The National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization.

Clearly define the responsibilities of the agency in charge of security industry and the Security Industry Development Management Council.

One of the basic contents of the draft Law is to separate the National Defense and Security Industry Fund into two independent funds: the Security Industry Development Investment Fund and the National Defense Industry Fund, assigning the Ministry of Public Security to manage the Security Industry Development Investment Fund; at the same time, adding a section on the National Security Industry Complex, which stipulates the functions, tasks, composition of the complex, the core of the complex, members participating in the complex and the State's policies towards the complex.

The majority of National Assembly deputies agreed with the additional content on the National Security Industrial Complex to promptly institutionalize Conclusion No. 158-KL/TW of the Politburo , which directs the formation of a National Security Industrial Complex led and oriented by the State, with the core being the core security industrial establishments under the Ministry of Public Security, with the participation of organizations and enterprises inside and outside the People's Public Security with resources and scientific and technological potential to organize research, design, manufacture, test, produce and complete security industrial products.

National Assembly Deputy Trinh Xuan An (Dong Nai) emphasized that the addition of content on the Security Industry Investment Fund and the National Security Industry Complex aims to realize the goal of building and developing a modern, democratic, self-reliant, dual-purpose, and modern defense and security industry; contributing to protecting the Fatherland and consolidating security and defense potential in the new period.

National Assembly Deputy Le Nhat Thanh (Hanoi) agreed with the addition of Section 8 to Chapter II of the current Law, with 4 articles regulating the National Security Industrial Complex, corresponding to the structure of Section 7, Chapter II of the current Law on the National Defense Industrial Complex, in order to separate two separate, independent complexes with their own specific regulations.

In addition, delegate Le Nhat Thanh also basically agreed with the content of amending and supplementing Article 79 stipulated in Clause 5, Article 1 of the draft Law on the responsibility of the Ministry of Public Security to establish a Security Industry Development Management Council to lead, orient, and comprehensively coordinate the activities of the national security industry complex, manage the Security Industry Development Investment Fund and assist the Minister of Public Security in directing the tasks of building and developing the security industry; supplementing Clause 8, Article 79 stipulating the responsibility of the Ministry of Public Security in managing and implementing the certification of conformity of security industry products and services with corresponding standards or regulations, in accordance with the Law on Technical Standards and Regulations.

Delegate Le Nhat Thanh suggested that the drafting agency study and clarify the position, functions and tasks of the Security Industry Development Management Council or assign the Minister of Public Security to stipulate them; it is necessary to clearly define the responsibilities of the specialized agency for security industry as prescribed in Clause 6, Article 79 of the current Law and the Security Industry Development Management Council as newly added in the draft Law in Clause 7, Article 79.

Identify suitable industrial complex components

According to Clause 2 of Article 45a added in the draft Law, the National Security Industrial Complex has the functions and tasks of researching, applying science and technology, designing, manufacturing, testing, producing, completing, repairing, converting, improving, and modernizing security industrial products and services, focusing on the following groups of products and services: industrial safety products and services, network security; industrial products and services of big data, cloud computing, blockchain, artificial intelligence applications based on national big data; professional technical products, criminal techniques, support tools, military uniforms of the police sector; patrol vehicles on coastal routes and rivers; fire prevention, firefighting and rescue products; special biotechnology products serving biosecurity; technical equipment, means, technology, and services to ensure aviation security; other products and services according to the decision of competent authorities.

The national security industrial complex also has the task of mastering strategic technology, foundation technology, core technology, transferring and receiving advanced and modern technology transfer; mobilizing national resources to develop security industry; researching, producing, providing products and services to serve people's lives, transferring appropriate technology to people's lives industry, serving socio-economic development; improving international competitiveness, participating in exporting security industry products and services.

Commenting on this content, delegate Trinh Xuan An said that it is necessary to determine according to the value chain to form certain product and service sectors for management. In addition, it is necessary to review other related laws and draft laws such as the Law on Cyber ​​Security, the Law on Data, the draft Law on Artificial Intelligence, etc. to determine the appropriate components of industrial complexes.

Explaining and clarifying a number of issues of interest to National Assembly deputies, Minister of Public Security Luong Tam Quang said that the product groups listed in Point a, Clause 2, Article 45a of the draft law are key product groups specifically identified by competent authorities and required for the National Security Industrial Complex to invest in and develop until 2030, with a vision to 2045.

“This is the mechanism we require to order these complexes to be researched and developed to be in line with the vision of national development.” Emphasizing this, the Minister of Public Security also stated that the regulation of product and service groups under the functions and tasks of the National Security Industrial Group also aims to affirm the difference between the National Security Industrial Group and the Defense Industrial Group.

To ensure flexibility and feasibility in the process of building and developing the security industry, the Government has proposed assigning the Minister of Public Security to decide on the specific product and service categories belonging to the product and service groups researched and developed by the National Security Industry Complex.

Regarding the establishment of the Security Industry Development Management Council, the Minister of Public Security said that the establishment of the Security Industry Development Management Council is a breakthrough solution to enhance the effectiveness of the security industry development task in the new era. The Security Industry Development Management Council is established by the decision of the Minister of Public Security and the Chairman of the Council directly leads and coordinates activities in the security industry sector, ensuring unity, efficiency, effectiveness and efficiency; at the same time, ensuring the requirements of the law, not affecting the function of assisting the Government in state management of the security industry of the Ministry of Public Security.
