Increasing transparency through expanding the application of land price lists

According to the program of the 10th Session of the 15th National Assembly, on the afternoon of December 1, the National Assembly discussed in the hall the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.

Discussing at the meeting, delegate Do Thi Viet Ha (Bac Ninh) gave her opinion on the content of regulations on land recovery, compensation, support, and resettlement in Article 3 of the draft Resolution.

Accordingly, Clause 3 stipulates the conditions for land recovery for the purposes of national defense, security, socio-economic development, national and public interests. Basically, delegates agreed with the addition of regulations on the conditions for land recovery for the purposes of national defense, security, socio-economic development, national and public interests in cases of land recovery. At the same time, the exclusion regulations as in the draft Resolution will also ensure more convenience and flexibility for the implementation of important national projects, urgent public investment projects, and other projects that the majority of people whose land is recovered agree to hand over the site in advance, thereby also removing difficulties and shortening the time for land recovery.

To ensure that this regulation is consistent and consistent with current regulations, especially ensuring feasibility in the implementation process, delegates from Bac Ninh province proposed to continue reviewing the regulations on conditions in a strict and feasible direction, ensuring a balance between national interests and people's rights, ensuring a fair and transparent process and a satisfactory compensation and resettlement mechanism, respecting the legitimate rights of people and avoiding possible abuse for national and public interests.

According to delegate Viet Ha, there are currently two current regulations related to this content, which are Clause 15, Article 4, Investment Law and Clause 3, Article 82, Land Law. Therefore, the delegate proposed to continue reviewing and researching to clarify the content of excluding urgent public investment projects according to the provisions of the law on public investment, to ensure that there is no partial overlap with the case of land recovery in Clause 3, Article 82. At the same time, it is necessary to clarify the relationship between cases of land recovery for the purpose of national defense, security, socio-economic development, for national and public interests and the implementation of urgent public investment projects, because the criteria for determining these types of projects are different.

Concerned about the content of land recovery, delegate Nguyen Duy Thanh ( Ca Mau ) requested to clarify the cases where the State recovers land for national and public interests, especially for BT projects (projects invested in the form of build - transfer). Citing the current reality that many localities have difficulty in recovering land to create land funds to pay for projects under BT contracts, the delegate said that the draft Resolution must clearly stipulate which cases fall within the scope of "socio-economic development for national and public interests" for the State to recover land; which cases are not allowed.

“This is to avoid abuse, to avoid turning land acquisition for public benefit into land acquisition to pay investors, causing legal risks and social outrage,” the delegate stated.

The delegate from Ca Mau province emphasized that the specific mechanism is only to remove obstacles, so it is necessary to clarify the responsibility for explanation and information disclosure, especially for projects using land as a BT payment fund. In addition, there must be a control framework, reporting regime, and periodic monitoring to limit negativity and ensure transparency. The delegate said that it is necessary to study and supplement specific principles for determining the value of land use rights to pay for BT projects, ensuring no loss of state assets and in accordance with the provisions of law on investment under the public-private partnership method.

Expressing his agreement and strong support for the issuance of the Resolution, Nguyen Thanh Nam (Phu Tho) said that this is an urgent and timely document demonstrating the Party and State's strong determination to break the long-standing deadlock of investment projects and enhance transparency through expanding the application of land price tables and land price adjustment coefficients.

In particular, delegate Nguyen Thanh Nam strongly supported the view that the State, as the owner's representative, must exercise the right to control and decide on land prices. The State must act as the "architecture of the market" to resolve the paradox of land prices in Vietnam being much higher than the world average compared to the average income of the people.

In addition, it is necessary to professionalize land valuation work in the direction of strengthening the specialization of public land valuation consultancy organizations according to the model of public service units or 100% state-owned enterprises, organizationally independent from land management agencies and price management agencies to strengthen the implementation of ordering tasks instead of the prolonged bidding mechanism of private consultancy organizations.

In addition, according to the delegate of Phu Tho province, it is necessary to further enhance the role of the Land Fund Development Center in participating in the purchase, sale and management of land reserve projects according to the planning; on the other hand, it is necessary to study the integration of social security policies in compensation and support, giving priority to bringing farmers and freelance workers who are past or near the end of working age into the social insurance system, shifting the focus of compensation from asset value to sustainable livelihood value.
