Promoting the effectiveness of tax exemption and reduction policies

On April 14, 2023, the Government continued to issue Decree 12/2023/ND-CP on extending the deadline for payment of value added tax, corporate income tax, personal income tax and land rent in 2023. Since the Government 's support policy under Decree 12 took effect, the Tax Department of Dien Bien province has actively promoted, disseminated, and coordinated with relevant units to support businesses in updating and grasping policies, and implementing procedures and documents to request an extension of tax and land rent payment according to regulations.

Decree 12 stipulates the extension of the tax payment deadline for the value added tax payable arising in the tax period from March to August 2023 and the tax period of the first and second quarters of 2023. The extension period is 6 months for the value added tax from March to May and the first quarter; 5 months for the value added tax of June and the second quarter; 4 months for the value added tax of July and the extension period is 3 months for the value added tax of August 2023. The extension period is calculated from the end date of the value added tax payment deadline according to the provisions of the law on tax administration. For corporate income tax, the tax payment deadline is extended for the provisional tax payment of the first and second quarters of the 2023 corporate income tax period of enterprises and organizations subject to the provisions of the Decree. The extension period is 3 months from the date of expiry of the deadline for payment of corporate income tax according to the provisions of the law on tax administration.

Decree 12 also stipulates an extension of the deadline for paying land rent. Accordingly, the deadline for paying land rent is extended for 50% of the land rent payable in 2023 by enterprises, organizations, households and individuals who are directly leasing land from the State under the decision or contract of a competent State agency in the form of annual land rent payment. The extension period is 6 months from May 31 to November 30, 2023. Also according to the regulations, if the taxpayer submits a request for extension to the tax authority after September 30, 2023, the tax and land rent payment deadline will not be extended according to Decree 12. Therefore, the work of propaganda, support and guidance for taxpayers is carried out seriously and in accordance with regulations by the tax authority, ensuring that taxpayers fully enjoy the policies of Decree 12 in particular and tax incentives in general.

Ms. Vu Huyen Nhung, Tax Management Team (Dien Bien District Tax Department) said: The Department has actively promoted and disseminated, and directly supported and guided taxpayers in carrying out procedures and tax declaration and payment documents to ensure that they enjoy preferential policies in accordance with regulations. Along with that, we have increased comparison and review to detect inappropriate contents for adjustment in accordance with current laws.

However, the tax extension policy under Decree 12 of the Government is only temporary, specifically from April 14 to December 31, 2023. Therefore, the implementation and application must be quick, timely, and targeted to the right subjects. Only then can the tax and land rent extension policy for organizations and individuals who pay taxes be effective.

Mr. Bui Anh Tuan, Deputy Director of Trading and Construction Company No. 6, said: After the Government issued Decree 12, the Company's accounting department completed the procedures and was notified that it was subject to Decree 12 and was allowed to delay paying taxes and land rent. Through the policies of deferring and extending tax payments, the Company has ensured a source of money to pay salaries to employees, contributing to overcoming the shortage of capital in production and business and creating conditions for enterprises to fulfill their tax obligations to the State budget.

According to statistics from the Provincial Tax Department, up to now, nearly 230 organizations and individuals in the province have had their taxes and land rents extended, with the extension amounting to over VND68 billion. Of which, value added tax is VND53 billion, corporate income tax is nearly VND3 billion, land rent is over VND12 billion, and business households are nearly VND300 million.
