It is necessary to supplement clear regulations on criteria for selecting enterprises and organizations to participate in the National Security Industrial Complex.

Commenting on the draft Law amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization at Group 8 (including the National Assembly Delegation of Bac Ninh and Ca Mau provinces), National Assembly Delegate Tran Thi Van (Bac Ninh) agreed with the necessity of amending and supplementing the Law to contribute to enhancing healthy competition and encouraging businesses to invest in developing technology and production capacity in the security sector.

B ensures transparency, objectivity, unity and enhances healthy competition

Regarding the regulations on the functions and tasks of the security industrial complex, National Assembly Delegate Tran Thi Van ( Bac Ninh ) agreed with the addition of regulations on the National Security Industrial Complex to form a new organizational model, playing a focal role in research, production, application and development of security industry in a modern, dual-use direction.

However, delegates suggested that the Drafting Committee carefully review the functions and tasks of the Group to ensure that important content is not omitted and to avoid overlap with existing agencies, organizations and enterprises.

The delegate suggested that the Drafting Committee consider adding the concept of “strategic technology” to the wording explanation of the draft Law, covering the scope of the Law. According to the delegate, the current Law has explained the concepts of “foundational technology” and “core technology” relatively clearly. In fact, the process of deploying the defense and security industry shows that it is necessary to define an additional group of “strategic technologies”, which have the meaning of guiding, controlling, ensuring technological superiority and national autonomy in the field of defense and security.

Regarding the composition of the national security industrial complex, the delegate suggested that the Drafting Committee add the concept of "Security Industry Development Management Council" in the wording explanation of the draft Law, in order to clarify the legal position, functions, tasks and authority of this organization in the system of state management agencies on security industry.

“Not clearly defining the concept can easily lead to confusion in implementation and overlap with other management and coordination agencies in the security industry sector,” delegate Tran Thi Van emphasized.

Regarding the criteria for selecting enterprises and organizations to participate in the National Security Industrial Complex, delegates proposed to supplement regulations on criteria for selecting enterprises and organizations to participate in the National Security Industrial Complex... According to delegates, clearly defining the criteria is extremely necessary to ensure transparency, objectivity and consistency in the selection process, avoiding arbitrary or administrative application. Criteria may include financial capacity, scientific and technological potential, reputation, experience in the field of security industry, as well as the ability to participate in the production chain, research, manufacturing and technology transfer to serve the task of ensuring national security.

Specifying selection criteria not only creates a solid legal basis for competent authorities in considering and approving members of the Consortium, but also contributes to enhancing healthy competition and encouraging businesses to invest in developing technology and production capacity in the security sector.

"This is also an important solution to improve the operational efficiency of the National Security Industrial Complex, ensuring that the Complex truly gathers capable and prestigious units, capable of participating in implementing important and strategic tasks on security industry in the new situation," said National Assembly Deputy Tran Thi Van.

It is necessary to clearly define the coordination mechanism between members of the Group.

Also related to the draft Law on amending and supplementing a number of articles of the Law on National Defense Industry, Security and Industrial Mobilization, giving comments on members participating in the national security industrial complex, delegate Tran Thi Van agreed with clearly defining the composition, rights and obligations of members participating in the national security industrial complex, considering this an important step forward in expanding public-private cooperation and promoting social resources in developing the security industry.

However, according to the delegate, some contents need to be regulated more specifically and clearly to ensure feasibility and consistency with the current legal system. Specifically as follows:

Regarding the criteria and mechanism for selecting members , according to the delegate, the new draft stops at the regulation that "participating members are organizations and enterprises inside and outside the People's Public Security with scientific and technological capacity and potential" . This regulation is still general, lacking quantitative criteria and a mechanism for assessing capacity. Therefore, the delegate suggested that the Drafting Committee study and supplement specific regulations on the criteria for selecting members, including: research and production capacity, financial capacity, technological capacity, reputation, experience in cooperation in the field of security, ensuring information security and state secrets; at the same time, there are regulations to encourage high-tech private enterprises, innovative start-ups, research institutes, and qualified higher education institutions to participate, creating conditions for expanding the innovation ecosystem in the field of security industry.

Regarding the coordination, management and information sharing mechanism, National Assembly Deputy Tran Thi Van said that the draft has not yet clearly stipulated the coordination mechanism between members of the Consortium. There are suggestions for additional regulations: specifying the coordination mechanism, linking production - research - testing - commercialization of products between members, ensuring operations along the value chain, avoiding duplication or unfair competition; establishing a mechanism for sharing information, data and research results within the permitted scope, having a mechanism to protect state secrets and commercial confidentiality, ensuring information security and intellectual property rights; building a system for evaluating, ranking and periodically checking members of the Consortium, as a basis for considering maintaining or withdrawing membership, ensuring discipline, professionalism and efficiency in operations...
