In the third draft of the decree on administrative sanctions for violations in the monetary and banking sectors, which is being consulted (amending and supplementing Decree No. 88/2019/ND-CP), the State Bank proposes to impose heavy penalties for violations related to payment accounts.
Accordingly, the fine ranges from 100 to 150 million VND for acts of buying, selling, renting, leasing, borrowing, lending payment accounts (bank accounts) or buying and selling payment account information with a quantity from 1 account to less than 10 payment accounts that is not yet subject to criminal prosecution.
Fines from 150 to 200 million VND for opening payment accounts for customers and allowing customers to use payment accounts in violation of the law in the process of providing payment services.
Buying, selling, renting, leasing, borrowing, lending payment accounts or buying, selling payment account information in quantities of 10 or more payment accounts without being subject to criminal prosecution.
Penalties for leasing, borrowing, buying and selling accounts, bank cards, and e-wallets are many times higher than current regulations.
Fines of up to 200 - 250 million VND for violations such as opening or maintaining anonymous or impersonating payment accounts; stealing or colluding to steal payment account information that is not yet subject to criminal prosecution...
Not only for bank accounts, the State Bank also proposed to increase the penalty for violations of regulations on payment intermediaries (providing e-wallet services).
Accordingly, a fine of 50 - 100 million VND will be imposed for opening or maintaining anonymous or impersonated e-wallets; buying, selling, renting, leasing, borrowing, lending e-wallets; stealing, colluding to steal, buying, or selling e-wallet information from 1 e-wallet to less than 10 e-wallets.
The fine will be increased from 100 to 120 million VND for the act of opening or maintaining anonymous or impersonated e-wallets; buying, selling, renting, leasing, borrowing, lending e-wallets; stealing, colluding to steal, buying, or selling e-wallet information from 10 or more e-wallets;
Even for violations in bank card operations, the State Bank also proposed fines of 60 - 80 million VND for renting, leasing, buying, selling, or opening bank cards (except for anonymous prepaid cards) with a quantity from 1 card to less than 10 cards.
The fine will increase from 100 to 200 million VND in cases of renting, leasing, buying, selling, or opening bank cards (except for anonymous prepaid cards) with a quantity of 10 cards or more that is not yet subject to criminal prosecution;
The highest fine is up to 300 million VND for stealing, colluding to steal, buying, or selling bank card information without being prosecuted for criminal liability...
The above acts will also be accompanied by additional penalties; remedial measures will depend on each violation. The above penalties are many times higher than current regulations, in the context that in recent times, the police have dismantled many chains specializing in purchasing, renting... bank accounts for fraud and money laundering.
Most recently in February 2025, the police agencies of Dong Nai province, Hanoi city and Da Nang city reported that they had arrested many subjects involved in the illegal trading of bank account information...
