In July 2025, several new policies came into effect, including: 28 decrees on decentralization, delegation of power, and delineation of authority for local governments at two levels; the authority of the Chairman of the People's Committee at the commune level to issue land use right certificates ("Red Book"); subjects required to participate in compulsory social insurance; standards and norms for the use of office buildings and facilities for public service activities; norms for automobiles serving general work at the commune level; decentralization and delegation of power in the field of emulation and commendation...

28 decrees on decentralization, delegation of power, and delineation of authority of two-tiered local governments.

The government has issued 28 decrees on decentralization and delegation of authority; defining the responsibilities between the government and local authorities at two levels, effective from July 1, 2025.

Deputy Prime Minister Nguyen Hoa Binh emphasized that the issuance of 28 decrees creates a complete, clear, and transparent legal basis for organizing and operating the two-tiered government system smoothly and stably, effectively fulfilling political tasks and serving the people. At the same time, it continues to strongly reform the administrative apparatus, improving the effectiveness and efficiency of state management in a constructive and service-oriented direction.

Minister of Home Affairs Pham Thi Thanh Tra stated: The process of drafting the decrees was carried out systematically, with a review of 5,076 legal documents, thereby identifying 2,718 tasks and responsibilities that needed to be decentralized, delegated, or clearly defined between different levels of management.

Of the 28 decrees on decentralization, delegation of power, and delineation of authority, there are: 11 decrees defining authority when organizing a two-tiered local government; 14 decrees on decentralization and delegation of power; and 3 decrees stipulating contents including decentralization, delegation of power, and delineation of authority. In addition, 4 other decrees were also developed to harmonize the legal system.

The Chairman of the People's Committee at the commune level has the authority to issue "Land Use Right Certificates".

The government issued Decree 151/2025/ND-CP on June 12, stipulating the delineation of authority between two levels of local government, and the decentralization and delegation of power in the field of land.

According to the Land Law, the authority of the District People's Committee is transferred to the Chairman of the Commune People's Committee to include: Issuing Certificates of Land Use Rights and Ownership of Assets Attached to Land as stipulated in Point b, Clause 1, Article 136 and Point d, Clause 2, Article 142 of the Land Law; re-determining the area of ​​residential land and issuing Certificates of Land Use Rights and Ownership of Assets Attached to Land as stipulated in Clause 6, Article 141 of the Land Law.

Decree 151/2025/ND-CP takes effect from July 1, 2025.

Individuals required to participate in compulsory social insurance.

The Government issued Decree No. 158/2025/ND-CP dated June 25, 2025, which provides detailed regulations and guidance on the implementation of several articles of the Law on Social Insurance regarding compulsory social insurance.

According to regulations, those subject to compulsory social insurance include: Workers who are subject to compulsory social insurance as stipulated in points a, b, c, g, h, i, k, l, m, and n of Clause 1 and Clause 2, Article 2 of the Social Insurance Law. Workers specified in points a, b, c, i, k, and l of Clause 1 and Clause 2, Article 2 of the Social Insurance Law who are sent for study, internship, or work in Vietnam or abroad while still receiving their salary in Vietnam are subject to compulsory social insurance.

The Decree stipulates the contribution rates, methods, and deadlines for mandatory social insurance contributions for employees and employers, in accordance with Articles 33 and 34 of the Social Insurance Law, and is detailed as follows:

For individuals specified in point k, clause 1, Article 2 of the Social Insurance Law who do not work and do not receive allowances for 14 working days or more in a month, neither the employee nor the employer is required to pay social insurance contributions for that month.

This Decree takes effect from July 1, 2025.

Standards and norms for the use of office buildings and facilities for business operations.

The Government issued Decree No. 155/2025/ND-CP dated June 16, 2025, stipulating standards and norms for the use of office buildings and facilities for public service activities. The Decree stipulates the principles for applying standards and norms for the use of office buildings and facilities for public service activities.

The decree stipulates that the area of ​​office buildings within a workplace includes the following types of areas: working area for the work of various positions; common area; and specialized area.

Regarding the working area for the work of various positions, the Decree stipulates the standards and norms for the use of working area for positions at the central and local levels, as specified in Appendix I and Appendix II attached to this Decree.

This Decree takes effect from July 1, 2025.

Regulations on the number of vehicles for general work at the commune level.

The Government issued Decree No. 153/2025/ND-CP amending and supplementing a number of articles of Decree No. 72/2023/ND-CP dated September 26, 2023 of the Government stipulating standards and norms for the use of automobiles. The Decree adds Article 11a. Automobiles for general work at the commune level. Accordingly, the maximum norm for the use of automobiles for general work is 2 vehicles/commune.

In addition, the Decree also amends and supplements "Article 11. Motor vehicles for general work of agencies, organizations, and units at the provincial level". This Decree takes effect from July 1, 2025.

Decentralization and delegation of authority in the field of emulation and reward.

The Government issued Decree No. 152/2025/ND-CP regulating the decentralization and delegation of authority in the field of emulation and commendation; and providing detailed regulations and guidance on the implementation of some articles of the Law on Emulation and Commendation.

The Decree clearly stipulates the specific decentralization and delegation of authority for state management tasks and powers regarding emulation and commendation. According to Decree 152/2025/ND-CP, the decentralization and delegation of authority in the field of emulation and commendation are implemented according to the principle of ensuring compliance with the Constitution; compliance with the principles and regulations on decentralization and delegation of authority in the Law on Government Organization and the Law on Local Government Organization; and consistency within the legal system, avoiding overlaps or conflicts between legal documents when implementing decentralization and delegation of authority.

Ensure maximum decentralization of tasks between central government agencies and local authorities, guarantee the unified management authority of the Government on emulation and commendation, and promote the initiative, creativity, and accountability of ministries, departments, and provinces in carrying out state management tasks related to emulation and commendation.

Promoting decentralization, delegation of power, and clear delineation of authority, ensuring consistency with the tasks, powers, and capabilities of agencies and individuals authorized to perform the assigned tasks and powers in state management of emulation and commendation, in order to improve the quality and effectiveness of patriotic emulation movements and the implementation of commendation work in the new situation.

Ensuring openness and transparency, creating favorable conditions for individuals and organizations to access information, exercise their rights and obligations, and follow procedures related to emulation and commendation as prescribed by law.

Ensuring that the implementation of international treaties and agreements to which the Socialist Republic of Vietnam is a party is not affected; the resources for carrying out the tasks are decentralized and delegated, and are guaranteed by the state budget as prescribed. This Decree takes effect from July 1, 2025.
