He said that e-cigarettes should be absolutely banned and controlled as a form of drug at entertainment venues.
Delegate Nguyen Thi Mai Thoa (Hai Phong) also agreed to add to the banned list, and at the same time proposed to study very limited exceptions such as production for export or research.
Delegate Nguyen Thi Thu Dung (Hung Yen) affirmed that the harmful effects of e-cigarettes and heated tobacco products have been proven domestically and internationally; many countries have completely banned them and Vietnam needs to follow this direction to protect public health.
In addition to the absolute agreement, some delegates suggested that it is necessary to distinguish between electronic cigarettes and heated tobacco products. Delegate Dong Ngoc Ba (Gia Lai) said that electronic cigarettes and heated tobacco products are two different concepts, and it is necessary to rely on clear evaluation criteria to determine which products should be included in the banned list.
He noted that it is necessary to clearly distinguish between the prohibition of investment and business sectors and the prohibition of circulation of goods under the Commercial Law to avoid confusion in applying the law.
Through discussion, the majority of National Assembly deputies expressed high consensus on including e-cigarettes and heated tobacco products in the list of prohibited investment and business sectors in the Investment Law (amended). The remaining opinions mainly focused on perfecting legal techniques and transitional mechanisms, not denying the harmful effects of e-cigarettes and heated tobacco products.
