Regulations on the organization and operation of the National Medical Council

Kinhtedothi - Deputy Prime Minister Le Thanh Long signed Decision No. 5/2025/QD-TTg promulgating the Regulations on the organization and operation of the National Medical Council.

The National Medical Council is responsible for independently evaluating the competence of medical practitioners in diagnosis and treatment.

Accordingly, the National Medical Council (the Council) is an organization established by the Prime Minister with the function of independently evaluating the professional capacity of medical examination and treatment practitioners, and has its own seal and bank account.

The council's English name is Vietnam National Medical Council (VNMC).

The National Medical Council is headquartered in Hanoi .

Organizational structure of the Council

The Council consists of a Chairman, a Vice Chairman, and Council members.

The Chairman of the Council is the Head of the Ministry of Health, holding the position concurrently.

The Vice-Chairpersons of the Council include: 01 Standing Vice-Chairperson working full-time, 01 Vice-Chairperson who is the Director of the Department of Medical Examination and Treatment Management under the Ministry of Health (concurrently holding the position), and 01 Vice-Chairperson who is the Director of the Department of Science, Technology and Training under the Ministry of Health (concurrently holding the position).

The Council members include: representatives from medical examination and treatment facilities; representatives from health-related training institutions; representatives from professional associations and medical experts; and representatives from state management agencies. One member also serves as the Council Secretary. The number of Council members is decided by the Chairman of the National Medical Council based on the Council's actual needs.

The Council also includes specialized committees: the Committee for Developing a Toolkit for Assessing the Competence of Medical Practice; the Committee for Organizing Examinations and Assessments of the Competence of Medical Practice; and the Legal Committee.

Operating principles of the Council

The Council operates on the principles of collective decision-making, democracy, independence, openness, and transparency in carrying out its tasks, ensuring compliance with the law. Open and democratic discussions are held to decide on issues related to the Council's activities. Important issues requiring open and democratic discussion and consultation with the Council must be addressed before the Chairman signs and issues a document.

The Council is an independent organization that collaborates with and supports ministries, departments, local governments, and professional associations operating in the healthcare sector to fulfill its functions and duties.

The National Medical Council was established by Decision No. 827/QD-TTg dated August 13, 2024, of the Prime Minister. The National Medical Council performs the tasks stipulated in Clause 3, Article 24; Clause 2, Article 25; Clause 3, Article 120 of the Law on Medical Examination and Treatment; and Clauses 2, 3, and 4, Article 9 of Government Decree No. 96/2023/ND-CP dated December 30, 2023, detailing certain provisions of the Law on Medical Examination and Treatment; and other tasks as assigned by the Prime Minister.
