28 decrees on decentralization, delegation of power, and determination of authority of two-level local governments
The Government has issued 28 Decrees on decentralization and delegation; defining authority between the Government and local authorities at two levels, effective from July 1, 2025.
Deputy Prime Minister Nguyen Hoa Binh emphasized that the issuance of 28 decrees creates a complete, clear, and transparent legal basis for the smooth and stable operation of the two-level government system, well performing political tasks, and serving the people. At the same time, it is necessary to continue to strongly innovate the administrative apparatus, improve the effectiveness and efficiency of state management in the direction of creation and service.
Minister of Home Affairs Pham Thi Thanh Tra said: The process of developing decrees was carried out methodically, with the review of 5,076 legal documents, thereby identifying 2,718 tasks and authorities that need to be decentralized, delegated or clearly defined between management levels.
In 28 decrees on decentralization, delegation of power and division of authority, there are: 11 decrees on division of authority when organizing two-level local governments; 14 decrees on decentralization and delegation of power; 3 decrees regulating the contents of decentralization, delegation of power and division of authority. In addition, 4 other decrees were also developed to synchronize the legal system.
The Chairman of the People's Committee at the commune level has the authority to issue "Red Book"
The Government issued Decree 151/2025/ND-CP dated June 12, regulating the delimitation of authority of two-level local governments, decentralization, and decentralization in the land sector.
The authority of the District People's Committee as prescribed by the Land Law transferred to the Chairman of the Commune People's Committee includes: Issuing Certificates of land use rights and ownership of assets attached to land as prescribed in Point b, Clause 1, Article 136 and Point d, Clause 2, Article 142 of the Land Law; re-determining residential land area and issuing Certificates of land use rights and ownership of assets attached to land as prescribed in Clause 6, Article 141 of the Land Law.

Subjects required to participate in compulsory social insurance
The Government issued Decree No. 158/2025/ND-CP dated June 25, 2025 detailing and guiding the implementation of a number of articles of the Law on Social Insurance on compulsory social insurance.
According to regulations, subjects participating in compulsory social insurance include: Employees subject to compulsory social insurance shall comply with the provisions at points a, b, c, g, h, i, k, l, m and n, Clause 1 and Clause 2, Article 2 of the Law on Social Insurance. Employees specified at points a, b, c, i, k, l, Clause 1 and Clause 2, Article 2 of the Law on Social Insurance who are sent to study, intern or work domestically and abroad but still receive salary in the country shall be subjects participating in compulsory social insurance.

The Decree stipulates the contribution rates, methods and payment periods for compulsory social insurance of employees and employers in accordance with the provisions of Articles 33 and 34 of the Law on Social Insurance and is specified in detail as follows:
Subjects specified in Point k, Clause 1, Article 2 of the Law on Social Insurance who do not work and do not receive allowances for 14 working days or more in a month, the employee and employer do not have to pay social insurance for that month.
This Decree takes effect from July 1, 2025.
Standards and norms for the use of office buildings and career facilities
The Government issued Decree No. 155/2025/ND-CP dated June 16, 2025 stipulating standards and norms for the use of workplaces and public service facilities. The Decree stipulates the principles for applying standards and norms for the use of workplaces and public service facilities.
The Decree stipulates that the working area of the headquarters includes the following types of areas: Working area serving the work of positions; common use area; specialized area.
Regarding working area serving the work of positions, the Decree stipulates standards and norms for using working area serving the work of positions at the central and local levels as prescribed in Appendix I and Appendix II attached to this Decree.
This Decree takes effect from July 1, 2025.
Car norms for public service at commune level
The Government issued Decree No. 153/2025/ND-CP amending and supplementing a number of articles of Decree No. 72/2023/ND-CP dated September 26, 2023 of the Government regulating standards and norms for the use of automobiles. The Decree supplements Article 11a. Automobiles for general work at the commune level. Accordingly, the norm for the use of automobiles for general work is a maximum of 2 automobiles/commune."
In addition, the Decree also amends and supplements "Article 11. Cars serving the general work of agencies, organizations and units at the provincial level". This Decree takes effect from July 1, 2025.
Decentralization and delegation of authority in the field of emulation and rewards
The Government issued Decree No. 152/2025/ND-CP regulating decentralization and delegation of powers in the field of emulation and commendation; detailing and guiding the implementation of a number of articles of the Law on Emulation and Commendation.
The Decree clearly stipulates the decentralization and delegation of specific tasks and powers of state management of emulation and rewards. According to Decree 152/2025/ND-CP, decentralization and delegation of powers in the field of emulation and rewards are implemented according to the principle of ensuring compliance with the provisions of the Constitution; in accordance with the principles and regulations on decentralization and delegation of powers of the Law on Organization of the Government, the Law on Organization of Local Government; consistency in the legal system, avoiding overlap or contradiction between legal documents when implementing decentralization and delegation of powers.
Ensure maximum decentralization of tasks between central state agencies and local authorities, ensure the Government's unified management authority on emulation and rewards, and promote the initiative, creativity, and self-responsibility of ministries, departments, branches, and provinces in performing state management tasks on emulation and rewards.
Promote decentralization, delegation of power and clearly define authority, ensuring conformity with the tasks, powers and capacity of agencies and persons with authority to perform the tasks and powers assigned in state management of emulation and rewards to improve the quality and effectiveness of patriotic emulation movements and carry out reward work in the new situation.
Ensure publicity and transparency, create favorable conditions for individuals and organizations to access information, exercise rights, obligations and procedures on emulation and rewards according to the provisions of law.
Ensure that it does not affect the implementation of international treaties and international agreements to which the Socialist Republic of Vietnam is a member; Resources for performing tasks are decentralized and delegated by the state budget as prescribed. This Decree takes effect from July 1, 2025./.
