On the afternoon of November 24, continuing the 51st session, under the direction of Vice Chairman of the National Assembly Nguyen Duc Hai, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly amending and supplementing a number of articles of Resolution No. 98/2023/QH15 on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City; the draft Resolution of the National Assembly amending and supplementing a number of articles of Resolution No. 136/2024/QH15 on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang City.

Propose specific, superior, stricter and more effective mechanisms and policies

Briefly presenting the Government's Report, Minister of Finance Nguyen Van Thang said that the draft Resolution of the National Assembly amending and supplementing a number of articles of Resolution No. 98/2023/QH15 on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City was built to continue perfecting the legal basis, ensuring specific, superior, strict, feasible and more effective mechanisms and policies, meeting urgent requirements in attracting strategic investors, mobilizing domestic and foreign resources for development investment, meeting the requirements and development orientation of the City after the merger.

Regarding attracting strategic investors (Article 7), the draft Resolution adds 11 priority project groups to attract strategic investors in Clause 1, Article 7 of Resolution No. 98/2023/QH15 to expand the list of priority projects to attract strategic investors; focusing on large investment projects, leading in the development of transport infrastructure, urban infrastructure, tourism infrastructure, culture - sports, specialized healthcare, clean energy, logistics, environmental protection (treatment, conversion of decommissioned landfills, construction of urban wastewater collection and treatment plants, key urban development areas identified according to the general planning of Ho Chi Minh City...) investment projects in areas with particularly difficult socio-economic conditions.

The draft Resolution supplements Article 7a stipulating the establishment of a complete legal framework for the Free Trade Zone model, including: location, functional area structure, management mechanism, authority, land policy, investment incentives, simplification of administrative procedures and special customs mechanism. In particular, the authority is given to the People's Committee of Ho Chi Minh City to decide on the establishment, expansion and adjustment of the boundaries of the Free Trade Zone, considering this as a decision to locally adjust the City's general planning. At the same time, the City People's Council stipulates the order and procedures for establishing, expanding and adjusting the boundaries of the Free Trade Zone.

Summarizing the main contents of the Government's Submission on the draft Resolution amending and supplementing a number of articles of Resolution No. 136/2024/QH15 dated June 26, 2024 of the National Assembly on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang City, Minister of Finance Nguyen Van Thang said that the draft Resolution amends and supplements Article 11 on planning, urban, natural resources and environmental management (6 contents).

In which, adding cases of land recovery as a basis for creating a site for implementing a number of projects, including: logistics service projects serving seaports, airports, inland waterway ports in the City (similar to the regulations for Hai Phong free trade zone) and Exhibition Center, mineral exploitation projects for common construction materials in the City that have been identified in the plan for auctioning mineral exploitation rights or mineral areas that are demarcated as areas not auctioning mineral exploitation rights as decided by the City People's Council.

Mechanisms and policies need to focus on promptly removing "bottlenecks"

Reporting on the preliminary examination of the draft Resolutions, Chairman of the Economic and Financial Committee Phan Van Mai said that the Standing Committee of the Committee agreed on the necessity of drafting two Resolutions to submit to the National Assembly for consideration and approval according to the procedures at the ongoing Tenth Session.

However, the draft Resolution of the National Assembly amending and supplementing a number of articles of Resolution No. 136/2024/QH15 on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang City has not received comments from competent authorities as required in Resolution No. 136/2024/QH15. The Government is requested to report to competent authorities for comments on the content of the draft Resolution. In case the competent authorities agree, the Standing Committee of the Committee will submit the draft Resolution to the National Assembly Standing Committee for consideration and addition to the agenda of the 10th Session.

Regarding the draft Resolution amending and supplementing a number of articles of Resolution No. 98/2023/QH15, the Standing Committee of the Committee found that many policies proposed for amendment and supplementation directly impact the state budget, land use management and public assets, impact and influence the socio-economic life of the people and the City, as well as the whole country.

To ensure consistency and feasibility, the Standing Committee of the Committee requests the drafting agency to thoroughly review and evaluate the overall impact of the proposed policies for amendment and supplementation. The mechanisms and policies for amendment and supplementation need to be focused, have a focus, and must be truly breakthrough and outstanding, exploiting the potential and strengths of the City; promptly removing difficulties and obstacles, effectively resolving " bottlenecks ". Ensuring publicity and transparency, avoiding the risk of group interests and policy exploitation.

Regarding the draft Resolution amending and supplementing a number of articles of Resolution No. 136/2024/QH15, Chairman of the Committee Phan Van Mai said that the scope of the proposed amendments and supplements is important and urgent, but spread across many areas; many provisions stated in the draft Resolution overlap with provisions of current laws and Laws and Resolutions being submitted to the National Assembly for consideration at the 10th Session or have provisions that are not within the authority of the National Assembly.

The Standing Committee of the Economic and Financial Committee requested the drafting agency to thoroughly review and evaluate the overall impact of the proposed policies for amendments and supplements. The mechanisms and policies for amendments and supplements need to be focused, have a focus, and must be truly breakthrough, outstanding, and exploit the potential and strengths of the City.

Speaking at the meeting, National Assembly Chairman Tran Thanh Man agreed with the amendment and supplementation of a number of articles of Resolution No. 98/2023/QH15 and Resolution No. 136/2024/QH15; noted that it is necessary to ensure the introduction of specific and outstanding mechanisms and policies for the development of Ho Chi Minh City and Da Nang City; and that the policies and mechanisms that the National Assembly has decided to apply to Hai Phong City and a number of localities can be applied.

The National Assembly Chairman also emphasized that mechanisms and policies must be focused, have a core, and key points, avoid spreading; ensure feasibility, and promptly resolve newly arising issues and difficulties that have been clearly stated in the Government's Submissions.

National Assembly Chairman Tran Thanh Man also suggested that decentralization and delegation of power should be strong; the two cities must strongly implement any authority that should be delegated to units, to ward and commune levels. In particular, to ensure effective implementation of these two Resolutions after they are issued, the implementation stage must be drastic, determined and determined to produce results.

“Now, asking is very difficult, deciding is also very difficult, but implementation is slow, running out of the best time. And, localities, ministries and branches also need to pay attention to not let negativity, corruption and policy abuse arise,” the National Assembly Chairman emphasized.

Regarding the method of implementation, the National Assembly Chairman suggested that after this meeting of the National Assembly Standing Committee, the Government should direct the Ministry of Finance to coordinate with the People's Committees of Ho Chi Minh City and Da Nang City to absorb and carefully complete the Reports. At the same time, the Economic and Financial Committee should coordinate closely with the Law and Justice Committee to examine and include the contents under the authority of the National Assembly; assign the Government to regulate the contents under the authority of the Government. The Law and Justice Committee should coordinate closely with the Economic and Financial Committee to specifically examine which contents should be submitted to the National Assembly and which contents should be under the authority of the Government.

Concluding the discussion, Vice Chairman of the National Assembly Nguyen Duc Hai suggested that the Government study and absorb the opinions of the Chairman of the National Assembly, the Standing Committee of the National Assembly and the examining agencies to complete the draft Resolution dossier, ensuring quality.

Continue to review and complete the draft Resolution, ensuring that there are sufficient necessary, outstanding, feasible, and appropriate mechanisms and policies for Ho Chi Minh City and Da Nang after the merger and consolidation. Overcome limitations, difficulties, and inadequacies in implementing Resolution 98 and Resolution 136 of the National Assembly; ensure that after the Resolution is issued, the two cities will implement the set goals according to the Party's policies and resolutions of the City Party Committee. Do not include in the Resolution policies under the authority of the Government and not under the authority of the National Assembly.
