The Ministry of Health has issued regulations on the delimitation and decentralization of authority of local authorities at two levels in the field of disease prevention.
Delimitation of authority in the field of disease prevention
According to the Circular, the authority to select key surveillance locations is stipulated in Clause 1, Article 15 of Circular No. 07/2023/TT-BYT dated April 4, 2023 of the Minister of Health guiding the process and methods of HIV/AIDS epidemiological surveillance and surveillance of sexually transmitted diseases by the provincial focal point for HIV/AIDS prevention and control.
The authority to advise on organizing and implementing activities to respond to the prevention and control of infectious diseases and epidemics in the area according to the provisions of Clause 2, Article 12 of Circular No. 17/2019/TT-BYT dated July 17, 2019 of the Minister of Health guiding the monitoring and response to infectious diseases and epidemics is implemented by specialized health agencies under the People's Committees at the commune level.
The authority to manage and inspect the situation of occupational hygiene and health of workers at labor establishments in the area according to the decentralization prescribed in Clause 1, Article 16 of Circular No. 19/2016/TT-BYT dated June 30, 2016 of the Minister of Health guiding the management of occupational hygiene and health of workers is implemented by the Provincial Center for Disease Control.
Classification in the field of disease prevention
The Circular clearly states that the authority to receive dossiers for registration of declaration of conformity, issue certificates of acceptance of declaration of conformity based on the results of conformity certification by the designated conformity certification organization (third party) for tobacco as prescribed in Clause 1, Article 7 of Circular No. 49/2015/TT-BYT dated December 11, 2015 of the Minister of Health regulating the declaration of conformity and declaration of compliance with regulations for tobacco is amended and supplemented in Circular No. 17/2023/TT-BYT dated September 25, 2023 of the Minister of Health amending, supplementing and abolishing a number of legal documents on Food Safety issued by the Minister of Health, implemented by specialized health agencies under the People's Committees of the provincial level.
The authority to receive dossiers for registration of declaration of conformity and issue certificates of acceptance of declaration of conformity based on the results of self-assessment by organizations and individuals producing and trading tobacco (first party) for tobacco as prescribed in Clause 1, Article 7 of Circular No. 49/2015/TT-BYT amended and supplemented in 2023 shall be implemented by specialized health agencies under the People's Committees of the provincial level.
The authority to receive dossiers for re-registration of declarations of conformity and re-issue certificates of receipt of declarations of conformity for tobacco products as prescribed in Clause 2, Article 8 of Circular No. 49/2015/TT-BYT, amended and supplemented in 2023, shall be implemented by specialized health agencies under the People's Committees of the provincial level.
This Circular takes effect from July 1, 2025 and expires from March 1, 2027./.
