(MPI) - On the afternoon of August 19, 2024, Deputy Minister of Planning and Investment Nguyen Thi Bich Ngoc chaired a meeting with relevant units under the Ministry on the proposal to develop a Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding. Attending the meeting were representatives of the Law Committee and the Economic Committee of the National Assembly.

Speaking at the opening of the meeting, Deputy Minister Nguyen Thi Bich Ngoc said that on August 14, 2024, Prime Minister Pham Minh Chinh , Head of the Steering Committee for reviewing and handling difficulties in the system of legal documents, chaired a meeting of the Government Standing Committee on reports proposing amendments and supplements to laws under the management of the Ministry of Planning and Investment related to the development of the draft Law on Public Investment (amended); development of the draft Law on amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.
Pursuant to the provisions of the Law on Promulgation of Legal Documents, Resolution No. 93/NQ-CP dated June 18, 2024 of the Government on key tasks and solutions to promote growth, control inflation and stabilize the macro-economy and the Conclusion of Prime Minister Pham Minh Chinh on the 2nd meeting of the Steering Committee for reviewing and handling difficulties in the system of legal documents in Notice No. 386/TB-VPCP dated August 16, 2024 of the Government Office , the Ministry of Planning and Investment shall develop a report on the draft Law on Public Investment (amended); develop a draft Law on amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.
The proposal to review and develop a Law amending and supplementing the above laws follows the principles of selecting amendments and supplements to the provisions of the laws to overcome urgent shortcomings and limitations to create favorable conditions for investment, production and business activities; simplify administrative procedures, promote decentralization and delegation of power on the basis of ensuring the effectiveness and efficiency of state management; and strengthen inspection and supervision.
At the same time, focus on the contents that have clearly defined amendment options, ensuring that they do not affect the general consistency of the Laws, avoid affecting the provisions of related laws, especially the laws that have just been passed by the National Assembly; at the same time, ensure stability so that it can be inherited when comprehensively amending and supplementing the laws.
At the meeting, heads of units assigned to preside over the drafting of relevant draft laws reported on the proposed amendments and supplements; delegates focused on discussing major issues of an open and principled nature; whether or not there were issues that needed to be amended, supplemented, or included in the draft law; emphasizing issues related to the necessity and purpose of promulgating the document; scope, objects, objectives, content of the policy, and solutions for implementing the policy in the proposed drafting of the document.

In particular, for the field of bidding and PPP, delegates emphasized the field, minimum investment capital scale, the proportion of state capital participating in implementing PPP projects, the type of BT, BOT projects, implementing the TOD model; mechanisms and policies to continue simplifying procedures, promoting decentralization of management for PPP projects, facilitating investment preparation, speeding up project implementation progress; contents related to transitional BOT, BT projects; some bidding activities carried out before the project and international treaties are approved and signed; contractor selection in special cases; the application of international bidding, restricted bidding, etc.
Regarding the Law on Planning, focusing on discussing the process of organizing the implementation of planning policies and laws in practice, there have been a number of difficulties and problems that need to be amended, supplemented and improved to meet the requirements of socio-economic development such as the national planning system; planning content, authority to issue planning implementation plans and procedures for planning adjustment; funding for planning activities... to create a flexible mechanism in using state budget sources suitable to the nature of each type of planning and speed up the planning process.
Regarding the Investment Law, the contents related to the authority to decide on investment policies; the appraisal of the suitability of investment projects with urban planning; termination of project investment activities;... were focused on by delegates for comments.
Concluding the meeting, Deputy Minister Nguyen Thi Bich Ngoc highly appreciated the frank and responsible opinions of the delegates; this is an important basis for the units assigned to preside over the amendment of relevant laws to study, absorb and supplement the report proposing the development of the Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding. At the same time, she requested the units assigned to preside over the development of the Law amending and supplementing a number of articles of the above Laws to urgently study, explain and clarify the contents to seek opinions from relevant subjects according to the provisions of the Law on promulgation of legal documents.
The drafting of the law must ensure the purpose of resolving urgent difficulties and problems in practical implementation related to planning, implementation of business investment activities, investment under the PPP method and bidding activities; simplifying administrative procedures, strengthening decentralization to localities, combined with strengthening inspection and supervision.
Focus on amending and supplementing some provisions of laws that are contradictory, causing difficulties and obstacles, and requiring urgent amendments to facilitate investment, production and business activities; the provisions that need to be amended and supplemented must clearly define the content, amendment and supplement plans and assess specific impacts; ensure the consistency and unity of the legal system./.
